Dear Mr. Hoffman:

The Solid Waste Section has completed a review of the Soil Assessment Report dated March 14, 2016 (DIN
25755) and submitted on behalf of Republic Services, Inc. by Joyce Engineering for the Yancey Mitchell
Transfer Station, Solid Waste Permit Number 100-03T. The report was submitted in response to a Notice
of Violation dated January 12, 2016, and the approved Soil Assessment Plan dated February 12, 2016 (DINs
25622 and 25623).

Subsurface soil sampling was conducted on February 18, 2016 to evaluate the extent of the potential
environmental impacts from the release at the transfer station. The samples will be analyzed for Appendix
I of 40 CFR 258 (Volatile Organic Compounds and Metals) and pH at a NC certified laboratory. The
analytical results indicated no volatile organic compounds exceeded the Preliminary Soil Remediation
Goals (PSRGs). However, cadmium, cobalt and vanadium were detected above their Preliminary Soil
Remediation Goals (PSRGs) for the Protection of Groundwater and the Residential Health Based in the
facility’s background soil sample.

As a result, based upon the soil assessment conducted at the transfer station, no additional environmental
assessment associated with this leachate release is required at this time. If you have any questions or
