Therefore, Orange County Regional MSW Landfill - HHW Facility is in violation of 15A NCAC 02C .0108(l). To achieve compliance, Orange County Regional MSW Landfill - HHW Facility must secure wells GP-12, GP-13, GP-17, GP-18, GP-19 and GP-22 with a locking well cap that shall ensure against unauthorized access and use. B. 15A North Carolina Administrative Code 02C .0108(m) states: “All non-water supply wells shall be equipped with a steel outer well casing or flush-mount cover, set in concrete, and other measures sufficient to protect the well from damage by normal site activities.” During the inspection, the top sections of wells GP-12, GP-13, GP-17, GP-18, GP-19 and GP-22 were observed without an outer steel casing. Therefore, Orange County Regional MSW Landfill - HHW Facility is in violation of 15A NCAC 02C .0108(m). To achieve compliance, Orange County Regional MSW Landfill - HHW Facility shall secure the entirety of landfill gas wells GP-12, GP-13, GP-17, GP-18, GP-19 and GP-22 with an outer steel casing. C. 15A North Carolina Administrative Code 02C .0108(p) states: “Each non-water supply well shall have permanently affixed an identification plate. The identification plate shall be constructed of a durable, waterproof, rustproof metal or other material approved by the Department as equivalent and shall contain the following information: (1) well contractor name and certification number (2) date well completed (3) total depth of well (4) a warning that the well is not for water supply and that the groundwater may contain hazardous materials (5) depth(s) to the top(s) and bottom(s) of the screen(s) (6) the well identification number or name assigned by the well owner.” During the inspection, wells GP-12, GP-13, GP-17, GP-18, GP-19 and GP-22 were observed without an affixed identification plate. Therefore, Orange County Regional MSW Landfill - HHW Facility is in violation of 15A NCAC 02C .0108(p). FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 5 To achieve compliance, Orange County Regional MSW Landfill - HHW Facility shall ensure wells GP-12, GP-13, GP-17, GP-18, GP-19 and GP-22 have an affixed identification plate. This plate shall include: (1) well contractor name and certification number; (2) date well completed; (3) total depth of well; (4) a warning that the well is not for water supply and that any groundwater may contain hazardous materials; (5) depth(s) to the top(s) and bottom(s) of the screen(s); and (6) the well identification number or name assigned by the well owner. ADDITIONAL COMMENTS On May 27, 2021, Chuck Kirchner met with Kristina Witosky, Bruce Woody and Lee Cloer with Orange County Solid Waste to conduct a comprehensive inspection of the Orange County Regional Closed MSW Landfill and Household Hazardous Waste Facility on Eubanks Road in Chapel Hill, Orange County. Facility Information: 1. This facility consists of two separate closed MSW landfills, a closed C&D landfill, an active C&D landfill and a household hazardous waste (HHW) overflow collection facility owned by Orange County. The 68-01 and 68-04 permits were combined onto one permit issued on December 30, 2019. Both permit numbers remain active. 2. The County operates two active, permitted, and permanent HHW collection centers. One is located on Walnut Grove Church Road in Cedar Grove, NC and holds Permit No. 68-05. The second facility is located at the landfill on Eubanks Road in Chapel Hill, NC and holds Permit No. 68-06. 3. The 68-01-MSWLF-1982 Orange County landfill facility is located on the north side of Eubanks Road. The Phase 1 of the landfill was approved for use in 1973. In 1982 landfill expansion (Phase 2) was initiated under Permit Number 6801-MSWLF-1982. This MSWLF unit encompassing a 56.40-acre waste footprint was operated from 1972 to 1995. Orange County certified the landfill closure on September 13, 1996. Orange County started the rule-required 30-year post-closure care activities on July 1, 1999 (FID 98206). Both of these areas are covered with the 68-01 permit issued on December 30, 2019. 4. In 1993 Orange County operated a landfill unit located on the south side of Eubanks Road under the Solid Waste Permit Number 6801-MSWLF-1993. This landfill unit has a baseliner system. This landfill unit consisted of four (4) phases with approved gross capacity of 1,604,000 cubic yards over the disposal boundary in a total of 25.9 acres; the original permit for constructing Phases 1 through 3 was issued on October 8, 1993. The original permit for operating Phases 1 & 2 was issued on June 8, 1995. The first load of waste was received at the landfill cell was on June 15, 1995. Phase 3 of the lined MSWLF unit was permitted to operate on August 19, 1998 and started receiving wastes in 1999. Phase 4 was constructed with an alternative liner system (DIN19634). The landfill (South Unit) ceased operation on June 29, 2013, and the closure of 25.9-acre landfill waste footprint was substantially completed on September 18, 2014 (DIN 25039). This area is also under the 68-01 permit. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 5 5. The closed C&D landfill is located at the northeast side of the facility. This disposal unit that was operated under Solid Waste Permit 6801-MSWLF-1982. The closed C&D landfill unit encompassing a 14.46-acre waste footprint was operated from 1995 to 2000 (FID 98201). This C&D landfill ceased operation on May 27, 2006. Final cover was certified by Orange County on the letter dated December 14, 2006 (DIN 5935). 6. The open C&D landfill, Permit Number 68-04, is the only open landfill on this site and is located north of Eubanks Road and west of the maintenance building. 7. Permit 68-01 & 68-04 dated 12-30-19 approved a post closure and land use plan to include the approved use of the closed HHW, tire collection and mulching operations. Records Review: 8. The facility maintains semiannual groundwater and surface water monitoring records. Monitoring is conducted by Smith Gardner, Inc. Prism Laboratories, Inc. in Charlotte, NC (NC Certification #402) conducted the analysis. Records were verified for November 24, 2015, May 6, 2016, November 4, 2016, May 18, 2017, November 14, 2017, June 4, 2018, and November 19, 2018. An exceedance is noted for each monitoring event. 9. The facility maintains quarterly methane and hydrogen sulfide monitoring records. Monitoring is conducted by facility personnel and loaded onto an Equiis database. Records were verified for the third and fourth quarter of 2017, all four quarters for 2018, 2019 and 2020 except for the fourth quarter of 2020 and for March 30, 2021. No exceedance is noted for each monitoring event. Ms. Witosky stated that the fourth quarter of 2020 LFG sampling had been conducted but the record was not in the normal place. Due to the consistency of the results this record was not considered necessary during this inspection. 10. Landtec GEM5000, S/N G506450, used on site to collect landfill gas samples last calibrated by Enviro-Equipment, Inc. on March 23, 2021. Closed Landfill Site Information: 11. Landfill cap observed in good condition with vigorous grass cover. 12. Mr. Cloer stated the landfill cap is mowed twice per year. 13. A clear path was maintained to all observed wells during this inspection. 14. No eroded areas on landfill cap were observed this inspection. 15. Edge of Waste (EOW) markers were observed in good condition this inspection. 16. Leachate collection system is connected to the Chapel Hill Wastewater Treatment Plant. Mr. Woody stated the landfill is allowed to dispose of a maximum 21,600 gallons of leachate per month to the WWTP. Facility Other Use Information: 17. 15A NCAC 02C .0108(o) requires well casings to be terminated no less than 12” above land surface unless site-specific conditions directly related to business activities, such as vehicle traffic, would endanger the physical integrity of the well and the well head is completed in such a manner as to preclude surficial contaminants from entering the well. 18. UNC – Chapel Hill owns and operates a landfill gas power plant located on the east side of the closed landfill south of Eubanks Road. UNC – Chapel Hill maintains an Air Permit with the NCDEQ – Division of Air Quality for the power plant according to Ms. Witosky. 19. This facility ceased accepting HHW in late August 2018. 20. The County proposes to designate this facility as storage area for paints and household hazardous wastes for short periods of time. HHW material will be stored in this facility in the event that the County’s two other HHW Collection Facilities are unable to store materials. In the event of use of this HHW facility, it will not be used as a permanent collection facility and the County shall remove any excess/emergency amounts of HHW as soon as reasonably possible not to exceed 30 days. 22. Currently only fluorescent bulbs are stored on site in one of the adjacent storage sheds. 23. A second shed contains recyclable plastic bags. 24. Ensure any liquids stored on site have adequate double containment as needed. 25. The Chapel Hill Fire Department and/or the New Hope Volunteer Fire Department can be contacted to address an emergency at the facility. 26. Only Orange County Solid Waste staff are on site during operation. 27. The site is secured by a locked gate. 28. The facility has proper signage. 29. Access roads are of all-weather construction.
