OBSERVED VIOLATIONS: None Long.:-80.099191 ° The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section ADDITIONAL COMMENTS: 1. All photos included in this report were taken by Susan Heim during the inspection on February 3, 2021. 2. The facility is permitted as an LCID landfill, a small Type 1 compost facility, and a treatment and processing facility for wood waste and used concrete. The compost operations area as well as the wood waste and concrete treatment and processing areas are currently under construction. Once construction is complete, a pre - operations inspection will be required prior to beginning these ancillary operations. 3. This inspection was conducted following the opening of the newly permitted expansion of a 2-acre notified LCID landfill. 4. The facility is permitted to accept only land clearing debris, untreated wood, yard trash, and inert debris that is strictly limited to untreated/unpainted concrete, brick, concrete block, uncontaminated soil, rock, and gravel. 5. The facility appeared to be clean and well -maintained, and no windblown litter was observed. 6. Unauthorized entry into the site is prevented by means of fencing, wood lines and berms, and the facility is secured by means of a locking gate at the entrance. Proper signage was observed at the facility entrance and along the access roadway. 7. The entrance roadway is of all-weather construction, made of compacted stone, and was found to be in good condition. An access roadway leading from the main parking area up the south side of the landfill to the tipping areas appeared to be stable and in good condition, capable of accommodating landfill traffic and equipment. 8. Landfill operations are conducted from an office located at the end of the entrance drive. Incoming waste is tracked by volume. Records are maintained in the office and are available for review upon request. 9. The facility maintains a cover log that lists the dates of each application of cover soil, slope repair, and seeding that takes place at the landfill. The cover log was reviewed during this inspection and found to be up to date. 10. An attendant is on duty during operating hours as required. The facility was operating during this inspection, and customers were observed dumping loads of brush and tree waste. Landfill staff met and directed each customer to a specific unloading spot, then screened the waste as it was unloaded. 11. All erosion control measures appeared to be functioning as designed, and no visible signs of erosion were noted. 12. Three phases of landfill development are included in the permit to construct. The first phase encompasses the notified 2-acre fill area. Phases 2 and 3 are lateral expansions north of the original landfill, and Phase 4 is a vertical expansion that will tie in Phases 2 and 3 to the original notified landfill area. Verbal permission was given to begin accepting waste in Phase 2 during the pre -operations inspection on January 13, 2021. Excavation in Phase 3 was observed to be underway at the time of this inspection. 13. Please provide as -built drawings and a construction certification to Permit Engineer Ming-Tai Chao (min2.chao(&ncdenr.2ov) when construction of Phase 3 is completed so that an inspection can be scheduled prior to accepting waste in Phase 3. 14. Edge of waste markers had been installed to identify the perimeter of the entire landfill as well as the boundaries between Phases I and 2, and between Phases 2 and 3. Markers were spaced so that the perimeter of the fill area is easily discernable along each side of the landfill. Mr. Boyles noted that he would be removing the edge of waste markers between Phases 1 and 2 as fill progresses, beginning with the western side. 15. Phase 2 is an L-shaped area that surrounds the western and northern limits of the original Phase 1 notified landfill. Fill had begun in the western portion of the dogleg, and waste was being placed in lifts with a very shallow grade. 16. The working face was small and well managed, and waste appeared to be well compacted. No unacceptable waste was observed in the working face. The tipping area was located on top of the Phase 1 fill area and appeared to be of adequate size to accommodate the truck traffic bringing waste to the facility. 17. Additional work had taken place in Phase 3 since the previous inspection on January 13, 2021. Excavated slopes appeared to be of a grade that would prevent erosion and were observed to be in good condition. Due to the recent heavy rain events in the area, some small rills were visible. 18. The southern and eastern slopes of the original Phase 1 fill area had been covered with clean soil and graded. Vegetative cover was becoming established on the southern slope, and Mr. Boyles stated that seeding would take place on the eastern slope as soon as the contractor became available. 19. Considerable work had been accomplished to reduce the grade on the northern slope of the landfill since the previous inspection on January 13, 2021; and, repairs were underway. The slope had been reduced, and soil cover had been applied and tracked in to stabilize the area. Some of the large rocks in that corner of the landfill had been removed to facilitate the reconstruction of the slope there. 20. Mr. Boyles stated that repair of the northern slope had been slow going due to the continued wet weather that has not only prevented the use of heavy equipment on the slopes but has also made mud of the stockpiles of cover soil. However, slope repairs had progressed since the January pre -operations inspection, and most of the exposed waste observed previously had been covered. 21. The mulch that had been piled at the top of the northeast corner of the Phase 1 disposal area was in the process of being incorporated fully into the landfill. The steep slope previously observed in this corner had been reduced, and soil cover had been applied. 22. A berm had been constructed south of the landfill to create the 0.38-acre area designated on the approved plans to be used for wood waste recycling. Mr. Boyles explained that he planned to apply additional stone and clay to this area, and to shape and compact the surface to create a stable pad with positive drainage on which to conduct wood waste operations. All of the unprocessed wood waste stockpile that had been observed in this area during the previous inspection had been removed. Mr. Boyles stated that the entire stockpile had been ground and either sold as mulch or disposed of in the landfill. He stated that he intended to focus on completing the construction of the wood waste and compost areas prior to stockpiling waste for processing. 23. The two 1/2-acre compost and mulch storage pads had not yet been constructed, and Mr. Boyles stated that the area is too wet to allow work to begin at this time. The 1/4-acre inert debris operations pad, to be located on the east side of the landfill, will be constructed of crushed stone and concrete and will be the last of the treatment and processing pads to be built. Please contact the Solid Waste Section to schedule an inspection of each of these 3 treatment and processing areas after construction is complete and prior to beginning treatment and processing operations.
