Macon County is in violation of 15A NCAC 13B .1626(2)(a) by failing to completely cover all disposed solid waste with six inches of earthen material or the facility's approved alternative daily cover (50/50 mixture of native soil and ground pallets and yard waste) at the end of each operating day. The facility is permitted to use 50150 mixture of native soil and ground pallets and yard waste as alternative daily cover, with soil coverage weekly. During the January 6, 2021 inspection, exposed waste was observed on the interior slopes and the top of the active landfill cell. Cover all areas of exposed waste with a minimum of six inches of earthen material within ten (10) days of the receipt of this inspection report. 2. Cover all waste with six inches of earthen material, or approved alternative daily cover, at the end of each operating day. Exposed Waste on Top of Landfill Cell Page 2 of 5 4-;1HCA�INA Department of Emiron_'.l Qu;l FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Exposed Waste on Interior Slope The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on January 6, 2021. 2. The facility is owned and operated by Macon County and is currently operating in Phase 3, Cell 1. 3. The facility is open to the public Monday through Friday, 7:30 am to 4:30 pm, and Saturday, 8:00 am to 2:00 pm. Records Review 4. Tonnage records were reviewed from the FY2019-2020 Facility Annual Report. The facility received 38,114.48 tons of waste from July 1, 2019 to June 30, 2020. 5. A random selection of waste screenings was reviewed and the forms showed the final disposition of any unacceptable material that was encountered. 8. Methane monitoring was conducted on March 26 & 27, 2020, June 22, 2020, September 23 & 30, 2020, and December 17 & 22, 2020. No landfill gas exceedances were noted at the property boundary or in structures. 9. Refrigerant extraction is performed by facility staff and extraction records were provided for review. Operations Inspection of the MSW Landfill Unit (5703-MSWLF-1992) 10. The working face was small, compact and no unacceptable material was observed. 11. Exposed waste was observed on the interior slopes and the top of the landfill cell. The exposed waste did not appear to be windblown litter, which was well managed throughout the rest of the facility. Adequate cover appeared to have been placed in the area; however, waste was protruding from the soil. Facility staff stated that the area had been "back bladed" to maintain positive drainage and, due to the recent rain and wet conditions, they had not been able to apply additional soil. Apply additional soil to all areas with exposed waste as required by 15A NCAC 13B .1626(2). See Observed Violations Section of this report. 12. The leachate lagoon is located adjacent to the Town of Franklin Wastewater Treatment Plant. Required freeboard was observed, and no visual deficiencies were noted in the liner at the time of inspection. Operations Inspection of the Recovery Center 13. The recovery center is located to the northeast of the scale house. 14. All non-commercial loads (excluding construction and demolition debris) are directed to the recovery center. 15. The incoming waste is dumped on the tipping floor, loaded into an open top trailer and is transported to the working face. No unapproved material was observed on the tipping floor at the time of inspection. 16. The floor drains were observed and appeared to be clean and working properly. The drains in the recovery center are connected directly to the Town of Franklin sewer system. 17. The recovery center also accepts scrap metal, cardboard, electronics, fluorescent tubes and thermostats. The facility has stopped recycling shingles due to market conditions. 18. Three tire trailers were staged to the south of the recovery center to receive incoming scrap tires. No tires were stored outside the trailer. Operations Inspection of the White Goods Area 19. The white goods collection area is located to the northwest of Phase 3. 20. Facility staff conduct the refrigerant recovery, mark empty units with an X and then place them into the scrap metal pile. 21. White goods and scrap metal are sent to Parrish Contracting in Franklin, NC for recycling. Operations Inspection of the Yard Waste Treatment and Processing area 22. The facility accepts untreated, unpainted pallets, wood, leaves and land clearing debris at a site northeast of the Recovery Center. 23. The material is ground and mixed with soil for use as an approved alternative daily cover for the landfill. No ground material is distributed to the public. 24. The facility has placed a roll off container in the area to dispose of any unapproved material that may be comingled in incoming loads. Painted lumber and Christmas lights were observed in a recently dumped load. Please continue to remove unapproved material from incoming loads.
