STATUS OF PAST NOTED VIOLATIONS None. OBSERVED VIOLATIONS) 1. 15A NCAC 02C .0108(11) requires that each (monitoring) well "shall have securely affixed an identification plate constructed of a durable material and shall contain the following information: (a) drilling contractor, or pump installation contractor, name and applicable certification or registration numbers; (b) date well completed; (c) total depth of well; (d) a warning that the well is not for water supply and that the groundwater FACILITY COMPLIANCE AUDIT REPORT Division of Waste Management Solid Waste Section Page 2 of 2 may contain hazardous materials; and (e) depth(s) to the top(s) and bottom(s) of the screen(s). Please ensure that all groundwater monitoring wells are properly identified with identification plates in accordance with 15A NCAC 02C .0108(11). 2. 15A NCAC 13B .0505(8) requires in part that: (a) The site shall be adequately secured by means of gates, chains, berms, fences, and other security measures approved by the Division, to prevent unauthorized entry. (c) The access road to the site shall be of all-weather construction and maintained in good condition. Please ensure that the entire site is adequately secured by means of gates, chains, berms, fences, and other security measures approved by the Division, to prevent unauthorized entry in accordance with 15A NCAC 13B .0505(8)(a). And, please ensure that all access roads are of all-weather construction and maintained in good condition in accordance with 15A NCAC 13B .0505(8)(b). The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The permit to operate that expired on September 19, 2007 was issued to the Collins and Aikman Products Company. A change in ownership form Collins and Aikman to International Automotive Company (IAC) took place in October 2007. 3. On September 10, 2013 IAC was issued a letter authorizing the closure of the landfill in accordance with 15A NCAC 13B .0505; Approved Soil Erosion and Sediment Control Plan dated March 12, 2013; and the Approved Revised Closure and Post -closure Plan dated August 13, 2013. 4. In accordance with the letter authorizing the closure, upon completion of the closure construction, IAC must submit a final construction certification and report in accordance with Section 2.7.5 of the Revised Closure and Post -closure Plan. A Permit for Closure, incorporating the facility change of ownership, will be issued upon approval of the construction report. 5. The facility is an industrial landfill that accepted only scrap carpet and backing generated by the former Collins & Aikman plant in Old Fort, NC. 6. The landfill was initiated by Collins & Aikman in 1982 and its use was terminated in 2005. 7. Based on review of the Solid Waste Section's records believed that the facility consisted of three phases as represented in Figure 1, and that: a) Phase 1 was operated early 1982 to late 1982 in the central west portion of the site. b) Phase 2 was operated from late 1982 to 1985 in the area south of the drainage feature in the central eastern portion of the site c) Phase 3 was operated from 1985 to 2005 in the area of the drainage feature north of Phase 2. 8. The entire site covers approximately 86-acres with the actual landfill area covering approximately 12-acres. Site Access 9. Access is on the NW corner of site, off of Parker -Padgett Road. This access is controlled by a locked gate. (Photo #1) 10. Proper landfill signage is displayed at the Roseborough Road access gate. 11. The access roads at the landfill are in passable condition, but are in maintenance in several places at the time of the inspection. Please ensure that all access roads are maintained and are passable at all times. (Photos #1 and #2). 1. Looking (E) up the main access road to Phase 3. 2. Some edge -of -waste markers for the south and west sides of Phase 1 are in place. (Photo #3) 2. The cap of the Phase #1 is covered with mature trees and an understory of small trees and brush. (Photo #4) 3. No seeps of leachate from the landfill, or excessive erosion of the cap or were observed. The edges -of - waste for Phase #2 and for Phase #3 are not marked. 4. The caps of both Phase #2 and Phase #3 have trees and woody vegetation that must be removed. (Photos #5 and #6) 5. Multiple areas of the cap on Phases #2 and #3 have areas of exposed scrap carpet waste that must be FACILITY COMPLIANCE AUDIT REPORT Division of Waste Management Solid Waste Section Page 4 of 4 covered. (Photos #7 & #8) 6. As access from the east side of the site is not controlled, the areas of both Phase #2 and #3 have become subjected to the un-authorized use by recreational vehicles (i.e. —dirt bikes and ATVs).
