Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS On October 19, 2021, Chuck Kirchner met with Richard Williams to conduct a pre-operational inspection for Phase 2 of the Orange County C&D Landfill on Eubanks Road in Chapel Hill, Orange County. 1. The construction and demolition debris (C&D) landfill (permit number 68-04) is located adjacent to the Orange County Closed Municipal Solid Waste (MSW) Landfill (South Landfill), the Orange County Closed MSW Landfill (North Landfill), the Orange County Closed C&D Landfill (North Landfill), the Orange County Household Hazardous Waste (HHW) Collection Facility, and the wood grinding area (permit number 68-01). 2. The facility is open Monday through Friday 7:00 am - 4:00 pm and Saturday 8:00 am - 12:00 pm. 3. The facility permit and permit application comments were discussed. 4. The permit currently authorizes operation of the C&D landfill, Phase 1. 5. Six inches of earthen material, used as cover, is required weekly and when the disposal area exceeds one-half acre. 6. The working face appeared small and compact. 7. The landfill cap, side slopes, and groundcover appeared maintained. 8. No windblown litter observed this inspection. 9. There was no indication of erosion or runoff. 10. Landfill edge of waste markers were observed. 11. Phase 2 area of the C&D landfill was observed this inspection. 12. Ensure edge of waste markers are installed around the phase 2 area as landfill operations move into this area in the future. 13. The landfill sediment basin appeared maintained. 14. No windblown material was observed during this inspection. 15. Landfill Gas Well, GP-22, was observed this inspection. Well casing, lock and label appear to be in compliance with 15A NCAC 02C .0108 (k, l, m & p). 16. Orange County has a Temporary Disaster Debris Staging Site (TDDSS, DS68-002) located adjacent to the active area of the C&D landfill in the undeveloped area allotted for Phases 2 and 3. This site was deactivated on March 13, 2019. 17. Effective January 1, 2021, the establishment of temporary debris storage and reduction sites (TDSRs), formerly called Temporary Disaster Debris Staging Site (TDDSS), and the management of debris and wastes regulated under 15A NCAC 13B are required to meet the provisions of rule 15A NCAC 13B .0208(b) in order to be temporarily exempt from solid waste permitting requirements. 18. 15A NCAC 13B .0208(b) states: “A temporary debris storage and reduction site (site) shall not be required to obtain a permit from the Division for the temporary operation of these sites for solid waste management after a disaster event if the operations comply with Article 9 of Chapter 130A of the General Statutes, the rules of this Subchapter, and the following conditions: (1) A site shall accept only waste generated by a disaster event for storage, segregation, processing, and reduction. A site shall not be used for solid waste management at any time other than following a disaster event. For the purposes of this Rule, "disaster event" means one of the following: (A) a natural or man-made event that causes a declaration of a state of emergency or disaster in accordance with Chapter 166A, Article 1A, Part 4 of the General Statutes; or (B) a hurricane, tornado, severe storm, ice storm, or a 100-year flood event. (2) The landowner or operator of the site shall submit notification of the proposed site to the Division on a site evaluation form, which may be found on the Division's website at https://deq.nc.gov/about/divisions/waste-management/waste-management-permit-guidance/solid-waste-section/disaster-debris, that shall include the following: (A) site name, address, city, county, parcel identification number, and latitude and longitude in decimal degrees, driving directions to the site, and acreage of the site; (B) primary operator contact name, telephone number, and e-mail address, and any business name; FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 3 (C) local government contact name, telephone number, and e-mail address; (D) landowner name, mailing address, telephone number, and e-mail address; (E) waste types proposed to be accepted; (F) proposed site operations and procedures for waste acceptance, handling, reduction, and removal; (G) proposed destination of waste or materials removed from the site; and (H) an aerial photograph indicating the proposed waste handling areas at the site and the buffer areas required in accordance with this Rule.” 19. The TDSR DS68-002 will need to be closed or relocated as phase 2 and phase 3 of the C&D landfill progress. DS68-001 is also located at this facility east of the closed landfill. 20. The New Hope Fire Department can be contacted to address an emergency at the facility. 21. The facility has an all-weather access road. 22. The facility is secured by a locked gate. The facility sign is located at the entrance to the scale house on Eubanks Road across from the C&D landfill.
