You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $5,000 per day may be assessed for each violation of
the Solid Waste Statute or Regulations. If the violations) noted here continue, you may be subject to enforcement actions including penalties,
injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessaryto
achieve compliance with the North Carolina Solid Waste Management Act and Rules.
STATUS OF PAST NOTED VIOLATIONS:

AREAS OF CONCERN AND COMMENTS:
1. The Brown Creek Correctional Institution Composting Facility (Brown Creek) is permitted as a Small, Type III
Composting Facility that utilizes an in -vessel composting method. It consists of two Greendrum Type 616 rotating-

drum composter units located on a, a compost curing and storage area, and a shelter for storage of bulking materials.
This facility is permitted to accept certain organic wastes generated at the correctional facility, including dining -hall
food waste and associated paper waste, food -processing waste, low-grade paper, 100% cotton clothing, and yard waste
and grass clippings; sawdust is utilized as the chief bulking material. Facility operations are conducted by Brown
Creek staff and inmates. Compost produced at this facility is permitted to be used as a soil amendment at Brown Creek
and Lanesboro Correctional Institutions, and on other state-owned land. The N.C. Division of Waste Management
Compost Facility Annual Report for the period from July 1, 2011 through June 30, 2012 states that no composting was
conducted due to machinery being out of order since May 3, 2011.
2. Met with Mr. Gaddy, who confirmed that the facility has not been actively composting for many months. He
explained that both composter drums were not operational, and that because repair costs for even one unit were found
to be cost -prohibitive and had not been provided for in the most recent Brown Creek Correctional operating budget, no
plans exist for their repair.
3. Discussed permit renewal issues with Mr. Gaddy, and told him that Solid Waste Compost Permit #04-04 needs to
be renewed if operations are to resume at the site, or to be closed out if the facility is to remain inactive. Mr. Gaddy
said that to his knowledge there are no plans to resume operations or renew the permit.
4. Observed that the composter units were empty, with no trash or unprocessed waste at the facility.
5. Observed two piles of cured compost in the curing/storage area; estimated volume to be less than 10 cu. yards.
6. Observed that the operations area is surrounded by a good stand of grassy vegetation.
7. Observed that the facility access road is maintained with gravel cover and graded to manage runoff.
8. Observed no stormwater or other runoff problems at the facility.
9. Observed no vector or dust problems at the facility at the time of inspection.
10. Access to the site is monitored by Brown Creek staff.
11. Observed signage in place at the entrance to the correctional facility stating hours of operation and the facility
contact telephone number.
