Permit to Operate will expire April 17, 2025. PURPOSE OF SITE VISIT: Follow-up Compliance Inspection STATUS OF PAST NOTICE OF VIOLATIONS: 3505-LCID-2020 A. 15A NCAC 13B .0566 (2), "Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time." RESOLVED: The previously identified whole logs had been cut, compacted, and covered. The side slopes had also been graded to three horizontal to one vertical. Continue to ensure that the waste is compacted and covered. Ensure that the side slopes are graded to three horizontal to one vertical. B. 15A NCAC 13B .0566 (3), "All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first." RESOLVED: The previously identified LCID waste had been covered. Ensure that all waste is covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. PARTIALLY RESOLVED: The carbonizer was still located at the facility. Mr. Getty stated that it had not been used at the facility since the last inspection. He also stated that the carbonizer would likely be taken back to Apex, where its use is permitted. A majority of the previously identified stockpile of wood products, adjacent to the carbonizer, had been removed from the site. The remainder pieces of wood debris located near the former stockpile, need to be removed. The stockpile of biochar was still located at the facility and appeared to be the same size as in the previous inspection. The stockpile of biochar should be disposed of properly. D. Permit to Operate Part VI (35), "Storage of pre-processed debris must be limited to a maximum of 30 feet high and 50 feet wide. A minimum of 15-foot row aisles must be maintained to separate the piles." and Permit to Operate Part VI (36), "Storage of finished product/mulch must be limited to a maximum of 30 feet high and 50 feet wide. A minimum of 15-foot row aisles must be maintained to separate piles in all storage areas." RESOLVED: During this inspection, the pre-processed debris and finished mulch were properly windrowed. The windrows were identified to be "steaming" during the inspection. Monitor the mulch piles so that spontaneous combustion does not occur. Continue to ensure that the windrows are properly maintained. 3505-MWP E. Permit to Operate Part VI (44)(C), "Waste may be stored on -site, in leak proof containers, with watertight covers, in accordance with the approved documents. Storage of the waste must not cause any nuisance, such as odor or attraction of vectors." UNRESOLVED: The previously identified wood stockpile, adjacent to the carbonizer, had been removed from the facility. The pile of shingles previously identified had grown in size and was still stored directly on the ground. Mr. Getty stated that they were trying to locate a contractor to remove the shingles. The shingle pile CANNOT be stored directly on the soil and MUST be placed within leak proof containers with a watertight cover in accordance with the permit and approved operations plan. NOTICE OF VIOLATIONS: A. Permit to Operate Part VI (44) (b), "Waste must only be deposited on the concrete pad or directly into containers. Waste must not be stored on the concrete pad after operating hours." Permit to Operate Part VI (45), "Any waste stored on site after operating hours must be stored in leak resistant containers, with watertight covers, a maximum of 24 hours. However, a minimal amount of waste may be stored for a maximum of 48 hours when the facility is closed during a weekend and a maximum of 72 hours when closed for a weekend holiday. Storage of the waste must not cause any nuisance, such as odor or attraction of vectors." Upon arrival at the facility, I spoke with the scale house operator. She stated that the facility had just opened, and no trucks had brought waste to the facility. The tipping floor was found to have waste approximately 8 feet high, across the entire tipping floor and onto the soil at the edge of the tipping floor. Mr. Getty stated that they had gotten behind and were unable to get all of the waste off the tipping floor and into containers. Mr. Getty also stated that trailers were on the way to the facility to remove the waste. All waste MUST be removed from the concrete pad and placed in leak resistant containers, with watertight covers, prior to the end of each operating day. B. 15A NCAC 13B .0302 (a)(5), "the owner or operator shall provide equipment to operate and maintain the site using safe and sanitary practices for the preservation of the public health and welfare and the Page 2 of 6 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA o"' t0E'"�m"""°"""' Solid Waste Section environmental by preventing the generation of leachate, the attraction of vectors, the release of odors, and the release of waste or leachate to the environmental." And 15A NCAC 13B .0103 (e), "No person shall dispose or cause the disposal of solid waste in or on waters in a manner that results in solid waste's entering waters or being deposited upon lands of the State." Waste was observed within the standing water that observed around the base of the shingle pile and around the MAT concrete pad. The standing water was also noted in the May 11, 2021, inspection report. The waste MUST be removed from the standing water. The facility should also be graded so that water is shed away from the waste. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. 15A NCAC 13B .0564 (7), "The site shall establish and maintain an access road around the waste boundary for access by emergency or fire -fighting vehicles and equipment." and 15A NCAC 13B .0301 (6)(D), "Buffer Requirements ... surrounded by an unused and cleared area of no less than 25 feet to allow access for fire or emergency response vehicles." The facility is in the process of installing an access roadway around the LCID. Ensure that the access roads are established and maintained around all areas for fire and emergency response vehicles. 2. Permit to Operate Part VI (51). "The facility shall store no more than 500 total tons of materials on -site, in accordance with the approved documents. Failure of the facility to comply with this condition will require the facility to immediately cease and desist all operations until the appropriate amount of stored material is reached." Ensure that no more than 500 total tons of materials are on site in the MAT area at one time. The facility appears to be approaching the 500 total tons of material, including the shingles and mixed wood waste. No treated wood should be processed at this site per the permit. 3. A water truck is located at the property and is used to control dust emissions at the facility. 4. 15A NCAC 13B .0564 (6)(b), "Buffer Requirements: A site shall maintain the following buffer requirements: 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells." and Permit to Operate Part VI (32), "A buffer of at least 100 feet must be maintained between the property line and the treatment and processing operation." Based on the Response to Facility Compliance Inspection Report dated June 18, 2021, an aerial topographic survey was completed the week of June 14, to assess the buffers at the facility. An updated site drawing with buffer zones would be completed. Please provide the Section a copy of the updated site drawing, once completed. The southern edge of the concrete recycling area appears to be encroaching on the southern adjacent property as well. The wastes need to be moved away from the property line so that the 100-foot buffer has been met. Ensure that necessary buffers are met and markers in place. 5. Facility Operations Plan, Appendix C 2.15 Windblown Litter, "The MWP Area will be protected from the wind by using storage containers and tree buffers. If windblown litter does occur, these materials will be collected and returned to the processing area at the conclusion of daily operations." Waste was observed along the northern edge of the concrete pad, where the trailers are loaded. The waste MUST be picked up and properly disposed of at the end of the operating day. 6. A permit modification for the use of the carbonizer should be submitted to Diana Felix at diana.felix(a,ncdenr.gov, for review and approval if the operator would like to use the carbonizer at this facility. 7. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact information as well as materials accepted at the facility. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days of receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed. 10. Digital pictures were taken during the inspection.
