FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 ADDITIONAL COMMENTS: 01 - This Yard Waste Notified Site (YWN) (Small Type 1 Compost Facility) has a Temporary Disaster Debris Site (DS-27-013) and a Land Clearing and Inert Debris Site (N0321) located on same tract of land. 02 - The Yard Waste Site has an Air Curtain Burner (ACB) to dispose of the waste. It’s evident that the ACB has not been used to reduce the vegetative waste on this facility since the last inspection on 12/29/2020. 03 - Only 6000 cubic yards of Yard Waste at any given time (it was per quarter) can be allowed onsite. Rule attached to email with this report. 04 - Need to put boundary markers up as was stated (as setback markers) in the 6/19/2020 and the 12/29/2020 inspection reports to be able to define the 3 sites listed above in #1. Now the boundaries of This Yard Waste Site, Land Clearing & Inert Debris Site & Temporary Disaster Debris Site cannot be defined due to the volume of Vegetative Waste is one long pile that covers ALL of the areas. The DS-27-013 site will not be able to be Activated in the event of a Declared Disaster Event due to the issues mentioned above. 05 - There are no required fire lanes present to be able to fight a fire if the vegetative waste was to catch fire. 06 - This site in in violation of 15A NCAC 13B .1402 GENERAL PROVISIONS FOR SOLID WASTE COMPOST FACILITIES: (e) (6) (A) for being over the allowed volume of vegetative waste of 6000 cubic yards at any given time. 07 - This site in in violation of 15A NCAC 13B .1402 GENERAL PROVISIONS FOR SOLID WASTE COMPOST FACILITIES: (g) (1) (E) for not providing fire lanes for fire-fighting equipment. 08 - Observed Violations must be corrected within 30 days of receipt of this report. 09 - If Observed Violations are not corrected within 30 days, A Notice of Violation will be issued to this Site. 10 - Entrance road has locking cable/chain and signage. 10 - Roads are constructed of all-weather materials (gravel & sand) and is being maintained in good condition. 11 - Digital Photos were taken during this site visit. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
