OBSERVED VIOLATIONS:
1. 15A NCAC 13B .1626(2)(a) states: "Except as provided in Sub -Item (b) of this Item, the owners or operators of all
MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each operating day, or
at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter, and scavenging ".
During the inspection of Phase 3 an area south of the working face was observed to have inadequate cover. This area
was pointed out to Mr. Bivins and he stated he would have facility staff apply additional cover.

Lincoln County is in violation of 15A NCAC 13B .1626(2)(a) for failure to cover disposed solid waste with six
inches of earthen material at the end of each operating day at the MSW Landfill.

To achieve compliance, Lincoln County must cover all waste with six inches of earthen material by October 8, 2021.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. Proper signage was observed at the entrance of the facility.
2. The facility is permitted to receive solid waste generated within Lincoln County.
3. The facility accepted an average 169 tons per day of MSW/CD waste (January 2020 — December 2020) and 155 tons
per day of MSW/CD waste (January 2021 — August 2021).

Operations Inspection of the MSW Landfill Unit:
4. The facility is currently working in Phase 3 and Phase 4 laying down fluff layer.
5. No unacceptable waste streams were observed in the MSWLF.
6. Edge of waste markers were observed.
7. All access roads maintained in good condition.
8. Working face was small and compact.
9. The facility utilizes soil and spray -applied Mortar Coating (SMC) for daily cover.
10. Slight amount of windblown was observed along the southern roadway to the working face. Waste observed
appeared to be no more than from daily activities. Ensure all windblown waste is picked up at the end of each
working day.
White Goods & Scrap Metal Collection Area
11. The facility has contracted with Carolina Metal Group to collect the metal containers from all the counties
convenience sites and take directly to their facility in Gaston County. The facility had a small area for local residents
to drop off metal. Facility staff load the metal into a container and transport to Carolina Metals Group.

Scrap Tires
13. Scrap tires are collected and stored in US Tire semi -trailers.
14. The area was organized and well maintained.
Electronic Recycling
15. All electronics are collected and taken for recycling by Synergy in Greensboro, NC.
16. The area was organized and well maintained.
17. All electronics were palletized, wrapped and ready for Synergy to pick up.
Used Oil Collection
18. The area is located in a fenced in are on the NE side of the office building. Citizens are escorted to the area for
disposal.
19. Used oil is utilized for heating the shop at the facility.
Small Type 1 Composting — Yard Waste
20. Lincoln County owns the tub grinder used to process the yard waste. Currently it is down for maintenance and parts
have been ordered.

22. After composting (131 °F for at least three days) the mulch is either distributed for use at Lincoln County facilities
for beautification or given away to Lincoln County residents at no cost.
Records Review
23. Reviewed 1 st Semi-annual monitoring report dated April 2019, 2nd Semi-annual monitoring report dated October
2019, 1 st Semi-annual monitoring report dated April 2020 and 2nd Semi-annual monitoring report dated October
2020. All reports were reviewed on the divisions database.
24. The landfill gas monitoring plan consists of gas monitoring wells MMW-1,2,3,4,5,6,7,8 along with the landfill shop
and scale house.
25. Landfill gas monitoring is performed by facility staff monthly and results are submitted to the Section quarterly.
26. The facility has two 325,000 gallon above ground storage tanks.
27. Leachate is gravity fed to the lift station which pumps the leachate up to the leachate tanks.
28. Leachate is pumped and hauled by landfill staff to the City of Lincolnton WWTP.
