The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On November 17, 2020, Chuck Kirchner conducted a comprehensive inspection of the City of Burlington Yard Waste Facility Notification – Anthony Road Site off Anthony Road in Burlington, Alamance County.
1. The yard waste facility notification (YWN) is owned by the City of Burlington. It is located adjacent to the Anthony Road Closed Landfill (closed pre-1983, NONCD0000106) and abuts the City of Burlington Temporary Disaster Debris Staging Site (TDDSS, DS01-008). 2. The YWN is located on the right off of Anthony Road (traveling from NC 62), via a gravel road prior to Lear Drive. 3. The site is not open to the public. It is accessed by City of Burlington personnel. 4. The area used for the YWN is less than 2 acres. 5. The YWN is used to compost leaves. 6. The City of Burlington primarily collects leaves from late October through February. 7. During the inspection, there were 5 windrows of leaves/compost on site and COB trucks were off loading into a
6th windrow. 8. The facility maintains estimates of the amount of leaves received. Records for 2017 - 2018 [10,500 yd3], 2018 - 2019 [4,632 yd3], and 2019 – 2020 [25 yd3].
9. Ensure processed and unprocessed material on site is less than 6000 yd³ quarterly. 10. The facility maintains temperature records. Please e-mail temperature records from August to October of 2020 to this office.
11. Windrow dimensions were approximately a height of 12 feet and a width of 25 feet and had very good fire lanes in between them. Recommend keeping area behind windrows cleared for fire equipment access. 12. An adequate 50-foot buffer appears to be maintained between the YWN and TDDSS. 13. Appropriate buffer shall be maintained between the YWN and the closed landfill.
14. The Solid Waste Section must receive your yard waste facility notification renewal form by June 1st of each year. If your facility only processes and stores less than 6,000 cubic yards of the following
materials on a quarterly basis, you can continue to operate by notifying the Section on an annual basis by June 1st of each year. A permit is required prior to processing and storing over 6,000 yards per quarter or expanding the facility greater than 2 acres in size. If you plan to increase composting activities to more than 6,000 cubic yards quarterly or exceed 2 acres in size please contact the Solid Waste Section for assistance in obtaining a permit.
15. Logs stored on site will be cut for firewood or repurposed. 16. Open burning of waste is prohibited on site. 17. Fires shall be reported to the Division orally within 24 hours of the incident and in writing within 15 days of the
incident. 18. The area allotted for the conditionally approved TDDSS did not contain any material. 19. Access roads are of all-weather construction.
