The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS:
1. All photos included in this report were taken by Susan Heim during the inspection on September 14, 2021,
unless otherwise noted.
2. Mr. Tate stated that the county had again been having problems with the contracted tire disposal company, New
River Tire. He explained that they had been having difficulties getting empty trailers at the facility. Mr. Tate
was provided with additional contact information for the president and owner of New River Tire, Ben Bryant,
following the inspection. Mr. Tate stated that he had gone so far as to contract with a local trucking firm to haul
tires directly from the landfill to New River's facility in Surry County. Ensure that the scrap tire stockpile
does not exceed the maximum dimensions set forth in 15A NCAC 13B .1107(2)(a); and that all scrap tires
stored on the ground are covered with a water shedding material as they are received and remain
covered until they are placed into trailers or removed from the site for proper disposal, as required by
15A NCAC 13B .1107(2)(c).
Field Inspection:
3. The access roadways throughout the facility are of all-weather construction and were observed to be well
maintained. The perimeter roadway is paved with asphalt and the access roadway leading to the working face
and to the top of the inactive portion of the landfill is hard packed gravel.
4. All of the closed and inactive areas of Phases 1 through 3 were observed to have well established vegetative
cover. The side slopes and top of this part of the landfill were stable and no signs of erosion were evident.
5. Edge of waste markers that had been knocked down during the partial closure construction had been re -installed
along the toe of the western slope of Phases 1 through 3.
6. A number of new landfill gas wells had been installed throughout the facility. Mr. Tate explained that a landfill
gas mitigation project had been required by the Division of Air Quality that included these new wells. He added
that the project had been completed except for the installation of the mini flare that would be placed adjacent to
the landfill office building; that part had been backordered for several months.
7. The perimeter ditch around the toe of the active landfill was found to clear and functional.
8. The leachate storage lagoon was observed to be well maintained. The visible portion of the liner appeared to be
intact and adequate freeboard was evident. Mr. Tate stated that the pump out system for leachate removal was
being redesigned, and the scope of the project would include the rethinking the vaults under the lagoon's access
roadway.
9. Operations are currently taking place in Phase 4, Cell 4-B. Phase 4 is designed in a dogleg shape that parallels
and wraps around the southeastern end of the Phase 3 disposal area. Lifts had been created in the northernmost
end of the cell, and the working face was observed to be well contained. The remainder of the cell was empty,
and windblown litter in the area was minimal and well managed.
10. The tipping area was large, providing space for vehicles and equipment to maneuver easily and safely.
11. Operational cover in the area surrounding the working face was sufficient to prevent waste from being exposed
during the workday. Mr. Shelton stated that one staff member had been dedicated to hauling dirt to the
operations area so that it was available to maintain adequate cover throughout the day, and to apply daily soil
cover, along with tarps, to the working face at the close of operations.
12. The working face was observed to be small enough for the two equipment operators on duty to manage and
cover at the end of the workday. Waste appeared to be well compacted, and no unacceptable materials were

found in the working face.
13. A slope drain on the southeastern slope of the inactive Phase 3 was noted to have become unseated and the
ground beneath it was beginning to show signs of erosion. Please reinstall the lower portion of the slope
drain to ensure it functions properly.
