Notary Public My commission expires -lr, 19 PERMIT NUMBER 44-A DATE ISSUED: November 17, 1992 HAYWOOD COUNTY DEMOLITION LANDFILL CONDITIONS OF PERMIT 1. This permit is issued for a period not to exceed five years from date of issuance. This permit is for the construction of the demolition landfill according to the attached application. Any additional conditions and revisions of these approved plans must be approved by the North Carolina Solid Waste Section. 2. Amendments or revisions to the NC Solid Waste Management Rules or any violation of groundwater standards may necessitate modification of the approved plans or closure of the facility. 3. This permit shall not be effective unless the certified copy is filed in the Register of Deeds office and indexed in the grantor index under the name of the owner of the land in the county or counties in which the land is located. The certified copy of the permit, affixed with the Register's seal and the date, book, and page number of recording shall be returned to the Division of Solid Waste Management. 4. When this property is sold, leased, conveyed, or transferred, the deed or other instrument of transfer shall contain in the deed description section in no smaller type than that used in the body of the deed or instrument a statement that the property has been used as a demolition landfill. 5. This facility is permitted to receive yard waste, land -clearing waste, inert debris such as rock, brick, concrete, concrete block, uncontaminated soil, untreated wood, and used asphalt. Waste acceptance requirements may be affected by future revisions to the NC General Statutes, NC Solid Waste Management Rules, or by an approved local solid waste management plan. 6. Waste shall be placed a minimum of four (4) feet above the seasonal high water table. 7. The following requirements shall be met prior to receiving solid waste at the site: a. A site inspection and pre -operative meeting shall be conducted by a representative of the Solid Waste Section. b. A sign shall be posted at the entrance showing the permit number, contact name and phone number in case of an emergency. 8. This facility shall conform to the operational requirements of the NC Solid Waste Management Rules (15A NCAC 13B .0507), and to the following requirements: PAGE TWO PERMIT NUMBER 44-A PERMIT CONDITIONS a. Waste shall be restricted to the smallest area possible, and compacted as densely as practical. The active area shall not exceed one (1) acre in size. b. Adequate soil cover (a minimum 6 inch layer) shall be applied monthly, or when the active area reaches one (1) acre in size, whichever occurs first. 9. Ground water quality at this facility is subject to the classification and remedial action provisions of 15 NCAC 2L. 10. All earth disturbing activities shall be conducted in accordance with the Sedimentation Pollution Control Act of 1973 (15 NCAC 4). 11. All landfilling activities shall occur in accordance with the approved local solid waste management plan. Horton Haywood County Manager Courthouse Annex Waynesville, NC 28786 Dear Mr. Horton: This office has reviewed the erosion and sedimentation control plan submitted for the project listed below. We find the plan to be acceptable and hereby issue this Letter of Approval. Please be advised that Title 15A, North Carolina Administrative Code 413.0017(a), requires that a copy of the approved soil erosion control plan be on file at the job site. Also, you should consider this letter to give the Notice required by NCGS §113A-61(d) of our right of periodic inspection to ensure compliance with die approved plan. The State's Sedimentation Pollution Control Program is a performance -oriented program requiring protection of the natural resources and adjoining properties. If, following commencement of this project, it is determined that the plan is inadequate to meet the requirements of NCGS § 113A-51 to 66, this office may require revisions to the plan and implementation of the revisions to ensure compliance with the Act. Please note that this approval is based in part on the accuracy of the information provided in the Financial Responsibility Form which you have provided. You are requested to file an amended form if there is any change in tlhe information included on the form.
