Expires November 29, 2021, PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: NONE OBSERVED VIOLATIONS: NONE ADDITIONAL COMMENTS The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 1. The facility is a land clearing and inert debris (LCID) landfill. 2. The facility has signage posted at the entrance to the haul road. The facility is properly secured with a locked gate. The facility is not open to the public. 3. The PTO expiration date is November 29, 2021. No later than May 29, 2021, the permittee must submit a request to the Section for permit review and must submit updated facility and operational plans meeting the requirements of Rules 15A NCAC 13B.0565 and .0566. 4. The facility is permitted to receive waste generated from any county in the State of North Carolina, but most waste generated from the following counties – Lenoir, Wayne, Craven, Pitt, Green Duplin, Onslow, and Jones Counties. 5. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, concrete, and concrete block. 6. Per Permit Condition, Attachment I, Part IV, Section 6: Construction or operation of this solid waste management facility must be in accordance with the Solid Waste Management Rules(Rule), 15A NCAC 13B, Article 9 of the Chapter 130A of the North Carolina General Statutes (NCGS 130A-290, et seq.), the conditions contained in this permit; and the approved plan. Should the approved plan and the rules conflict, the Rules shall take precedence unless specifically addressed by permit condition. Failure to comply may result in compliance action or permit revocation. 7. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 8. Stockpiled materials are being maintained in reasonably sized piles with adequate fire breaks. 9. Facility stockpiles concrete onsite for future use. Per G.S. 130A-309.5 (c) (1) Seventy-five percent (75%), by weight or volume, of the recovered material stored at a facility at the beginning of a calendar year commencing January 1, shall be removed from the facility through sale, use, or reuse by December 31 of the same year. 10. 11. The SWS will conduct a follow-up inspection in 45 days to ensure facility construction according to approved plans has been completed.
