OBSERVED VIOLATIONS: No violations were observed during this Facility Compliance Inspection; please see the ADDITIONAL COMMENTS section below. ADDITIONAL COMMENTS: 1) This Facility is a closed Municipal Solid Waste (MSW) Landfill. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 1602_INSP_20210414 Page 2 of 4 2) The Facility access road is of all-weather construction and is being well maintained at this time. 3) The site is secured by a locked gate at the Facility entrance. 4) The Facility gate was closed and locked and open upon my arrival and no attendant was on-site during this Facility Compliance Inspection. 5) Highly visible edge-of-waste markers have been installed and are being maintained throughout the Facility as required. 6) An all-weather perimeter road is maintained around the landfill for access to the Facility monitoring wells and to perform Facility maintenance and inspections. This road is maintained clear of brush and provides for access around the entire Facility. 7) Soil has been stockpiled adjacent to the landfill access road for use in repair and maintenance of the landfill cap system. 8) Compost and ground mulch have been staged adjacent to the landfill for use is cover and grading repairs. 9) The Facility monitoring wells were observed during this Facility Compliance Inspection. All wells were readily accessible and clear of brush. All wells, except for MW-3R, were closed and secured with functioning locks. MW-3R was unlocked, open, and uncapped. *This well should be capped, closed, and secured from unauthorized access as soon as possible. Moving forward, please ensure that all wells are capped, closed, and secured with functioning locks at all times. 10) Overall, the landfill has a healthy cover crop of native warm season grasses suitable to prevent erosion of the landfill cap system. However, some bare areas were observed on both the western and eastern outside slopes of the landfill. *Within thirty days of receipt of this Facility Compliance Inspection Report, please cover these areas with topsoil, seed, and mulch to establish a groundcover suitable to prevent erosion of your landfill cap system. 11) The cover crop is mowed throughout the year as needed. 12) Overall, the landfill is being maintained clear of trees and other woody vegetation. However, several small FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 1602_INSP_20210414 Page 3 of 4 trees and other woody vegetation were observed in/on the surface water drainage feature on the western sideslope. *Within thirty days of receipt of this Facility Compliance Inspection, please remove all woody vegetation from the landfill. 13) An area of erosion was observed along the downpipe of the surfacewater control feature on the western outside slope of the landfill. *Within thirty days of receipt of this Facility Compliance Inspection Report, please repair this area by filling and grading at a slope not greater than 3:1. All repaired areas should be seeded and mulched to establish a groundcover suitable to prevent erosion of your landfill cap system. 14) No off-site erosion was observed during this Facility Compliance Inspection. 15) Areas of differential settlement were observed on the top lift of the landfill. No areas of standing water were observed during this Facility Compliance Inspection, however, the presence of wetlands dependent vegetation in some of the settled areas indicates that surface waters are being impounded during periods of wet weather. *Please monitor these areas for ponding water and continue working to fill and grade all areas of differential settlement to promote positive drainage of surface waters away from the landfill.
