PURPOSE OF SITE VISIT: Follow-up to a complaint received on October 15, 2020. NOTICE OF VIOLATIONS A. 15A NCAC 13B .1402 (e)(6)(A), "Small Type 1 Facilities shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards material onsite at any given time, including finished product." During the inspection, the mulching and stockpile area for the facility was identified to be to the south of the Professional Stone & Masonry main office and residential dwellings located on the site. Mr. Harper stated during the inspection, that he received waste from land clearing activities, which he mulches and covers with dirt to degrade. Once some of the mulch breaks down, Mr. Harper will mix it with soil to add more nutrients. Mr. Harper also stated that he dyes mulch at the facility. Mr. Harper sells finished mulch and mixed topsoil to the public. Following the inspection, a comparison between the operations area identified during the inspection and aerial photographs revealed that Mr. Harper is currently operating on 6 to 7 acres of land. In order to be in compliance, Mr. Harper will need to either consolidate the yard waste operation area to be under two acres or apply for a Large Type 1 facility permit. During the inspection, smoke was coming from a pile of burned land clearing debris located near the northeastern corner of the operations area. Immediately stop the burning of waste at the facility. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS On October 15, 2020, a complaint regarding wood grinding operations was received by the Section. The Section inspected the facility on October 15, 2020 and supplied the facility with information on how to submit a Yard Waste Notification (YWN). The YWN was received by the Section on November 11, 2020. Lana, the office manager, provided me a copy of the submitted YWN and green card. 1. During the inspection, the stockpiles located near the southeastern corner of the operation area were close to the adjacent forested area and not accessible by a vehicle. The stockpiles close to the adjacent forested land should be properly windrowed so that there is a 20-foot fire lane around the stockpiles. 2. A black oily sheen was also identified on the surface of the pond located to the south of the operation area. 3. An open dumping area was identified to the east of the pond located in the southeastern portion of the Site. The comingled waste was identified to contain broken concrete, plastic drains and buckets, rebar, metal wire, and a tire. The comingled waste was pushed into the adjacent tree line and into a natural drainage feature or stream. The comingled waste must be removed and properly disposed of at a permitted facility. 4. Corrective measures are necessary to bring this site into compliance with the permit and approved operations plan and should be completed within 30 days' receipt of this inspection report. 5.
