RESOLVED: 15A NCAC 13B .1626(2)(a): cited for failure to ensure all MSWLF units are covered with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter and scavenging. Mr. Bivins provided photographs of the area on September 27, 2021. During the inspection of Phase 3 adequate cover was observed on the southern side slope, western side slope and top. Mr. Bivins stated facility staff will apply six more inches of cover on top in preparation for seeding the entire area. Therefore, this violation is considered resolved. '_,_ .. qAV Ok _ sr FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The facility stopped accepting waste in the C&D unit March 2019, and all waste is now being directed to the MSWLF. 2. Well established vegetative cover was observed on the cap of the C&D landfill. 3. The working face of the MSWLF was small and well controlled. 4. A facility staff member was observed picking up windblown liter around the MSWLF. 5. Adequate cover was observed on the top and side slopes of Phase 3 of the active MSWLF. (See Past Noted Violations section of this report for additional information.) 6. Facility staff were dressing the cap of Phase 3 in preparation for seeding.
