The items) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS:
1. Ms. Bradford and I met with Mr. Fitzgerald and Mr. Ricker at site office and discussed the MSW landfill layout,
design, and current operations. Mr. Fitzgerald said that the current landfill disposal area (Phase 1) is approaching its
final design elevation, and that a new disposal cell (Phase 2, Cell 1) is currently under construction.
2. Joined by Mr. Dawkins at the landfill, we toured the facility, including constructed MSW landfill and current
working face disposal area atop landfill, construction of new disposal cell, and also the facility's soil -borrow area,
new sediment basin, tire collection area, and Land Clearing Debris Treatment & Processing (LCDT&P) operation.
3. Observed a tire in the active working face area, which was removed promptly upon request.
4. Observed that "auto fluff', the approved alternative daily cover material (ADC), was staged adjacent to the
working face, ready for use at the end of daily operations.
5. Although litter -control fences were in use at the time of inspection, some windblown waste was observed beyond
the working face area. Mr. Fitzgerald said that it would be collected at Lite end of daily operations.
6. Observed some erosion on landfill slopes, though not severe at the time of inspection. Mr. Fitzgerald said that
staff would address and correct the situation, to be followed by seeding of repaired areas, and overseeding of slope
areas where existing vegetative cover lacks adequate density.
7. Observed that grinding of wood waste was underway in the LCDT&P area.
