Dear Mr. Sullivan,
The Solid Waste Section Hydrogeologic Unit has completed a review
of the September 17, 1996, revisions to the Transition Plan for the
Cherokee County Landfill. There are still some revisions needed in
order to meet the requirements of the Solid Waste Management Rules.
Please address the following comments and questions:
LOCATION RESTRICTION DEMONSTRATION
As we discussed in our recent meeting, the text regarding the
floodplain conditions of the facility needs to be amended to more
accurately reflect the actual conditions at the site. The current
text is misleading, since a significant portion of the site is
located within the 100 year floodplain.
WATER QUALITY MONITORING PLAN (WQMP)
Item 3 in my February 22, 1994, letter has still not been addressed
adequately. "The revised Plate 2 does not show most of the
information requested in my Feb. 1994 letter. If other drawings
from the Local Area Study are to be used to show this information,
then these drawings will need to be referenced in the WQMP."

On the bottom of page 5 of the WQMP there is a reference to three
still needed on the three wells to the East of the site. Are there
two or three wells?" The Local Area Study Map shows two wells, one
serving one residence and another serving three residences.
However on the Aerial Photo, the one residence is identified as a
Barn and is not shown to have a well, and another well is shown to
be serving only two residences. The text of the WQMP and the
various drawings need to be consistent and accurately portray the
actual conditions.

Dear Mr. Honeycutt,
Thank you and Mr. Allen for meeting me at the County's landfill facility April 4. You
were very helpful in making my visit very productive. Many questions were answered during the
site visit. This letter serves as a followup correspondence and to highlight some of the Solid
Waste Section's (Section) concerns.
The primary item of concern is the close proximity and the water supply of several
domiciles around the landfill. Active water supply wells adjacent to the landfill create the
possibility of locally influencing predicted groundwater flow direction. As a routine precaution
the Solid Waste Section recommends the County develop a sampling program, for Section
approval, of the wells and spring(s) adjacent to the landfill being used as a potable water supply.
According to the Section's records the Cherokee County facility should presently be
conducting Appendix II monitoring and performing statistical analysis on all of the ground water
quality data to remain in compliance. If these tasks have been performed please provide the
Section with copies.

& 2000' Perimeter" Map is inconsistent with these other
documents, and therefore needs to be revised.

RE: Transition Plan - Ground And Surface Water Monitoring System
For The Existing Cherokee County Landfill (Permit # 20-01)
Dear Sirs,
A review has been completed of the above referenced water
quality monitoring _system plan. Additional information and
clarification is needed on a number of issues. Please review the
following comments and questions and prepare a revised monitoring
system plan for the Cherokee County Landfill.
COMMENTS AND QUESTIONS:
1. There is a brief discussion of regional geology and
hydrogeology, however there is no discussion on how this
relates to design of the monitoring system. For example,
could the contacts between different geologic formations be
more conductive zones that should be targeted for monitoring?
2. There is no discussion or reference made to site geology or
hydrogeology based on prior subsurface investigation at the
site (that is required for permitting). A review of the
original subsurface investigation should be made and this
,information should be used in the evaluation and design of the
monitoring system, including the number, spacing, location,
and screen depths of monitoring wells, as referenced by Rule
.1623(b)(3)(A)(ii). Although this information is somewhat
limited, there is some valuable information on soils,
lithology, depth to ground water, depth to rock, original
topography, drainage features, and the presence of a spring.
Is the spring still present and can it be sampled?
3. Plate 2 does not show local off -site topography and drainage
features, waste boundaries, houses, trailers, wells, springs,
public water lines or other pertinent information needed to
properly evaluate the site conditions. The flow direction of
the Valley River should be indicated. Plate 2 should be
revised to show all of this information. Do the topographic
contours represent original or existing topography?

RE: Status of the Cherokee County MSW Landfill Transition Plan, Permit No. 20-01
Dear Nft. Honeycutt:
Rule .1603(d)(2)(A) of the North Carolina Solid Management Rules directs that the Division will
determine the adequacy of all Transition Plans by October 9, 1996. Furthermore, in accordance
with Rule .1601(c)(4), MSW Landfill Units that have not demonstrated the adequacy of their
plans by this date are constituted as "Open Dumps" and must be closed under both state and
federal law.
As of this time, the Division has not been able to complete it's review of the above referenced
Transition Plan. A response to the Division's review letter of April 26, 1996 needs to be
submitted in order to complete the review process.
Please submit all required information to the Division by September 1, 1996 in order for a timely
review to be completed prior to the October 9, 1996 deadline. If you have any further questions,

satisfies the conditions of that letter the transition plan will be modified to allow the vertical
expansion.

The Solid Waste Section has reviewed Cherokee County's request, dated January
30, 1996, to allow continued operation of the existing Cherokee County Landfill. The
Section agrees to this request. The existing Cherokee County Landfill may continue to
operate through December 31, 1997 and receive waste from Cherokee, Clay, Graham, and
Swain Counties.
Cherokee County is strongly encouraged to submit a Permit to Construct Application for
the proposed lined landfill as soon as possible in order to allow sufficient time for review
and construction.

Sueanna Sumpter sent me the attached documents which were recently
served upon the Attorney for Cherokee County.
The group serving the papers claims to have established a court and
that anyone trespassing on property belonging to members of the group
is subject to arrest by a "posse" and trial in that court.
I discussed this matter with the Cherokee County Sheriff's office. I
was advised to take the matter seriously to the point that we do not
go on property whose owner we do not know. i.
I think we are functioning with a reasonable margin of safety if we
always obtain permission from the owner before we enter upon private
property to conduct State's business. Obviously we have to be
comfortable with the situation.
By copy of this memorandum I am sharing this information with others
in the Asheville Regional Office who might have reason to do State's
business on private property in Cherokee County.
