STATUS OF PERMIT: Original Permit Approval to Construct and Operate: Issued November 29, 2016. Expires November 29, 2021, PURPOSE OF SITE VISIT: Partial Inspection and Review of Approved Facility Site Plan FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 STATUS OF PAST NOTED VIOLATIONS: 1. Per 15A NCAC 13B .0566 (2) states that “The facility shall only accept those solid wastes which it is permitted to receive.”- UNRESOLVED Unacceptable waste streams were noted during the inspection. Treated lumber, engineered wood, electrical junction box and any other unacceptable waste need to be removed and properly disposed of at a facility permitted to accept the waste type. The waste needs to be disposed of at a permitted facility within 30 days of receipt of this report. Documentation will be required to indicate that the waste has been disposed of properly. Mail copies of receipts to Liz Patterson at Division of Waste Management, 127 Cardinal Drive Ext., Wilmington, NC 28405. Electrical junction box, engineered wood, and treated lumber unacceptable wastes at time of inspection. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 6 Engineered wood, treated lumber on side slopes in as you enter the LCID. 2. Per NCAC 13B .0566 (11) States: “Solid waste shall not be disposed of in water.” Waste was being disposed in standing water at the time of the inspection. Please remove and correct the slope so storm water can be managed without erosion. Be careful not to cause any water quality violations with runoff. -UNRESOLVED FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 6 3. Per Attachment 3, Section 11, of the LCID permit No. 5410-LCID-2016 states, “Excavation, grading and fill material side slopes must not exceed a ratio of three horizontal feet to one vertical feet (3:1) as shown on the drawings of the approved plan (DIN 27057) and according to Rule 15A NCAC 13B .0563(3)(j).” Side slopes on several areas were greater than a 3:1 slope. Unacceptable waste needs to be removed. These areas need additional cover which should be corrected during that process. -UNRESOLVED Steep side slopes when entering facility 4. Per Attachment 3, Section 17, of the LCID permit No. 5410-LCID-2016 states, “the facility must maintain a supply of cover material adequate to cover the working face in case of an emergency or fire, at all times. There was not sufficient cover onsite to cover all the active areas/phases of waste onsite. -UNRESOLVED The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 5 of 6 ADDITIONAL COMMENTS 1. The facility is a land clearing and inert debris (LCID) landfill. 2. The facility has signage posted at the entrance to the haul road. The facility is properly secured with a locked gate. The facility is not open to the public. 3. The PTO expiration date is November 29, 2021. No later than May 29, 2021, the permittee must submit a request to the Section for permit review and must submit updated facility and operational plans meeting the requirements of Rules 15A NCAC 13B.0565 and .0566. 4. The facility is permitted to receive waste generated from any county in the State of North Carolina, but most waste generated from the following counties – Lenoir, Wayne, Craven, Pitt, Green Duplin, Onslow, and Jones Counties. 5. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, concrete, and concrete block. 6. Per Permit Condition, Attachment I, Part IV, Section 6: Construction or operation of this solid waste management facility must be in accordance with the Solid Waste Management Rules(Rule), 15A NCAC 13B, Article 9 of the Chapter 130A of the North Carolina General Statutes (NCGS 130A-290, et seq.), the conditions contained in this permit; and the approved plan. Should the approved plan and the rules conflict, the Rules shall take precedence unless specifically addressed by permit condition. Failure to comply may result in compliance action or permit revocation. On December 14, 2020 Liz Patterson and Drew Hammonds met with Lynn Everett to review the permit and current approved site plan. Facility expected to stop disposing of waste until violations are corrected and facility is constructed according to approved facility plans. 7. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 8. Stockpiled materials are being maintained in reasonably sized piles with adequate fire breaks. 9. When correcting the slope issue and adding cover, be sure not to encroach onto the required buffers. 10. Facility stockpiles concrete onsite for future use. Per G.S. 130A-309.5 (c) (1) Seventy-five percent (75%), by weight or volume, of the recovered material stored at a facility at the beginning of a calendar year commencing January 1, shall be removed from the facility through sale, use, or reuse by December 31 of the same year. 11. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days receipt of this report.
