RESOLVED: Violation of 15A NCAC 13B. 0402 for the failure to ensure that the transfer trailer loading area (a.k.a. "receiving bay") was maintained in a clean and sanitary condition at all times. This violation has been resolved. (Photo # 1) OBSERVED VIOLATIONS None. All photos by taken by Bill Wagner on 9/19/12: 4W 1. Photo taken on 9/13/12 FACILITY COMPLIANCE AUDIT REPORT Division of Waste Management Solid Waste Section Page 3 of 5 In order to correct the violations above and to maintain compliance with the above rules and permits conditions moving forward, within 30 days of the receipt of this report, the facility in conjunction with its contractors and/or subcontractors shall develop and implement (at the minimum) an inspection, maintenance and storage plan for all trucks, trailers, and/or other waste hauling and storage containers at this facility. A copy of this plan be maintained as part of the operating record and made available upon request by Section staff. In addition, the plan must be incorporated into the facility operations plan during the next permit action. You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. AREAS OF CONCERN AND COMMENTS: 1. Hours of operation: M-F: 7AM — 4PM Sat: 7AM — 1PM 2. Garbage Disposal Services, Inc. (GDS) is under contract with Burke County to haul municipal solid waste from the Burke County Transfer station to the Foothills Landfill in Lenoir, NC which includes providing the waste transfer trailers; moving the waste trailers in and out of the receiving bay of the transfer station; and hauling the waste from the transfer station to the Foothills Landfill in Lenoir, NC. GDS has subcontracted K.R. Drenth Trucking, Inc. to meet the conditions of GDS's agreement with Burke County. 3. The transfer station is permitted to receive municipal solid waste that has been generated from within Avery, Burke, Caldwell, Catawba, Cleveland Lincoln, McDowell, Mitchell, Rutherford and Yancey Counties. 4. Wastes must be transported to the Foothills Municipal Solid Waste landfill in Lenoir, Caldwell County. 5. The transfer station is currently taking in an average of approximately 250 tons of municipal waste per day. 6. Residential tipping fee at the transfer station is $59.12 per ton. Commercial / industrial tipping fee is $58.00 per ton. 7. Used oil and used oil filters collection receptacles are located on the asphalt apron in front of the transfer station. 8. Leachate from the tipping floor is collected in a floor drain that runs across the entire front of the Transfer Station. (Photo #3) This drain was clean and well maintained. 9. Leachate from the receiving bay is collected in a floor drain the runs across the width of the east end access. (Photo #4) This drain was partially clogged with debris and needs to be cleaned. 10. Both of these floor drains feed into gallon underground storage tank that is located off the SE quadrant of the transfer station. According to the September 2008 Revised Operations Plan (DIN 5821) prepared by Joyce Engineering, Inc. the leachate holding tank has a capacity of 5,000-gallons. 11. The leachate is pumped out and hauled to the City of Morganton's Wastewater Treatment plant by Honeywell Septic of Morganton. (4068 Bel Aire Dr., Morganton, NC 28655, 828-433-7867) 12. The interior walls of the transfer station and the tipping floor are very clean and well maintained. (Photo #2) 13. Waste screening records were reviewed. Random waste screening is done once or twice a week. 5. Looking at the (W) side of the transfer station: Note the two vertical drain pipes for removing rain water from the roof. (Entrance to the receiving bay is to the right.) 6. Looking at the (N) across the entrance to the receiving bay. Note the pooled stormwater runoff at the edge of the receiving bay. FACILITY COMPLIANCE AUDIT REPORT Division of Waste Management Solid Waste Section Page 5 of 5 14. Wastes were being received during the inspection. 15. Wind-blown litter was very well controlled. 16. There is a 2-inch water hose on site for fire control. The Chesterfield volunteer fire department also provides fire response for the facility. 17. The tipping floor was in good condition — no cracks and no worn concrete. 18. During heavy rains the surface water runoff from the roof of the transfer station; the asphalt apron to the tipping floor; and from the asphalt road to the receiving bay entrance accumulates to the point where it floods the receiving bay with several inches of water. (Figure 1) The east end of the receiving bays is down gradient from the west end. This stormwater flooding can easily overwhelm the leachate holding tank. Burke County should develop and implement a plan to control and divert stormwater runoff from entering the transfer station receiving bay.
