The permit will expire on February 14, 2024. Wind River Environmental is identified as the operator in the permit. PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTED VIOLATIONS None. OBSERVED VIOLATIONS A. 15A NCAC 13B .1406 (3), "Stormwater shall be diverted from the operations area." And February 14, 2019 Permit to Operate, Attachment 3 (18), "An appropriate Division of Energy, Mineral and Land Resources (DEMLR) permit for managing any stormwater and/or wastewater at the facility must be maintained as required. Any leachate generated at the facility and any runoff from the facility must be managed to prevent containment of groundwater and surface water. The facility must be maintained to prevent the accumulation of stormwater and leachate on composting areas, storage areas, and roads." Depressions with algae growth on the soil were observed near the final product stockpiles. The site needs to be properly graded to promote drainage of surface water away from the windrows and stockpiles. B. February 14, 2019 Permit to Operate, Attachment 3 (10), "All sides of storage and compost areas for flammable materials must be clear and drivable, to provide vehicular access in the event of a fire." During the inspection, the final product windrow near the southeastern corner of the Site, was not accessible on all sides. Adequate distance around the windrow must be maintained for fire suppression and proper mixing. C. February 14, 2019 Permit to Operate, Attachment 3 (15), "The operator must monitor the compost for process indicators, including moisture content, aeration/turning, porosity, and particle size, and make adjustments as necessary to minimize odors and to ensure composting best management practices." During this inspection, we spoke with a driver, David, for Wind River. He stated that the attendant for the site had quit approximately 3 weeks ago. David reportedly took the temperatures of the compost for a about a week, then told Wind River that he would not be taking the temperatures anymore. David stated that he only parks his truck at the site. No waste is currently being delivered to the site. David also stated that the loads of grease he hauls are taken to Brooks in Sanford. Wind River needs to have an attendant at the site to properly manage the composting process. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 1. This facility is a Large Type III Solid Waste Compost facility. 2. The facility is permitted to accept dewatered septage and grease, food waste, manure, yard waste, vegetative material, and clean wood material. 3. Signage has been posted at the entrance to the facility listing the permit number, and emergency contact number as well as materials accepted at the facility. The facility is not open to the public. 4. Then site is secured by a locking gate at the facility entrance. 5. The facility access road is of all-weather construction and is well maintained at this time. 6. Access around the facility is stable, and no areas of erosion were noted during this compliance inspection. 7. Per the February 14, 2019 Permit to Operate, Attachment 3 (22), "Trash and unacceptable wastes received at the site must be stored in containers and promptly removed from the site for proper disposal." A few unacceptable waste materials including plastic tubing were identified within the final product windrow. The waste must be removed and disposed of properly. 8. No fugitive dust was observed during the facility compliance inspection. 9. Odors were minimal in the composting area and none were noted at the permitted facility boundaries. 10. No windblown debris was observed during this facility compliance inspection. 11. Corrective measures are required as a result of this inspection and should be completed within 30 days' receipt of this inspection. 12. Photographs were taken during the inspection.
