Timberlake, North Carolina 27583 AUDIT PARTICIPANTS: Chris Marriott-NCDENR, Solid Waste Section STATUS OF PERMIT: Notification Recorded: September 30, 2002 PURPOSE OF AUDIT: Comprehensive Audit NOTICE OF VIOLATION(S): None You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Statute or Regulations. For the violation(s) noted here, you may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE AUDIT REPORT Division of Waste Maaagement _ Solid Waste Section Page 2 of 2 STATUS OF PAST NOTED VIOLATIONS: None AREAS OF CONCERN AND COMMENTS: 1) Facility is a notified LCID landfill operated by L. J. Martin & Sons, Inc. 2) Facility is for the private use of L. J. Martin & Sons and is not open to the public. 3) A sign is posted at the entrance identifying the facility and listing the contact information. 4) Upon inspector's arrival the gate was unlocked and open. Please note that in the operational requirements for land clearing/inert debris (LCID) landfills [15A NCAC 13B .0566 (8)] state: "The facility shall be adequately secured by means of gates, chains, berms, fences, etc. to prevent unauthorized access except when an operator is on duty. An attendant shall be on duty at all times while the landfill is open for public use to assure compliance with operational requirements and to prevent acceptance of unauthorized wastes." The facility gate should remain locked if no attendant is on -site, future non-compliance with this rule may result in enforcement action. 5) The facility has proper 100 foot buffers from the property lines as required. 6) No prohibited (non-LCID) waste was observed at the facility. 7) The waste is properly graded to promote water run-off. No standing water was observed on the waste cover. 8) The operational requirements allow no more than an acre of uncovered waste. Uncovered waste at the facility was well under a half an acre. 9) Soil cover over waste was good on the top, north, east, and west slopes. The southern slope had marginal cover. It is recommended that the cover on the southern slope be repaired/improved to ensure complete coverage of all waste material.
