PURPOSE OF SITE VISIT: Partial Facility Follow-up Compliance Inspection. STATUS OF PAST NOTED VIOLATIONS: Corrective actions are in process. OBSERVED VIOLATIONS: Original: 15A NCAC 13B .0542 OPERATION PLAN AND REQUIREMENTS FOR C&DLF FACILITIES: (f) (Cover material requirements) (1) & (2). (g) (Spreading and Compacting requirements) (3) The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS: 01 - Life of Site Permit issued April 08, 2018. 02 - Facility has a locking gate and fencing for security. Entrance signage has required information. 03 - Roads are constructed of all-weather construction. 04 - New Landfill directional signs have been installed and looks good. 05 - Scrap metal was being removed during this inspection. 06 - Scrap tires are being laced into a covered box trailer and facility has an empty trailer on standby. 07 - Edge of waste markers (signs) have been reinstalled in several areas at the C&DLF. When cover work is completed on side slopes, putting up permanent markers should take place. 08 - This facility has 6 Certified Landfill Operators: Justin Harrison, expires 9/27/2022, Johnny Rascoe, expires 12/6/2021, Kimley Brown, expires 9/27/2022 William Brown, expires 8/21/2023, Elizabeth Daniel, expires 8/21/2023 and Ronald Brownfield, expires 10/19/2022. 09 - Non-conforming waste was not an issue at the C&DLF working face. 10 - Facility is using the S/M approved cover at the 50/50 rate. 11 - Continuing: OBSERVED VIOLATIONS: 15A NCAC 13B .0542 OPERATION PLAN AND REQUIREMENTS FOR C&DLF FACILITIES: (f) (1) & (2) Cover material requirements and (g) (3) Spreading and Compacting requirements: (f) (1) Except as provided in Subparagraph (3) of this Paragraph, the owners and operators of all C&DLF units must cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half acre and at least once weekly. Cover must be placed at more frequent intervals if necessary to control disease vectors, fires, odors, blowing litter, and scavenging. A notation of the date and time of the cover placement must be recorded in the operating record as specified in Paragraph (n) of this Rule. (f) (2) Except as provided in Subparagraph (3) of this Paragraph, areas which will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, must be covered and stabilized with vegetative ground cover or other stabilizing material. SOME OF THIS COULD BE PREVENTED BY NOT WALKING MACHINES DOWN THE SIDE SLOPES OF THE ALREADY COVERED AREAS. THUS CAUSING EXPOSED WASTE AND A FEW SMALL LEACHATE BREAKOUTS (CONTRACTOR TO BE BROUGHT IN TO REPAIR LEACHATE BREAKOUT ARES) THAT WAS NOTED DURING THIS FOLLOW UP INSPECTION. (g) (3) Appropriate methods such as fencing and diking must be provided within the area to confine solid waste which is subject to be blown by the wind. At the conclusion of each operating day, all windblown material resulting from the operation must be collected and disposed of by the owner and operator. 10 - Windblown trash looked a lot better during this inspection but during this inspection, JUSTIN HARRISON AND JOHN COLLEGE SPENT 1.5 HOURS ON THE CDLF. NO INCOMING LOADS WERE BROUGHT IN AND NO STAFF MADE ANY ATTEMPT TO BE WORKING ON THE NEW AND OLD WINDBLOWN TRASH THAT WAS STILL PRESENT. THIS MUST BE A DAILY PRIORITY. 12 - FACILITY HAS PURCHASED ANOTHER COMPACTOR THAT SHOULD HELP IF USED PROPERLY. 13 - A follow-up inspection will be conducted of the landfill’s observed violations of cover material and windblown trash, and will be re-accessed to ensure compliance has been met. STAFF MUST DO A BETTER JOB TO AVOID A NOTICE OF VIOLATION BEING ISSUED TO THIS FACILITY IF THESE ITEMS ARE NOT CORRECTED BY THE NEXT FOLLOW UP INSPECTION WITHIN THE NEXT 30 DAYS. 14 - Digital pictures taken during this inspection with several attached to this inspection report.
