Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS On November 4, 2020, Chuck Kirchner met with Bruce Woody and Kristina Witosky to conduct a comprehensive inspection of the Orange County C&D Landfill on Eubanks Road in Chapel Hill, Orange County. 1. The construction and demolition debris (C&D) landfill (permit number 68-04) is located adjacent to the Orange County Closed Municipal Solid Waste (MSW) Landfill (South Landfill), the Orange County Closed MSW Landfill (North Landfill), the Orange County Closed C&D Landfill (North Landfill), the Orange County Household Hazardous Waste (HHW) Collection Facility, and the wood grinding area (permit number 68-01). 2. The facility is open Monday through Friday 7:00 am - 4:00 pm and Saturday 8:00 am - 12:00 pm. 3. The facility permit, operations plan, and site plan were discussed. 4. The permit authorizes operation of the C&D landfill, Phase 1. 5. The following are certified personnel: a. Kristina Witosky, Certified Manager of Landfill Operations, No. 828637, exp. 6/13/22 b. The facility is permitted to receive C&D material, inert debris, land clearing debris, and (used) asphalt from Orange County. 7. The facility maintains records of the amount of material received. Throughput records were observed. Tonnage received from January 1, 2020 through October 31, 2020 was 10,464.74 tons C&D. 8. The facility annual report (FAR) for July 2019 through June 2020 was received by the SWS dated July 29, 2020. The facility received 12,398.05 tons. 9. The facility maintains semiannual groundwater monitoring test records prepared by Draper Aden Associates, conducted by Sherrill Environmental, Inc., and analyzed by ENCO (Environmental Conservation Laboratories, Inc.). Groundwater records were observed for February 08, 2019, September 3, 2019, February 17, 2020 and July 6, 2020. An exceedance was noted for each event. 10. The facility maintains quarterly methane monitoring records. Methane monitoring is conducted by facility personnel. Records were observed for June 10, 2019 through September 28, 2020. No exceedance of the methane lower explosive limit (LEL) was noted. 11. The facility maintains quarterly hydrogen sulfide, tetrahydrofuran and 1,4 Dioxane monitoring records that mirror the methane monitoring dates. No exceedance was noted. 12. The facility uses a Gas Data LMSx 1406 methane detection unit, S/N 504615, rented from Environmental Equipment out of Pineville, NC. Calibration record observed for August 2, 2019. Last quality assurance check was performed on this instrument on June 18, 2020. Unit is sent to Landfill quarterly to perform LFG monitoring and then is sent back to Environmental Equipment upon completion. 13. There is a landfill gas (distribution) trunk line with eight passive vent risers adjacent to the west external side slope. 14. Six inches of earthen material, used as cover, is required weekly and when the disposal area exceeds one-half acre. 15. The facility maintains weekly landfill cover of the C&D landfill. Weekly cover log observed from January 4, 2019 through October 30, 2020. 16. The working face appeared small and compact. A waste screening is required weekly or at > 1% by weight of the previous week’s total. Records were observed for June 11, 2018 through October 20, 2020. Ensure destination of banned items found in waste screenings is noted on the waste screening report. Ms. Witosky stated that any banned items such as cardboard or aluminum cans that are found are re-directed to the recycling center. 18. The landfill cap, side slopes, and groundcover appeared maintained. Repair eroded rills and continue to seed and mulch as needed. 19. There was no indication of erosion or runoff. 20. Landfill edge of waste markers were observed. 21. The landfill sediment basin appeared maintained. 22. Some windblown material was observed during this inspection. Ensure all windblown material is returned to the working face as discussed in the field. 23. Recyclable material being brought to storage areas associated with permit 68-01 appeared in good condition. 24. Orange County has a Temporary Disaster Debris Staging Site (TDDSS, DS68-002) located adjacent to the active area of the C&D landfill in the undeveloped area allotted for Phases 2 and 3. This site was deactivated on March 13, 2019. 25. The New Hope Fire Department can be contacted to address an emergency at the facility. 26. The facility has an all-weather access road. 27. The facility is secured by a locked gate. The facility sign is located at the entrance to the scale house on Eubanks Road across from the C&D landfill.
