A. RESOLVED: 15A NCAC 13B .0203(d) states, `By receiving solid waste at a permitted facility, the permittee
shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the
permit." Permit to Operate No. 3416T-TRANSFER-, ATTACHMENT 3, PART VI, Transfer Station/Treatment
and Processing Unit Condition #7(a) states, "The tipping floor and transfer trailer loading area must be maintained
in a clean, sanitary condition at all times and must be cleaned at least daily." New cleaning procedures have
been implemented, and temporary patches have been added to the outside wall of the loading bay to
prevent waste from escaping the facility. In addition, the areas surrounding the scales in the loading bay
have been cleared out and the waste build up has been removed. These areas are now being cleaned on a
regular basis, along with the rest of the loading bay.
B. RESOLVED: 15A NCAC 13B .0402(6) states, "Equipment shall be provided in the storage and charging areas
and elsewhere as needed or as may be required in order to maintain the facility in a sanitary condition." New

cleaning procedures have been implemented, and temporary patches have been added to the outside wall of
the loading bay to prevent waste from escaping the facility. In addition, the areas surrounding the scales in
the loading bay have been cleared out and the waste build up has been removed. These areas are now being
cleaned on a regular basis, along with the rest of the loading bay.
OBSERVED VIOLATIONS:
None.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS:
1. The purpose of this inspection was to follow up on corrective measures implemented to address previously
noted violations. (See Status of Past Noted Violations section of this report for additional information)
2. The loading bay floor drain is recessed, and the concrete floor under the scales is sloped to direct the flow
of liquid to the drain. A small gap exists between the metal plates of the scale and the concrete curbing
along both walls of the loading bay that was designed to direct liquid and small debris to the drain that is
centered below the scales. This inspection occurred several hours into the operating day. Although the
spaces surrounding the scales contained waste, it was obvious that these areas had been cleared of waste
recently. Please ensure that the entire loading bay, including the spaces on the floor surrounding the
scales, are cleaned and all waste is removed at the end of every operating day in order for the facility
to comply with the conditions of the Permit to Operate and with 15A NCAC 13B .0405(11). (Note that
this requirement is stated in detail in the newly revised rules for the operation of a transfer station,
effective January 2, 2021.)
3. The modifications to the facility's Operations Plan were submitted as requested, and the revised Operations
Plan was approved by the SWS on January 5, 2021. Please ensure that the newly approved Operations
Plan is maintained at the scale house, along with the current Permit to Operate, as required.
4. Facilities operations were observed while a trailer was being pulled out of the loading bay into the trailer
parking area and an empty trailer was being parked for loading. An accumulation of waste that included
fine, lightweight material was left on the loading bay floor and walls rather than being removed prior to
installing the next empty trailer. Please ensure that the loading bay is cleaned throughout the day as
necessary to prevent waste from leaving the building, rather than only at the end of each operating
day.
5. During this inspection, an open area was observed in the chain link fence on the northwest side of the
loading bay. This opening is large enough to allow waste to leave the facility. Ensure that this section of
fence is repaired immediately and that any waste that passed through the gap in the chain link is
collected from the slope beyond the fence and returned to the transfer station for proper disposal.
6. Mr. Bouchard had provided verbal notification of a fire that involved the loader that occurred on the paved
area outside the transfer station building, as required. In addition, a completed fire notification form was
provided. During the inspection, the burned -out loader was observed sitting directly in front of the
southwest end of tipping floor. It appeared that the loader had originally been surrounded by two rows of
wattling that had apparently been anchored with sacks of Oi1Dry, presumably to ensure that any liquid
emitted would be absorbed and contained. However, the outside row had been damaged and dragged by
truck traffic at the facility. Ensure that the burned, inoperable loader is removed from the site, that the
wattling is collected and disposed of properly, and that the pavement is cleaned of any oil and debris
resulting from the equipment fire.
