Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Section staff Mr. Powell visited site to follow up on corrective actions needed during last inspection. Mr. Pope was onsite during inspection. 2. REMINDER: Communicate with local fire department and Division of Air Quality on open burning of the land clearing waste in future. 15A NCAC 13B .1406 (8) Reporting Fires - Fires shall be reported to the Division orally within 24 hours of the incident and in writing within 15 days of the incident. A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). 3. The renewal submitted in 2021, states that the waste onsite will, “One to three times per quarter finished composted material shall be removed from the site and utilized for DEQ approved purposes including but not limited to, the following: a. Maintenance and/or repair of roads on the Pope farm. b. Animal bedding. c. Storm water runoff remediation and erosion control. d. Blending for improvement of soil quality in deficient portions.” Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Last renewal indicated that none of the YW will be going to the public. The renewal property owner information is listed as Mr. Pope, but the county tax GIS records indicates Mr. Popes deceased sister, Mary Pope, is still owner. Be sure this information is accurate and correct. If Mr. Pope has inherited this property, then the tax records may just be delayed in showing the updated information. Renewal is due by June first of each year and should reflect current owner of the property. 4. Site has installed four EOW markers, although one was not visible due to it being run over by site staff recently. An email from Mr. Pope indicated the repairs had been completed by 8/2/2021. Good job. This will help inspector see edge of waste and onsite staff to know the limits of operations for the 2-acre notification. EOW markers were measured on three sides using measure wheel and the area was inside of 2-acres. Be sure and keep all waste inside the 2-acre footprint. During last inspection, there was small amount of house hold trash, municipal solid waste (MSW), near back of cleared area. Mr. Pope had this waste removed. Please be sure and keep site secured by the fence/gate on site. Unapproved wastes in YW windrows were taken to Moore County LF. 6. The waste that was onsite before is now combined into two windrows. A lot of soil is mixed with the waste and will inhibit composting. Remember waste cannot be buried. Also, the terrain is now rutted and will hold storm water. The YWN should be built up and sloped, when weather allows, to keep water from standing, because waste cannot be in water. Be sure and monitor for leachate releases. Communicate with NC DAQ for burning of land clearing debris in future. Keep records of any mulching events for review by inspector during future visits.
