The Small Type I Facility currently operates under active Yard Waste Notification (YWN) #56-012. PURPOSE OF SITE VISIT: Comprehensive Site Inspection. STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. Per the YWN-56-012 Facility Renewal form (submitted on 5/12/20), the facility notified the Section it would accept land clearing debris; including stumps, tree limbs, and branches. Site access is located off West Main Street in Old Fort, McDowell County, NC. Site access is well controlled. 3. Site access roads were maintained during this inspection. 4. All minimum buffer requirements appeared to be maintained during this inspection. 5. The facility operational area appeared to occupy less than 2-acres during this inspection. 6. During this inspection, the amount of processed and unprocessed material on -site appeared to total less than 6,000 cubic yards (photo #1). 7. During this inspection, no unpermitted waste was observed on -site. Continue to maintain waste screening efforts at the facility. 8. Surface water appeared to be diverted from all operational and storage areas at the site. Continue to maintain diversion measures for surface water control on -site as necessary. 9. Continue to maintain access around the processed and unprocessed material areas at the site for hot load and/or fire control. 10.
