(CEC) respectfully submits this Permit Modification for the Union County CDLF unit on top of the closed unlined MSWLF, Permit # 9001-CDLF-1998. Included in this application is a summary of the permit modifications, revised operations plan, calculations and permit modification drawings. Specifically, the permit modification is related to the final closure grades and stormwater features. Previously permitted final closure stormwater downchutes and existing Sediment Basin SB-1 have been modified as part of this permit modification application. The proposed revisions associated with this permit modification will increase the capacity for the C&D landfill to 1,832,800 yd3. The resulting additional capacity is 159,000 yd3, a 9.5% increase in capacity from the permitted C&D Landfill Area combined capacity (1,673,800 yd3). The entire existing Permit to Construct Application should be kept on file, including this plan, at the site. The Union County Construction & Demolition (C&D) Landfill is located at 2125 Austin Chaney Road near Wingate. C&D Landfills dispose of solid waste generated from the construction, remodeling, repair or demolition of buildings, structures and roads. The current site has been operated by Union County since 1972. Prior to December 31, 1997 municipal solid waste (garbage) was disposed of on site. Since January 1, 1998 only C&D waste is disposed of on site. There are currently no plans to change operating procedures or schedules. Figure 1 shows the Facility in relation to waterbodies, adjacent properties, and other features. - 2 - Union County Landfill Facility Plan July 2020 Figure 1- Site Plan - 3 - Union County Landfill Facility Plan July 2020 The Facility is permitted to operate as a construction and demolition (C&D) landfill in accordance with North Carolina Department of Environment Quality (NCDEQ), Division of Waste Management Permit Number 90-01. The facility is also permitted as a Large Type 1 Solid waste Compost and Reprocessing Facility Permit Number 90-05T. Union County owns a total of 175.2 acres of which 26.5 are designated for the disposal of C&D waste. In addition to C&D disposal, Union County owns and operates a municipal solid waste transfer station and hosts multiple recycling programs adjacent to the C&D disposal area. 1.2 COMPLIANCE WITH STATE AND COUNTY SOLID WASTE MANAGEMENT PLANS The Facility is being developed in compliance with the North Carolina Department of Environmental Quality (NCDEQ). The State Waste Policy and Management Act required NCDEQ to develop a state solid waste management plan. NCDEQ requires that a solid waste management facility permit to have two parts: Permit to Construct, and Permit to Operate and be in accordance with North Carolina Solid Waste Management Rules 15A NCAC 13B .0201 (c) and (d) and Rule 15A NCAC 13B .0534 (b) (2). Operation and maintenance of the Solid Waste Compost and Reprocessing Facility is in accordance with Solid Waste Compost Rules 15A NCAC 13B, Section .1401. - 4 - Union County Landfill Facility Plan July 2020 2.0 FACILITY PLAN 2.1 FACILITY DRAWINGS Approved Drawings from the Minor Permit Modification can be found in Appendix B. 2.2 FACILITY COMPLIANCE The following is a discussion of the characteristics of the waste received at the facility, an analysis of landfill capacity and soil resources, and special engineering features consistent with Subparagraph (e)(1-2) of 15A NCAC 13B. 2.3 WASTE STREAM Waste that is generated from the construction, remolding, repair, or demolition operation on pavement and buildings or structures will be accepted. The waste acceptance rate projected for this facility is approximately 35,000 tons per year. The average monthly disposal rate over the past five years is approximately 2,000 tons per month, with the waste stream increasing significantly over the past two years to approximately 2,900 tons per month. The estimated disposal rate may vary due to population, industrial, and commercial growth within the region, recycling efforts, or availability of other landfills. Equipment and staffing recommendations in this manual are based on these disposal rates and are subject to change in the event of future modification to waste acceptance rates at the Facility. Waste segregation procedures are presented in the Operations Plan, Appendix A. The Facility will be operated with equipment owned by the landfill owner. CEC estimates 412,556 CY of waste airspace, not including the final cover system, remain in the C&D landfill as of July 2019. For the C&D landfill, using the historical in-place waste density of 1,166 lbs/CY (0.58 tons/CY), the landfill has approximately 240,619 tons of waste capacity remaining. At the disposal rate for the 2018-2019 year of 45,586 tons per year, approximately 5.3 years of life remain in the C&D landfill. The remaining time for the landfill operations is proportional to incoming waste stream and in-place waste density. If the incoming C&D waste stream remains consistent in volume and waste type, the life of the landfill increases with increasing in-place waste density. The proposed final closure grade modifications to the C&D Landfill area will result in additional capacity for the phases. The combined permitted capacity for C&D Landfill is 1,673,800 cubic yards (cy). The proposed revisions associated with this permit modification will increase the capacity for the C&D Landfill to 1,832,800 cy. The resulting additional capacity is 159,000 cy, a 9.5% increase in capacity. The Plan serves as a guide to the landfill operator with respect to routine landfill operations, environmental monitoring, and record-keeping. The Facility is permitted to operate as a construction and demolition (C&D) landfill in accordance with North Carolina Department of Environmental Quality (NCDEQ), Division of Waste Management Permit Number 90-01. The facility is also permitted as a Large Type 1 Solid waste Compost and Reprocessing Facility Permit Number 9015-COMPOST-2020. The Facility is expected to have an approximate operational waste acceptance rate of 35,000 tons per year. Equipment and staffing recommendations in this manual are based on these disposal rates and are subject to change in the event of future modification to waste acceptance rates at the Facility. 1.1 PURPOSE The Operations Plan is intended to serve as a site reference. Every employee should be acquainted with its contents and location at the site. Each section of this plan is self-contained, easily updated, and may be used in the field, for training sessions, or self-instruction. The operations manual addressed the following topics: · Personnel requirements; · Entrance procedures and recordkeeping; · Incoming vehicle inspection; · Traffic control; · Landfilling operations; · Recycling operations; · Equipment requirements; · Operation and maintenance of environmental controls; · Contingency and emergency procedures; and · Safety practices and plan implementation. -2- Union County Landfill Operation Plan July 2020 This Operations Plan has been prepared in accordance with North Carolina Administrative Code (NCAC) Title 15A Section 13B .0542. Furthermore, the plan is based on engineering judgment and reflects generally accepted solid waste landfilling techniques. 1.2 REFERENCE DOCUMENTS This Operations Plan constitutes a portion of the Union County facility Permit to Construct Application prepared by S&ME, Incorporated dated 2008. October 2012 (17388), March 13, 2013 (18744) and July 9, 2012 (19917). 1.3 REGULATIONS Solid Waste Management Rules 15A NCAC 13B .0500 and all conditions of the operating permit granted by the NCDEQ Division of Waste Management, shall take precedence and be complied with by landfill operators if there is an actual or perceived contradiction with the text of this plan, unless written consent for variance(s) is granted by the NCDEQ Division of Waste Management. The Facility supervisory staff should be familiar with the State Solid Waste Management Rules and the Facility permit(s). 1.4 LOCATION The Union County C&D Landfill is located on 2125 Austin Chaney Road in Wingate, North Carolina. The existing landfill property is bordered on the north and west by Richardson Creek and on the east/southeast by Austin Chaney Road. -4- Union County Landfill Operation Plan July 2020 2.0 OPERATIONAL DRAWINGS Appendix B of the Union County C&D Landfill Permit Renewal prepared by CEC consists of the approved permit application drawings provided by S&ME dated 2008 which illustrate the site development prepared on topographical maps representative of existing site conditions. These drawings are consistent with the requirements of Subparagraph (d)(1) of Rule .0537 of 15A NCAC 13B. -5- Union County Landfill Operation Plan July 2020 3.0 WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS The Facility will accept only those solid wastes it is permitted to receive including: 1. Land Clearing Debris: as defined by G.S. 120A-290, specifically, waste that is generated solely from land-clearing activities, such as stumps, trees, etc. 2. Inert Debris Waste: defined as solid waste which consist solely of material that is virtually inert (brick, concrete, rock, and clean soil); 3. Asphalt: in accordance with G.S. 130-294 (m); 4. Construction and Demolition Debris: defined as solid waste resulting solely from construction, remodeling, repair, or demolition operations on pavements, buildings, or other structures; 5. Other Wastes that are defined as similar to wastes typically found in the land clearing- inert debris and C&D waste streams consisting of wastes at this time: roofing shingle waste from manufacturers, waste building materials from mobile home/modular home manufacturers and wooden pallets; 6. Asbestos waste as described in Section 3.1 below; and 7. Yard trash (waste), as defined in G.S. 130A-290, shall not be disposed of in the landfill area. However, yard trash (waste), along with land-clearing debris, may be accepted for processing in a designated area. Union County may stop accepting yard waste altogether or they may compost yard waste on-site. Appropriate permits will be obtained if Union County decides to compost yard waste. The landfill owner or operator must notify the Division within 24 hours of attempted disposal of any waste the C&DLF is not permitted to receive, including waste from outside the area the landfill is permitted to serve. 3.1 ASBESTOS WASTE The Union County Landfill does not currently accept asbestos waste for disposal. -6- Union County Landfill Operation Plan July 2020 3.2 WASTE EXCLUSIONS The Facility will accept all types of wastes generated within approved service area except those prohibited by 15A NCAC 13B .0542 (e). Specifically, the following types of wastes will not be accepted: 1. Containers such as tubes, drums, barrels, tanks, cans, and bottles unless they are empty and perforated to ensure that no liquid, hazardous or municipal solid waste is contained therein; 2. Garbage as defined in G.S. 130A-290(a)(7); 3. Hazardous waste as defined in G.S. 130A-290(a)(8), to also include hazardous waste from conditionally exempt small quantity generators; 4. Industrial solid waste unless a demonstration has been made and approved by the Division that the landfill meets the requirements of Rule .0503(2)(d)(ii)(A); 5. Liquid wastes; 6. Medical waste as defined in G.S. 130A-290(a)(17a); 7. Municipal solid waste as defined in G.S. 130A-290(a)(18a); 8. Polychlorinated biphenyls (PCB) wastes as defined in 40 CFR 761; 9. Radioactive waste as defined in G.S. 104E-5(14); 10. Septage as defined in G.S. 130A-290(a)(32); 11. Sludge as defined in G.S. 130A-290(a)(34); 12. Special wastes as defined in G.S. 130A-290(a)(40); 13. White goods as defined in G.S. 130A-290(a)(44); 14. Yard trash (waste) as defined in G.S. 130A-290(a)(45); Yard trash, except in landfills approved for the disposal of yard trash under rules adopted by the Commission. Yard trash that is source separated from solid waste may be accepted at a solid waste disposal area where the area provides and maintains separate yard trash composting facilities, thermostats; -7- Union County Landfill Operation Plan July 2020 15. Batteries including but not limited to those from exit and emergency lights and smoke detectors; and lead-acid batteries, as provided in G.S. 130A-309.70 16. Transformers, Used oil, Motor vehicle oil filters, antifreeze (ethylene glycol). 17. The owner or operator of a C&DLF must not knowingly dispose any type or form of C&D waste that is generated within the boundaries of a unit local government that by ordinance a. Prohibits generators or collectors of C&D waste from disposing that type or form of C&D waste. b. Requires generators or collectors of C&D waste to recycle that type or form of C&D waste. 18. Aluminum cans. 19. Oyster shells. 20. Discarded computer equipment, as defined in G.S. 130A-309.131. 21. Discarded televisions, as defined in G.S. 130A-309.131. 22. Wooden pallets, except that wooden pallets may be disposed of in a landfill that is permitted to only accept construction and demolition debris. 23. Recyclable rigid plastic containers that are required to be labeled as provided in subsection e of this section (G.S. 130A-309.10) have a neck smaller than the body of the container. And that accept a screw top, snap cap, or other closure, the prohibition on disposal of recyclable rigid plastic containers in landfills does not apply to rigid plastic containers that are intended for use in the sale of distribution of motor oil or pesticides. 24. Whole scrap tires, as provided in G.S. 130A-309.58(b). The prohibition on disposal of whole scrap tires in landfills applies to all whole pneumatic rubber coverings, but does not apply to whole solid rubber coverings. Per Rule .NCAC 13B .1106: a. A scrap tire collection site permit shall be issued for a period of five years. Permit renewal applications shall be submitted to the Division not less than 60 days prior to the expiration date of the permit. b. A permit shall specify the storage limit for a scrap tire collection site. -8- Union County Landfill Operation Plan July 2020 c. Scrap tire collection sites shall meet the following siting and design requirements for a permit to be issued: (a) a site shall not be located within either the 100-year floodplain or 100 feet of any surface water; A site shall not be located within any wetland as defined in the Federal Clean Water Act, section 404(b)(1), which is hereby incorporated by reference, including any subsequent amendments or additions. (b) a site shall maintain a 50-foot buffer between all property lines and scrap tire storage areas; (c) the site shall be designed to prevent standing water on-site and prevent off-site drainage problems; (d) the site shall be designed to prevent liquid runoff from a potential tire fire from entering any surface water d. The following information shall be submitted to the Division in an application for a scrap tire collection site permit: (a) a site shall not be located within either the 100-year floodplain or 100 feet of any surface water; A site shall not be located within any wetland as defined in the Federal Clean Water Act, section 404(b)(1), which is hereby incorporated by reference, including any subsequent amendments or additions. (b) name and location of proposed facility, including street address or state road number, city, county, and zip code; (c) name, address, telephone number, and signature of site operator; (d) name, address, telephone number, and signature of property owner, and a copy of the deed or other legal description of the site that would be sufficient as a description in an instrument of conveyance, showing property owner's name; (e) a map or aerial photograph showing the area within one-fourth mile of the site, and identifying the following: -9- Union County Landfill Operation Plan July 2020 (f) the property owned or leased for use as a scrap tire collection site by the applicant; and (g) the location of all homes, buildings, public or private utilities, roads, wells, water courses, floodplains, and other details regarding the topography; (h) a description of the operation of the facility; (i) quantity of tires, expressed in tons, for the following: (j) the quantity expected to be received per month from each source; (k) the quantity expected to be shipped off-site per month; and (l) the quantity expected to be stored on-site. (m) plans for disposition of all tires collected at the site, including the names, addresses, and permit information, if applicable, of all facilities where the tires will be recycled, processed, or disposed; (n) the projected date of commencing operation; (o) a description of how any waste resulting from the operation of the tire site will be disposed; (p) a description of how the scrap tire collection site will meet the siting and design requirements of Paragraph (c) of this Rule; (q) a letter stating that this use complies with local zoning from the unit of local government having zoning authority over the site. If no zoning is applicable, the unit of local government shall provide documentation to that effect; (r) a letter from the local fire protection authority accepting the responsibility for fire protection services and an annual fire safety survey for the site; (s) a description of how the scrap tire collection site will meet the operational requirements of Rule (t) .1107 of this Section; (u) documentation of the operator's ability to meet the financial responsibility requirements of Rule (v) .1111 of this Section; -10- Union County Landfill Operation Plan July 2020 (w) documentation that all processors or recyclers have access to a disposal site that is permitted to receive scrap tires; and (x) documentation from the Division of Energy, Land, and Mineral Resources within the Department stating that the planned site use and operations comply with the requirements of the Sedimentation Pollution Control Law (15A NCAC 04). Per Rule .NCAC 13B .1107 Scrap tire collection sites shall meet the following operational requirements: (1) Owners and operators of collection sites that process scrap tires shall submit to the Division an annual report by August 1 of each year, for the previous calendar year. The report shall be submitted on a form prescribed by the Division. The following information shall be included in the report: (a) the facility name, address, and permit number; (b) the year covered by the report; (c) the total quantity and type of scrap tires or processed tires received at the facility during the year covered by the report; (d) the total quantity and type of scrap tires or processed tires shipped from the facility during the year covered by the report; (e) the quantity of scrap tires or processed tires shipped to each receiving facility identified by name and address; and (f) the total quantity and type of scrap tires or processed tires located at the facility on January 1 of the year covered by the report. (2) All scrap tire collection, processing, or disposal sites that store scrap tires or processed tires outdoors shall comply with the following technical and operational standards: (a) Whole scrap tires shall be placed in an outdoor scrap tire pile(s) having dimensions no greater than 200 feet in length, 50 feet in width, and 15 feet in height. (b) A 50-foot wide fire lane shall be placed around the perimeter of each -11- Union County Landfill Operation Plan July 2020 scrap tire pile. Access to the fire lane for emergency vehicles shall be unobstructed and passable at all times. (c) The owner or operator of any scrap tire collection site shall control mosquitoes and rodents to protect the public health and welfare. Whole and partial scrap tires capable of holding water shall be covered upon receipt with a water shedding material or disposed of, processed, or removed from the site within ten days of receipt. Sliced scrap tires stacked concave-side down shall not be required to be covered. The Division may approve other methods of rodent and mosquito control, if the owner or operator submits a request for the proposed method in writing to the Division, and demonstrates the effectiveness of this method to be protective of public health and the environment, and to comply with the requirements of this Subchapter. (d) If the scrap tire collection site receives tires from persons other than the operator of the site, a sign shall be posted at the entrance of the site and the sign shall state the operating hours. An attendant shall be present when the site is open for receipt of tires. (e) No operations involving the use of open flames, blow torches, or flammable substances shall be conducted within 50 feet of a scrap tire or processed materials pile. (f) A fire safety survey shall be conducted annually by local fire protection authorities that accepted responsibility for fire protection services in the letter submitted in accordance with Rule.1106(d)(12) of this Section. (g) Communication equipment shall be maintained at the scrap tire collection site to assure that the site operator is able to contact local fire protection authorities in case of a fire. (h) Debris, grass, underbrush, and other potentially flammable vegetation shall not be within 10 feet of scrap tires or processed materials. (i) The operator of the scrap tire collection site shall prepare and keep an emergency preparedness manual at the site. The manual shall be -12- Union County Landfill Operation Plan July 2020 updated at least once a year, or upon changes in operations at the site. The manual shall contain the following elements: (i) a list of names and numbers of persons to be contacted in the event of a fire, flood, or other emergency; (ii) a list of the emergency response equipment at the scrap tire collection site, its location, and how it should be used in the event of a fire or other emergency; (iii) a description of the procedures to be followed in the event of a fire, including procedures to contain and dispose of the oily material generated by the combustion of large numbers of tires; and (iv) a listing of all hazardous materials stored on-site, their location, and information regarding precautions. (j) The operator of the scrap tire collection site shall within 24 hours notify the Division in the event of a fire or other emergency if that emergency has potential off-site effects. Within two weeks of any emergency involving potential off-site impact, the operator of the site shall submit to the Division a written report describing the cause(s) of the emergency, actions taken to deal with the emergency, results of the actions taken, and an analysis of the success or failure of these actions. (k) The operator of the scrap tire collection site shall maintain the following records and make them available for inspection by the Division at the Division's request: (i) a copy of the permit; (ii) records of the quantity of scrap tires and processed tires received at the site, stored at the site and shipped from the site, including destination (name and address of facility); and (iii) all certification forms applicable to any tires received, stored, or shipped from the site. (l) Unless otherwise specified by the Division in the facility permit, the -13- Union County Landfill Operation Plan July 2020 number of scrap tires stored at a scrap tire collection site shall not exceed 60,000 tires on site at any time and shall not exceed the stated number of scrap tires shipped off-site per month plus the stated number of scrap tires disposed of on-site per month, except that the storage limit for collection sites associated with scrap tire processing facilities shall be determined by multiplying the daily through put of the processing equipment used by 30. (m) A scrap tire processing facility shall not accept any scrap tires for processing above the number that may be processed daily if it has reached its storage limit. At least 75 percent of both the scrap tires and processed tires that are delivered to or maintained on the site of the scrap tire processing facility site shall be processed and removed for recycling or disposal at a solid waste management facility permitted by the Division to receive such waste within one year of their receipt. (n) The temperature of any above ground piles of compacted, processed tires over 1,000 cubic yards in size shall be monitored and shall not exceed 300 degrees Fahrenheit. Temperature control measures shall be instituted so that pile temperatures do not exceed 300 degrees Fahrenheit. Temperature monitoring and controls shall not be required for processed tires disposed of in sanitary landfills permitted by the Division to receive such waste. (o) The operator of the scrap tire collection site shall prepare and keep a contingency plan stating disposal methods or other means to handle tires during adverse weather, equipment failure, or other conditions that cause the site to be unavailable. 25. Per Rule .NCAC 13B .1109: (a) a. Any scrap tire collection or disposal site that does not meet the requirements of this Section shall be closed. (b) In closing any non-conforming scrap tire site, the owner or operator shall: -14- Union County Landfill Operation Plan July 2020 (1) prevent public access to the site; (2) post a notice indicating the site is closed and the nearest permitted site where scrap tires may be deposited; (3) notify the Division of the closing prior to tire removal; (4) remove all scrap tires, processed tires and residuals to a scrap tire collection site that is permitted in accordance with this Section, or that is exempt from permitting pursuant to G.S. 130A 309.57(d); or to a solid waste management facility permitted by the Division to accept scrap tires or processed tires, and provide receipts to the Division by a deadline that shall be specified by the Division; and (5) remove any solid waste to a solid waste management facility permitted by the Division to receive such waste. (c) Once all requirements set forth in Paragraph (b) of this Rule are complete, the owner or operator shall notify the Division in writing. The following wastes are not accepted if separate from C&D landfill waste. The subject wastes include: 1. Lamps or bulbs including but not limited to halogen, incandescent, neon or fluorescent; lighting ballast or fixtures; 2. Light switches; 3. Lead pipes; 4. Lead roof flashing; 5. Capacitors; and 6. Copper chrome arsenate (CCA) and creosote treated woods. Waste accepted for disposal in a landfill unit shall be readily identifiable as C&D waste. C&D waste that has been shredded, pulverized or otherwise processed shall not be accepted for disposal from a facility unless that facility has received a permit from an authorized regulatory authority which specifies such activities are inspected by the authority, and whose primary purpose is recycling and reuse of the C&D material. Union County shall not knowingly dispose any type or form of C&D waste that is generated within the boundaries of a unit of local -15- Union County Landfill Operation Plan July 2020 government that by ordinance prohibits generators or collectors of C&D waste from disposing that type or form of C&D waste or requires generators or collectors of C&D waste to recycle that type or form of C&D waste. 3.3 RECYCLING The County currently receives segregated pallets and yard waste. These materials are periodically ground or shredded prior to off-site recycling as boiler fuel or composted on-site. Recovered material is not subject to regulation as solid waste under this Article. In order for a material that would otherwise be regulated as solid waste to qualify as a recovered material, the Department may require any person who owns or has control over the material to demonstrate that the material meets the requirements of this subsection. In order to protect public health and the environment, the Commission may adopt rules to implement this subsection. Materials that are accumulated speculatively, as that term is defined under 40 Code of Federal Regulations § 261 (July 1, 2014 Edition), shall not qualify as a recovered material, and shall be subject to regulation as solid waste. In order to qualify as a recovered material, the material shall be managed as a valuable commodity in a manner consistent with the desired use or end use, and all of the following conditions shall be met: 1. Seventy-five percent (75%), by weight or volume, of the recovered material stored at a facility at the beginning of a calendar year commencing January 1, shall be removed from the facility through sale, use, or reuse by December 31 of the same year. 2. The recovered material or the products or by-products of operations that process recovered material shall not be discharged, deposited, injected, dumped, spilled, leaked, or placed into or upon any land or water so that the products or by-products or any constituent thereof may enter other lands or be emitted into the air or discharged into any waters including groundwaters, or otherwise enter the environment or pose a threat to public health and safety. Facilities that process recovered material shall be operated in a manner to ensure compliance with this subdivision. 3. The recovered material shall not be a hazardous waste or have been recovered from a hazardous waste. -16- Union County Landfill Operation Plan July 2020 4. The recovered material shall not contain significant concentrations of foreign constituents that render it unserviceable or inadequate for sale, or its intended use or reuse. (1989, c. 784, s. 2; 1995 (Reg. Sess., 1996), c. 594, s. 9; 2015-1, s. 2(b).) White goods as defined in G.S. 130A-290(a)(44), shall not be disposed of in the landfill. White goods are however accepted for on-site consolidation and off-site recycling and disposal. Freon containing white goods are segregated for Freon removal. The date and quantity of Freon removal will be documented and placed in the Operating Record. Tires, antifreeze, oil, batteries, and pesticide containers are accepted for on-site consolidation and off-site disposal and/or recycling. Tires are stored under cover in tractor trailers prior to shipment. Antifreeze, oil, batteries, and pesticide containers are stored under cover prior to shipment. In addition, the County is currently investigating the options of recycling oil filters, and electronics. 3.4 WASTE SCREENING The landfill operator shall be responsible for screening wastes to ensure that hazardous or unacceptable wastes are not disposed in the landfill. Screening of wastes (load inspections) shall be accomplished as follows: Informal load checking will be the responsibility of all employees, particularly those that work at the entrance area and those that work at or near the active working face. Each employee will observe vehicles entering the Facility and landfill for potentially unauthorized waste and will alert management personnel if unauthorized wastes are suspected. Facility personnel involved with the screening inspections shall be trained for identification of hazardous and liquid wastes through programs offered by the State or by SWANA. Through the waste collection programs, there will be several checkpoints: · Facility Entrance – Only authorized vehicles and material will be allowed beyond the scales. The scale attendant will refuse entry to any unauthorized vehicles or vehicles observed carrying unauthorized waste. In addition, the scale personnel and operators shall be educated to recognize probable violations to the acceptable waste guidelines. -17- Union County Landfill Operation Plan July 2020 · Active face checkpoints – All incoming loads of waste will be observed by the equipment operators as it is discharged and compacted at the active face. The frequency of the random inspections shall be determined by the quantity and type of waste received, the familiarity with the generators and/or transporters, and the occurrences of identified unauthorized waste. Inspections should be performed at the minimum of the following frequency: Once a week. The inspections also need to be random. The time of day and day of week shall vary between inspections. The transporter/hauler selected for inspection shall also vary between inspections. Once the random inspection is completed, operations personnel record the information required on the Random Load Inspection form contained in Attachment 1. If hazardous waste, liquid waste, MSW, industrial waste or waste not characterized as C&D or LCID are not found in the inspected load, then the waste is disposed of on the working face in the cell immediately after completion of the inspection. If hazardous waste, liquid waste, MSW, industrial waste or waste not characterized as C&D or LCID are identified in the load, the material will be removed by the responsible party for disposal at an appropriate facility and the Screening Inspector shall immediately notify the Operations Manager. If hazardous waste is identified, the hazardous materials emergency response team for Union County shall also be notified. Emergency response team contact information is provided in Attachment 2. If liquid waste is discovered, it shall be contained temporarily until an absorbent can be placed or until proper containers are available for pumping. The saturated absorbent or containers will then be disposed of at an appropriate facility. The hazardous waste shall be contained in the same manner as the liquid waste and will be disposed of at a suitable facility for hazardous waste disposal as determined by the emergency response team or a qualified environmental/hazardous waste consultant. Costs for material handling and disposal will be the responsibility of the hauler. Union County will take appropriate actions toward the hauler, including but not limited, to revoking disposal privileges. If the presence of excluded waste is discovered only after spreading and compaction -18- Union County Landfill Operation Plan July 2020 has commenced, the operator will contact the scale house to establish the hauler and generator responsible for the load so that they can be made aware of their mistake and their future loads inspected more carefully. The landfill operator shall notify the Division within 24 hours of any attempt to dispose of any waste products not approved by the Division for disposal at the facility. 3.5 COVER, SPREADING, AND COMPACTING Union County shall restrict solid waste placement to the smallest area feasible for operations. The solid waste shall be compacted as densely as practical using landfill compactors and dozers. Fencing and/or soil berms shall be provided within the landfill area to confine solid waste which is subject to be blown by the wind. At the conclusion of each operating day, windblown material resulting from the operation shall be collected and disposed of by the facility. Solid waste shall be covered with six (6) inches of earthen material, or approved alternate cover material and thickness, when the waste disposal area exceeds one-half acre and at least once weekly. Cover shall be placed at more frequent intervals if necessary to control disease vectors, fires, odors, blowing litter, and scavenging. The date and time of the cover placement shall be documented and maintained in the Operating Record. Areas which will not have additional wastes placed on them for three (3) months or more, but where final termination of disposal operations has not occurred, shall be covered and stabilized with a 12-inch thick intermediate cover and vegetative ground cover or other stabilizing material. The County does not currently utilize alternate cover materials or thicknesses. However, the facility may utilize alternative materials or an alternative thickness of cover for the landfill units following approval by the Division. 3.6 SURVEY CONTROL Operations personnel will periodically monitor landfill top and side slope elevations with a level or through construction staking by a land surveyor. The survey shall be performed by a registered land surveyor duly authorized under North Carolina law to conduct such activities. -19- Union County Landfill Operation Plan July 2020 When top and side slope elevations approach design grades, the final waste grades will be staked to provide filling operations consistent with the approved Drawings. Within 60 days of the Division's written request, the County shall conduct a survey of active or closed portions of unit or units at the facility in order to evaluate whether operations are being conducted in accordance with the approved design and operational plans. The County shall then report the results of such survey, including a map produced by the survey, to the Division within 90 days of receipt of the Division's request. 3.7 AIR CRITERIA AND FIRE CONTROL Open burning of solid waste, except for the approved burning of land clearing debris generated on-site or debris from emergency clean-up operations shall be prohibited at the facility. The open burning at the landfill should also obtain approval form NC Division of Air Quality, the local Fire Marshal, and a burning permit from the north Carolina Forest Services. The copy of the approval documents and the permit should be forwarded to the SWS. A notation of the date of approval and the name of the Division personnel who approved the burning shall be included in the Operating Record. Equipment and stockpiled soil is available to control accidental fires. Union County has made arrangements with Wingate Fire Department to provide firefighting services as needed. Fire Department contact information is provided in Appendix II. Any fires or explosions that occur at the facility shall be verbally reported to the Division within 24 hours and written notification provided within 15 days. Written notification shall include the suspected cause of fire or explosion, the response taken to manage the incident, and the action(s) to be taken to prevent the future occurrence of fire or explosion. The SWS has prepared a standardized fire incidence report which can be downloaded from the link: https://files.nc.gov/ncdeq/Waste%20Management/DWM/SW/Forms/FireOccurrenceReport.pdf. If the County likes to use the form, please append a copy of the form to the Operations Plan. A “hot load” is a load of burning solid waste in an incoming truck. It may be actively burning, but more likely will just be smoldering. When a “hot load” is discovered in a vehicle, the driver should be directed to dump the material in an area located away from the working face and cleared of vegetation and debris. After the “hot load” is dumped, the equipment operator should -20- Union County Landfill Operation Plan July 2020 spread the material, and then cover it with soil to smother the fire. After the fire has been extinguished, the material should remain in the cleared area until no evidence of fire remains. At the end of the day, check to make sure that the waste is an acceptable waste and that no fire or smoldering remains. If these checks are satisfactory, then place the waste into the landfill. 3.8 ACCESS AND SAFETY Landfill operations must be conducted considering the health and safety of the facility’s operating staff. Union County will provide each of the operating staff with site specific safety training prior to landfill operations and designate safety protocol on-site in accordance County practices. The eastern side of the site along Austin Chaney Road is currently enclosed by fencing. Access to the majority of the north and west portions of the site is restricted by Richardson Creek. Access to remaining portions of the site to the north, southwest, and south is restricted by steep terrain and dense vegetation. Site access is controlled by a gate at the main entrance. A security check station and weigh scales are located at the landfill entrance to weigh and monitor the incoming waste for proper disposal. Service access roads are constructed of gravel/dirt, and are maintained to ensure appropriate access and egress of the site. Signs providing information on disposal procedures, the permit number, hours of operations, statements that no hazardous or un-permitted waste can be received without written permission from the State Division of Waste Management, Solid Waste Section (Division) and other pertinent information are posted at the site entrance. Traffic signs and markers are provided, as necessary, to promote an orderly traffic pattern to and from the active disposal area and maintain efficient operating conditions. The County shall maintain permanent physical markers that accurately identify the edge of approved waste footprint for all active, inactive and closed disposal units at the landfill facility. -21- Union County Landfill Operation Plan July 2020 An individual trained by the Solid Waste Association of North America (SWANA) shall be on duty at the site while the facility is open for public use and at all times during active waste management operations to provide compliance with operational requirements. The County will maintain adequate equipment on-site for landfill operations. The County will perform equipment maintenance on-site as needed to keep equipment in good working order. 3.9 EROSION AND SEDIMENTATION CONTROL Erosion/sedimentation control structures, which include diversion berms around the landfill perimeter and on side slopes, down-drain piping, sediment traps, sediment basins, check dams, silt fence, and other measures, will be used to minimize on-site erosion and prevent sediment from leaving the site. Vegetative cover will also be used to reduce erosion and help prevent off- site transportation of sediment. Maintenance of the control structures will be conducted in accordance with Erosion and Sedimentation Control Plan for the site and the North Carolina Erosion and Sedimentation Control Guidelines. The sediment basins shall be inspected at minimum weekly, and after each significant rain event (1/2-inch or greater). Sediment shall be removed and the basin restored to original dimensions after sediment has accumulated to one-half (1/2) of design volume as indicated by cleanout stripe on riser structure. Removed sediment shall be placed in an area that has sediment controls in place. Sediment basin spillways, baffles, embankments and outlet control structure shall be inspected at the same time for erosion damage and piping (embankment only). All necessary repairs shall be made to prevent basin failure. Silt fencing shall be inspected at least once per week and after every rainfall event. Any tears, cracks or overall failure should be repaired and/or replaced immediately. Sediment deposits shall be removed as necessary to ensure proper functioning of fencing. Silt fencing shall remain until final site stabilization has occurred. -22- Union County Landfill Operation Plan July 2020 Permanent ditches should be seeded and matted after their construction; they should be inspected after rain events for any failure of the ditch or erosion control matting. Outlet protection measures used to protect from damage to channel vegetation shall be inspected for wash out. Necessary repairs/replacements should be made immediately, and rip rap should be added where necessary. Embankment and landfill cover slopes shall be periodically inspected for erosion. The slopes shall be mowed no more than twice per year. The embankment slopes shall be re-fertilized in the second year unless vegetation growth is fully adequate. The damaged areas shall be re-seeded (permanent seeding for embankment slopes and temporary seeding for landfill cover slopes), fertilized and mulched immediately. Seeding, fertilizing and mulching shall be in accordance with the Erosion and Sedimentation control plan. The Engineering Report includes all relevant calculations and references for erosion and sedimentation control measures design. Landfill slopes will be periodically monitored for erosion and shall be mowed at least once a year. The landfill slopes shall be fertilized in the second year unless vegetation growth is fully adequate. Damaged areas shall be reseeded, fertilized and mulched. Seeding, fertilizing and mulching shall be in accordance with the North Carolina Erosion and Sedimentation Control Guidelines. 3.10 DRAINAGE CONTROL AND WATER PROTECTION Surface water shall not be impounded over or within the waste. The waste surface shall be graded and soil berms used, as necessary, to divert surface water away from the operational area and away from the waste. Waste shall not be disposed of in water. The waste surface shall be graded and soil berms used, as necessary, to divert surface water away from the operational area and away from the waste. -23- Union County Landfill Operation Plan July 2020 The landfill should be inspected regular and after a major rainfall event for a leachate outbreak at sloped areas including both active C&DLF unit and the closed unlined MSWLF unit which is underneath the C&DLF unit. If a Leachate outbreak is observed, the County should: · Notify the Solid Waste Section (SWS) within 24 hours of any release or discharger outside of landfill unit per Rule 15A NCAC 13B .1604(b)(2)(L)(iii). · Environmental impact investigation plan should be prepared and implemented after it is approved by the SWS. Leachate at the facility is currently contained on-site. If it becomes necessary to collect leachate, methods for leachate handling will be evaluated at that time. Leachate handling methods will be submitted to NCDEQ and other relevant and appropriate agencies for review and approval at that time. The facility will be operated in a manner which prevents the discharge of pollutants into waters of the United States, including wetlands. Such discharge would be in violation of the requirements of the Clean Water Act, including the National Pollutant Discharge Elimination System (NPDES) requirements, pursuant to Section 402. Additionally, the facility will be operated in a manner which prevents the discharge of a non-point source of pollution to waters of the United States, including wetlands. Such discharge would be in violation of the requirements of an area-wide or State-wide water quality management plan that has been approved under Section 208 or 319 of the Clean Water Act, as amended. 3.11 DISEASE AND VECTOR CONTROL & DUST CONTROL The Landfill Facility will prevent or control the on-site population of disease vectors using techniques appropriate for the protection of human health and the environment. Disease vectors -24- Union County Landfill Operation Plan July 2020 are defined as any rodent, flies, mosquitoes, or other animals or insects capable of transmitting disease to humans. Cover material will be applied as an effective vector control measures. It is not anticipated that additional vector control will be required. If vectors are not adequately controlled by the normal monthly cover application frequency, the frequency of cover application will be increased. If increased cover application frequency fails to control vectors, other pest control methods will be implemented. Due to the nature of landfill operations, dust has the potential to be generated during dry periods of the year. The following control measures may be employed at the landfill: • Soil wetting. Periodic watering using a water tank truck will be utilized to control dust originating from paved and unpaved access roads. The main access road to the scale will be paved, while the perimeter roads will be paved or graved-surfaced. Soil wetting may have to be performed several times during an operating day for gravel-surfaced roads; 3.12 OPERATING RECORD AND RECORDKEEPING The owner and operator will record and retain at the facility the following information including dates and times: · Records for random waste inspections, monitoring results, certifications of training, and training procedures; Records of random waste inspections, monitoring results, certifications of training, and training procedures required by the Solid Waste Management Rules, Section .0542; · Amounts by weight of solid waste received at the facility to include, consistent with G.S. 130A-309.09D, county of generation; · Demonstration, certification, finding, monitoring, testing, or analytical data required by the Solid Waste Management Rules, Sections .0544 through .0545; Closure or post- closure monitoring, testing, or analytical data as required by the Solid Waste Management Rules, Section .0543; · Cost estimates and financial assurance documentation required by the Solid Waste Management Rules, Section .0546; -25- Union County Landfill Operation Plan July 2020 · Notation of date and time of placement of cover material; · Audit records, compliance records and inspection reports, and · Fire occurrence report, burning permit/notation, and leachate outbreak. If records are located at another location, it must be approved by the Solid Waste Section. All information contained in the operating record will be furnished to the Division upon request or made available for inspection by the division. The operating record will also include a copy of all approved permits and Monitoring Plans. -26- Union County Landfill Operation Plan July 2020 4.0 FACILITY COMPOSTING Union County owns and operates a Type I composting operation within the Union County Solid Waste Management Facility (Facility) property located at 2125 Austin Chaney Road in Wingate. The Facility operates under solid waste permit number 90-01. The composting operation will function in accordance with the applicable portions of Solid Waste Management Rule; NCAC 15A 13B .1400 – Solid Waste Compost Facilities. A Type I composting operation as defined by the rule may receive yard and garden waste, silvicultural waste, untreated and unpainted wood waste or any combination thereof. The Landfill Manager is responsible for the operations, maintenance, and safety for the composting operation. The County shall employ personnel with compost training credentials to operate the compost unit and provide rule required annual training accord to 15 A NCAC 13B .1406(19): · Facilities permitted as Large Type 1, Large Type 2, all Type 3, and all Type 4 shall have an operator, supervisor, or manager trained in accordance with the requirements in G.S. 130A-309.25. No less than one trained operator, supervisor, or manager meeting the requirements of this Sub-item shall be onsite during the facility's operating hours or available at a phone number provided in the facility permit. · Training in accordance with G.S. 130A-309.25(c) shall be required every five years. · Persons who have achieved and maintain compost operator certification by the US Composting Council Certification Commission or equivalent shall be considered as having met the training requirements in G.S. 130A-309.25 for the permitted facility. · Owners or operators shall provide annual training for facility staff, including a review of the operations plan and permit documents. -27- Union County Landfill Operation Plan July 2020 · Documentation of training required in Sub-items (a) and (b) of this Item shall be maintained at the facility and made available to the Division upon request. · Facilities permitted before the readopted effective date of this Rule shall meet the requirements of Sub-item (a) of this Item within three years of the readopted effective date of this Rule. Facilities permitted after the readopted effective date of this Rule shall meet the requirements of Sub-item (a) of this Item within 18 months of permit issuance. Contact information for the Landfill Manager and other important persons is included in Appendix II of the Facility’s Operations and Waste Acceptance Plan, which this document is part of. 4.1 COMPOSTING OPERATIONS LOCATION The location for the Type I composting operation is within the County’s Solid Waste Management Facility property, south of the active construction and demolition landfill and adjacent to the active white goods collection area. Composting operations shall occupy approximately 1.75 acres. The composting operation is consistent with previous operations in the same area, where yard waste and wood pallets were collected, ground up, stockpiled, and transported off-site for boiler fuel. The composting operation is located adjacent to and on an un- lined MSW landfill that was closed in December 1997 with a soil cover. The location, extents, and general configuration for the composting operation are shown on the included Drawing No. 1 and Drawing No. 2. The extents and specific locations for the composting operation shall be marked in the field with durable markers. 4.2 WASTE ACCEPTANCE AND QUANTITY The waste stream (feedstock) for the composting operations will consist of the following materials and any combination thereof: -28- Union County Landfill Operation Plan July 2020 · Tree stumps; · Tree limbs; · Brush; · Grass clippings; · Leaves; · Wood pallets and untreated and unpainted wood (i.e. wood material that has not been glued, treated with preservatives, painted, stained, or varnished); No grinding of wood wastes shall take place on rainy or windy days, and · Similar vegetative material. No other waste materials will be accepted for composting. All detected prohibited wastes will be handled by the approaches described in Section 3.4 of this Operations plan. The wooden pallet, wooden waste, and high C:N ratio vegetative waste must be separately stockpiled and processed. The intermediate material or fines may be co-mingled for compost. The expected average weight of feedstock materials received for composting annually is 4,200 tons which equates to approximately 22,400 cubic yards of material. The random waste screening described in Section 3.4 of this Operations plan shall be implemented for compost waste screening. Any detected non-conformance wastes must be temporarily stored on-site and disposed of at the on-site transfer station by the end of each operating day. 4.3 COMPOSTING PROCESS Composting operations shall be conducted within the designated area as outlined in Section 4.1. The general process for composting operations to follow, in sequential order, is as follows: 1. The feedstock materials will be accepted at a designated acceptance area within the composting operation area, chosen by the Landfill Manager. The acceptance area size and location may be altered as needed to reflect changes in operations. Stockpiling feedstock shall be limited to 30-feet in height by 50-foot in width by the as needed length. A -29- Union County Landfill Operation Plan July 2020 stockpile size and location shall be manageable and accessible by equipment and vehicular traffic. 2. During periodic intervals throughout a year the feedstock materials are processed in a tub grinder and ground up into mulch. 3. The mulch is then formed into parabolic windrows with cross-section dimensions of 10 to 20-feet wide by 6 to 12-feet high. The windrow size and length determination shall be based on the capability of equipment and operator in turning the windows in a reasonable amount of time. 4. The windrows shall be aerated by turning or dividing them when compost internal temperatures reach 160 degrees Fahrenheit (°F) [71 degrees Celsius (°C)], ±5 °F, or at least monthly by front-end loader(s). To minimize the possibility for spontaneous combustion, maintain compost internal temperatures below 160 °F, ±5 °F. 5. Take windrow compost internal temperature readings at least every month initially and more frequently when internal compost temperatures are higher, above 120 °F. The temperature readings schedule should be adjusted to reflect actual conditions and good judgment. 6. The windrows internal compost temperature shall be elevated to at least 131 degrees Fahrenheit (°F) or 55 degrees Celsius (°C) for at least three (3) days. When this occurs, the compost material is considered a finished product and ready for public use, on-site use, or stockpiled. 7. Windrows internal compost temperature readings will be documented on Field Logs showing individual windrow identification, temperature reading, and date collected. The Field Logs will be maintained on-site in the Facility’s records. 8. The finished product may be stockpiled on-site before use. 4.4 STORMWATER COLLECTION AND CONVEYANCE Stormwater run-off from the composting operations area should be minimal having relatively flat slopes ≤1%. Stormwater that flows toward the composting operations area from up-gradient areas is diverted to the Facility’s existing stormwater collection and conveyance system, away -30- Union County Landfill Operation Plan July 2020 from the composting operations area. The division of stormwater shall be maintained by the Facility. 4.5 ENVIRONMENTAL MONITORING Environmental monitoring for the composting operations is conducted through the use of the Facility’s existing regulatory groundwater and surface water monitoring and reporting. The Facility conducts semi-annual groundwater laboratory testing per 15A NCAC 02L.0202 groundwater quality standards for CFR Part 258 Appendix I and II constituents. In addition, the Facility completes stormwater qualitative monitoring and laboratory testing at the Facility’s stormwater outfalls. The Facility’s stormwater discharges are permitted under NPDES General Permit Number NCG120000, Certificate of Coverage Number NCG120085. 4.6 MAINTENANCE The composting operation area shall be kept in a neat and organized manner. Access roads to the designated waste (feedstock) acceptance area and around the perimeter of the composting operations area shall be kept in a good condition for vehicular travel. The composting operation area shall be maintained at current grades with no depression for ponding of water. Additional soil material will be placed to fill depressions, replace removed soil material by composting operations, construct access roads, or to promote stormwater drainage. No excavation of soil material is allowed within the composting operations area. Portions of the composting operation are located on a closed MSW landfill and the closure soil cover must be maintained. Any soil that is removed as part of composting operations shall be replaced to previous grades at a minimum. Periodic inspections shall be conducted by Facility personnel for the composting operations including the ground surface condition. 4.7 CONTINGENCY FOR COMPOSTING OPERATIONS -31- Union County Landfill Operation Plan July 2020 The contingency in the event the waste stream cannot be composted in accordance with the process outlined in Section 4.3 and applicable portions of Solid Waste Management Rule; NCAC 15A 13B .1400 is the waste will be stockpiled, ground up into mulch by a tub grinder, and transported off-site for boiler fuel. This use of yard waste, land clearing debris, and wood pallets as boiler fuel is consistent with the regulatory approved operations at the Facility. Classification, Testing, and Distribution of solid waste compost per Rule 15A NCAC 13B .1407: 1. Compost or mulch that is produced at a Type 1 facility, is free from offensive odor, contains no sharp particles, and, for compost, has met the temperature requirements in Rule .1406(11) of this Section shall be classified Grade A and have unrestricted application and distribution. Compost analytical testing shall not be required for Type 1 compost if temperature requirements in Rule .1406(11) of this Section have been met and documented. 2. Compost produced from Type 2, 3, and 4 facilities shall be sampled and analyzed as follows: a. a composite sample of the compost produced at each compost facility shall be analyzed at intervals of every 20,000 tons of compost produced or every six months, whichever comes first, for metals and pathogens; b. compost samples shall be analyzed for the metals listed in 40 CFR 503.13(b)(3), except that analysis for mercury shall not be required for Type 2 and 3 facilities, and analysis for arsenic and selenium shall not be required for Type 2 facilities. The concentration of metals in compost offered for sale or distribution to the public shall not exceed the pollutant concentration limits listed in 40 CFR 503.13(b)(3). 40 CFR 503.13 and 40 CFR 503.32 are incorporated by reference including subsequent amendments and editions. Copies of the Code of Federal Regulations may be obtained from the U.S. Government Publishing Office website at www.gpo.gov at no cost; c. compost samples shall be analyzed for pathogens, either for fecal coliform or salmonella bacteria. The concentration of pathogens in compost offered for sale or distribution to the public shall not exceed the concentration limits listed in 40 CFR 503.32(a)(3); -32- Union County Landfill Operation Plan July 2020 d. sample collection, preservation, and analysis shall assure valid and representative results. At least three individual samples of equal volume shall be taken from each batch produced in separate areas along the side of the batch. Each sampling point shall be sampled from a depth of two to six feet into the pile from the outside surface of the pile as follows: i. metals samples shall be composited and accumulated over a six-month period or at intervals of every 20,000 tons of product produced, whichever comes first; and ii. pathogens samples shall be a representative composite sample of the compost and shall be processed within a period of time required by the testing procedure; e. analytical testing methods shall be in accordance with the procedures of one of the following: i. EPA publication SW-846, "Test Methods for Evaluating Solid Waste: Physical/Chemical Methods." This document is incorporated by reference including subsequent amendments and editions, and may be obtained for a fee of three hundred fifty dollars ($350.00) at https://compostingcouncil.org/tmecc/ or a copy may be reviewed free of charge at the Division of Waste Management, Solid Waste Section office at 217 West Jones Street, Raleigh, N.C. 27603; or iii. other methods that are approved by the Division as providing equivalent standards of analysis; and f. the Division may decrease or increase the parameters to be analyzed or the frequency of analysis based upon monitoring data, changes in the waste stream or processing, or information regarding the potential for the presence of -33- Union County Landfill Operation Plan July 2020 contaminants that are not required to be analyzed in this Paragraph. 3. Compost produced from Types 2, 3, and 4 facilities that meet the requirements of Subparagraphs (b)(2) and (b)(3) of this Rule shall be classified Grade A compost and shall have unlimited, unrestricted distribution, except as otherwise determined by the Division based on analyses of parameters pursuant to Subparagraph (b)(6) of this Rule. 4. The facility operator shall be responsible for meeting the requirements of the North Carolina Department of Agriculture and Consumer Services Plant Industry Division Seed and Fertilizer Section concerning the distribution of this product. 4.8 COMPOST UNIT CLOSURE REQUIREMENTS When the permitted compost facility ceases operations, the owner or operator shall meet the following conditions: 1. All feedstock and unfinished compost materials shall be removed from the site and taken to a permitted solid waste facility within 180 days; 2. finished compost materials left onsite shall comply with G.S. 130A-309.05; and 3. the owner or operator shall notify the Division in writing upon completion of the requirements of Subparagraph (1) of this Paragraph. When a permitted compost facility has been closed in accordance with the requirements of Subparagraph (a) of this Rule, the permit shall be terminated. Future compost operations at the site shall require submittal of a new permit application in accordance with Rule .1405 of this Section. 4.9 RECORD KEEPING AND REPORTING REQUIREMENTS When the permitted compost facility ceases operations, the owner or operator shall meet the following conditions: 1. Record Keeping: Facility owners or operators shall maintain records for no less than five years. The following records shall be available for inspection by Division personnel -34- Union County Landfill Operation Plan July 2020 during the facility's normal business hours and shall be sent to the Division upon request: a. daily operational records that include temperature data (length of the composting period) and quantity of material processed; b. analytical results of compost testing; c. the quantity, type, and source of waste received; d. the quantity of waste processed into compost; e. the odor management records required by Rule .1405(10) of this Section; and f. the quantity of compost removed for use or disposal and the market or permitted disposal facility. 2. Annual Reporting: An annual report for the period July 1 to June 30 shall be submitted by all facility owners or operators to the Division by August 1 of each year and shall contain: a. the facility name, address, and permit number; b. the total quantity in tons, with sludge values expressed in dry weight, and the type of waste received at the facility during the year covered by the report, including tons of waste received from local governments of origin; c. the total quantity in tons of compost produced at the facility during the year covered by the report; d. the total quantity in tons of compost removed for use or disposal from the facility during the year covered by the report; e. monthly temperature monitoring to support Rule .1406 of this Section; and f. the results of analytical testing required by Rule .1407 of this Section. 3. Yearly totals of solid waste received and composted shall be reported back to the local government of origin for annual recycling reporting. C&D Landfills dispose of solid waste generated from the construction, remodeling, repair or demolition of buildings, structures and roads. The current site has been operated by Union County since 1972. Prior to December 31, 1997 municipal solid waste (garbage) was disposed of on site. Since January 1, 1998 only C&D waste is disposed of on site. The site will serve as a Landfill Expansion Area for Class Two landfill of the Union County Solid Waste Facility. Site construction will include clearing and grubbing, modification of an existing Sediment Basin (SB-1), C&D minor modification landfill expansion construction grading, perimeter grading, import and placement of soil material. Final stabilization will establish natural vegetation within the site. 1.2 SITE DESCRIPTION The site is approximately 175.2 acres of which 26.5 are designated for the disposal of C&D waste. The facility is permitted as a C&D (construction and demolition waste) and existing MSW (municipal solid waste) landfill. The facility is also permitted as a Large Type 1 Solid waste Compost and Reprocessing Facility Permit Number 90-05T. The immediate surrounding area is wooded. The site, latitude N35°2’12” and longitude W80°27’36.43”, is situated in Union County, North Carolina. 1.3 ADJACENT PROPERTY The land use in the vicinity is mainly developed with majority of the land being wooded. 1.4 SOILS The project site soil is described as primarily (Ud) Udorthents, loamy. The soils are in the Hydrology Group B, see Soil Data section in Attachment A of this report. -2- Union County Minor Modification May 2020 2.0 PLANNED EROSION CONTROL PRACTICES 2.1 TEMPORARY SEDIMENT BASINS Sediment Basin SB-1 will be modified and diversion ditches will be installed prior to the initiation of land disturbance. Runoff from disturbed areas will be directed to existing sediment basins and sediment traps using appropriate conveyance measures. 2.2 TEMPORARY DIVERSION Temporary diversions will be constructed to divert flow and sediment from disturbed areas to Sediment Basin SB-1. Diversion ditches will be adjusted as cut/fill operation progresses. 2.3 LAND GRADING Initial grading activities will not begin until sediment controls are implemented. Sediment controls are as follows but not limited to: (Sediment Basin SB-1, existing sediment basins and traps, sediment diversion ditches, silt fence etc.) Once sediment controls have been implemented land disturbing/grading activates will begin. The site improvements will be constructed on cut and fill areas. Excess material from the borrow area grading will be utilized within the C&D Overlay Expansion area construction. Fill slopes will typically be 3 (horizontal):1 (vertical). Fill will be placed in layers not to exceed 8 inches in depth and compacted. Four to six inches (4”-6”) of the fill surface will be left in loose condition and groomed on the contour before seeding. Filling will be done as a continuous operation until final grade is reached. Berms and temporary diversions at top of fill slopes will be maintained daily. There will be no cut slopes on site. 2.4 SURFACE STABILIZATION -3- Union County Minor Modification May 2020 Surface stabilization will be accomplished with vegetation and mulch as specified in the seeding specifications. 2.5 RIP-RAP CHECK DAM Small rip-rap check dams will be constructed in diversion ditches at various points on the project. The check dams shall be maintained during the construction period. -4- Union County Minor Modification May 2020 3.0 PERMANENT STORMWATER MEASURES 3.1 PROPOSED STORMWATER SYSTEM This project is limited to clearing, grubbing, grading and filling operations on the site. No new impervious area is proposed. An existing sediment basin (SB-1) with conveyance to the sediment basin will be modified to capture runoff during filling operations. Runoff from disturbed areas will be directed to existing sediment basins and sediment traps using appropriate conveyance measures. Upon completion of filling operations, the site will be seeded in accordance with the Stormwater General Permit. Once the site has been stabilized, Sediment Basin other existing basins will remain for permanent stormwater control. For the proposed modified Sediment Basin (SB-1) outfall, Hydrology analysis using TR-55 Tables provided a curve number of 66 for pre- developed area, and a curve number of 86 for post-developed disturbed area. Rainfall depth data was used from NOAA. The analysis demonstrates that pre-development peak discharge will decrease for the 25-year 24-hour storm event (see Table 1 below). TABLE 1. The site outfalls to the existing Richardson Creek. Riprap dissipaters in conjunction with NA Green Matting and riprap lined channels are used to reduce flow velocities. Furthermore, after the stormwater runoff has exited the riprap dissipaters, it will flow through undisturbed existing vegetated areas, further decreasing the velocity before entering surface waters adjacent to the site. New State regulations require that Union County hold a public meeting to discuss future operating plans for the C&D Landfill. The regulations also require that adjacent property owners be notified of the meeting. Your attendance at the public meeting is not required. The Union County Construction & Demolition (C&D) Landfill is located at 2125 Austin Chaney Road near Wingate. C&D Landfills dispose of solid waste generated from the construction, remodeling, repair or demolition of buildings, structures and roads. The current site has been operated by Union County since 1972. Prior to December 31, 1997 municipal solid waste (garbage) was disposed of on site. Since January 1, 1998 only C&D waste is disposed of on site. There are currently no plans to change operating procedures or schedules. In accordance with Title 15A NCAC 13B.0536c (11C) Union County is holding a public meeting to inform the community of proposed waste management activities for the existing C&D Landfill. The meeting will be held June 10, 2008 at Union County’s Agricultural Center, located at 3230 Presson Road, Monroe. The meeting will be held in Room 162 and will begin promptly at 9:00 AM. A map showing Union County’s property in relation to yours is attached. Please note that the gray area outlined in yellow is the topic of discussion. Here are some facts related to the area: • Union County owns a total of 173.8 acres of which 20.4 are designated for the disposal of C&D waste. • Until recently the C&D Landfill has accepted approximately 25,000 tons of waste per year (the volume received has been significantly reduced over the past several months). There is currently available space for an additional 438,700 tons to be disposed of. The yearly tonnage and available space equate to approximately 17.5 years of remaining disposal capacity. • The proposed final elevation is approximately 642 feet. The current base elevation is approximately 542 feet. • In addition to C&D disposal, Union County owns and operates a municipal solid waste transfer station and hosts multiple recycling programs adjacent to the C&D disposal area.
