FACILITY COMPLIANCE AUDIT REPORT Division of Waste Management Solid Waste Section Page 2 of 3 NOTICE OF VIOLATION: None You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Statute or Regulations. For the violation(s) noted here, you may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. STATUS OF PAST NOTED VIOLATIONN: None AREAS OF CONCERN AND COMMENTS: On February 9, 2011, John Patrone met with Dale Shumate and Russell Hawkins to conduct a comprehensive audit of the Town of North Wilkesboro Town Garage Yard Waste Facility located on Flint Hill Road in North Wilkesboro, Wilkes County. 1. The Town of North Wilkesboro Town Garage Yard Waste (YWN) Facility is not yet in operation. 2. The facility is planned to be located at the right rear of the property at the Pubic Services Department maintenance garage. 3. The facility will receive material from the Town of North Wilkesboro picked -up from city residents. 4. Mr. Hawkins stated that the YWN may begin operation in fall 2011. 5. Mr. Hawkins was reminded that the facility shall maintain temperature records and records of throughput. 6. Compost piles shall be monitored for 3 days at a temperature > 131 ° F and aerated accordingly. 7. Ensure that compost windrow thermometer annual calibration records are maintained. 8. Windrow dimension should not exceed a height of 12 feet and a width of 20 feet (minimum dimensions of 6 feet in height and 9 feet in width). 9. The YWN operation shall maintain a 50' buffer from property lines, 200' buffer from buildings (not owned or occupied by the permittee), 100' buffer from wells, and 50' buffer from perennial streams/rivers. 10. The facility shall process or store less than 6,000 yd3 of material per three month period. 11. The YWN is planned to be located adjacent to the Town of North Wilkesboro Land Clearing Debris Treatment and Processing (T&PN) Facility (T&PN-97-002). 12. Mr. Hawkins was asked to redesign the area used for equipment storage, the T&PN operation, and planned YWN operation such that surrounding activities do not encroach upon one another and adequate fire lanes are maintained. 13. The facility shall maintain a > 50 foot setback between the YWN and T&PN operations. 14. Material should not be processed or stored within the 30' power line rights of way. Mr. Shumate stated that the power lines are inactive and that the facility may inquire to have them removed. 15. Mr. Hawkins was given a copy of 15A NCAC 13B .1404 and .1406. 16. The facility is secured by a locked metal gate. Town personnel are on the site during business hours. 17. The facility should post signage with contact information pertaining to the YWN operation, when in operation. 18.
