Permit to Operate renewed January 30, 2019. Permit to Operate expires June 28, 2023. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None. Long.:-80.181527' OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0203(d) states, `By receiving solid waste at a permitted facility, the permittee shall be considered by the Department to have accepted the conditions of the permit and shall comply with the conditions of the permit." Permit No. 2909-LCID-2013, Part VII: Miscellaneous Solid Waste Management, Condition 2 states, "Recyclable or recovered materials may be received and processed as described in the approved plan (FID 1260730). The received unprocessed materials and final products shall be placed at the designated locations as shown on the drawing Sheet No. C2.0 (FID 1260730)." Page 1 of 6 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section Andrew Veach, owner of Veach LCID Landfill, is in violation for placing unprocessed materials outside of the designated locations shown in the approved drawing Sheet No. C2.0. Logs were observed adjacent to a pile of crushed concrete in the inert debris processing area. Pieces of wood waste were found mixed in piles of soil and inert debris near the landfill disposal area, near the inert debris processing area, and in the berm located next to the public roadway. Scrap metal that had been separated from crushed concrete was observed in piles on the ground and not within the designated scrap metals container. To achieve compliance, Andrew Veach must complete the following corrective measures: • Move all wood waste, including logs and pieces of wood that are mixed into soil and inert debris piles, to the Wood Waste Collection Area, located at the north end of the site; • Remove all wood waste from the berm and dispose of it properly within the landfill disposal area; • Collect all scrap metal stored on the ground and mixed into soil and inert debris piles and remove it from the site or place it inside the leak -resistant scrap metal container for recycling. A follow-up inspection will occur within 30 days to verify that these corrective measures have been completed. Failure to accomplish these measures may result in additional tiered enforcement. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 1. The facility is a land clearing and inert debris (LCID) landfill. Facility operations include the treatment and processing of used concrete and clean wood waste, both of which are defined in the permit renewal issued January 30, 2019. The permit renewal also includes a 5.56-acre expansion of the landfill disposal area. 2. All photos included in this report were taken by Susan Heim on May 25, 2021 during the inspection. 3. The facility's erosion control plan and landfill cover log were available at the landfill office for review; however, the permit to operate and approved operations plan were not. Ensure that the following documents are kept at the facility and available for review on request: • Current permit to operate; • Current approved operations plan; • Current approved site plan drawings; • Landfill cover log. 4. The site is secured by means of a gate that is kept locked when the facility is not open to the public. 5. Proper signage was posted in the road right-of-way near the facility entrance. However, the sign was partially obscured from view by the high weeds growing along the roadside. This has been noted as a problem during previous inspections. It is recommended that the facility sign be relocated to an area beside the gate so that it can be properly maintained and remain visible, as required. 6. Facility roadways are of all-weather construction and were observed to be in good condition throughout the facility. Facility operations appeared to be set back from the property lines in excess of the required buffers. 7. During the previous inspection on August 17, 2020, construction of a berm was underway between Old Thomasville Road and the landfill to assist with stormwater management and to prevent unauthorized access to the facility. Some wood waste and metal scrap had been observed mixed into the soil used to construct the berm. Facility staff had been advised at that time to remove all unacceptable material from the berm and dispose of it properly in the landfill or store it in leak -resistant containers prior to recycling. Ensure that all unacceptable material is removed from the berm and the surrounding access roadway and disposed of properly. Permanent edge -of -waste markers were observed around the entire perimeter of the permitted disposal boundary. 9. Mr. Phillips verified that operations were still confined to the originally approved 3.32-acre landfill footprint. Prior to moving into the 5.56-acre expansion area, please provide the engineer's construction certification and as -built drawing, and arrange for a pre -operations inspection of the facility by the Solid Waste Section, as required by the permit to construct Pre -Operational Condition #5 — items a through h. 10. The facility was open for business during this inspection. Customers were observed bringing loads of vegetative waste for disposal. No unacceptable wastes were observed in the tipping area or in the working face of the landfill. 11. Stockpiles of clean soil, to be used as cover, and ground wood waste, to be used to help maintain the access roadways during heavy rain events, were observed on the north side and the west side of the disposal area. 12. Unloading of incoming loads was taking place on top of the existing landfill cell. The access roadway and tipping area were of adequate size to allow vehicles and equipment to maneuver safely on a stable surface. Two equipment operators were observed receiving and placing wood waste in the working face. Mr. Phillips stated that the loader operator was working specifically to prepare the side slopes for the application of the required monthly soil cover. As discussed during the inspection, please provide photos of the landfill after the required monthly cover for May 2021 has been applied. Photos may be texted to Susan Heim at 919-621- 3687 or sent via email to susan.heim(&ncdenr.2ov. 13. The side slope of the landfill appeared to be almost vertical. The loader operator was observed to be compacting waste and pulling it back to reduce the slope below the required maximum grad of 3:1. Please ensure that the excavated, grading and fill slopes of the facility are reshaped and maintained at a grade no steeper than 3:1, as required by 15A NCAC 13B .0566(2) and by LCID Landfill Operation Condition 9 of the current Permit to Operate. 14. The site was dry and dusty at the time of the inspection. Mr. Phillips stated that he has a water tank that allows him to spray water on the roadways if dust becomes a problem. 15. The sediment basin and the ditch line leading to it were filled to capacity with sediment. An inspection of the outfall found that sediment had escaped the basin and pooled in an area approximately 15' south of the basin rim. Mr. Houck stated that the baffles must be replaced, and the basin cleared of sediment. He added that the ditch line that directs surface water from the landfill disposal area must be reconstructed so that a clear path allows water to flow directly to the basin, as the approved erosion control plan requires. Ensure that the sediment basin and all erosion control measures are cleared of sediment and repaired so that they function as required by the approved erosion control plan. 16. Only a small, excavated area is visible in the original 3.32-acre landfill cell. Some erosion rills were noted on the excavated slope. A layer of ground wood waste had been applied to portion of the excavated slope to prevent additional erosion at the edge of the disposal cell. Mr. Houck stated that this is acceptable as a temporary means of controlling erosion on the slope. 17. Wood waste was observed outside of the wood waste operations area identified in the approved site plan in several areas of the site. Several logs were stored adjacent to a pile of crushed concrete in the inert debris processing area, and small pieces of wood were found mixed into soil and inert debris stockpiles. Please ensure that all wood waste, including logs and any wood that is mixed in soil or processed or unprocessed waste stockpiles, is stored within the approved wood waste operations area located at the northwest corner of the site, or incorporated into the landfill for disposal. (See the Observed Violations section of this report for additional information.) 18. Inert debris processing currently takes place near the southeastern end of the original facility operations area. As landfill operations expand, the processing operation will be relocated to the 1.2-acre area identified in the 2019 permit renewal. 19. Large stockpiles of crushed concrete, unprocessed concrete, and used asphalt were situated around the processing equipment. Mr. Phillips stated that the frequent rainstorms had made processing operations almost impossible over the past three months. Please ensure that the amount of inert debris stored onsite — both processed and unprocessed — does not exceed the 1,000-ton maximum specified in the permit to operate. 20. A roll -off container for the collection of scrap metal was observed in an area between the landfill and the inert debris processing area. The container appeared to be full and in need of repair. Ensure that all metal waste at the facility is collected and removed from the facility or stored in the designated roll -off container. (See the Observed Violations section of this report for additional information.) Equipment operators are seen working to prepare the side slope of the landfill for the application of 6" of clean soil cover that is required at least monthly.
