Polk County is in violation of 15A NCAC 02C .0108(g) for failing to maintain monitoring well MW-2R in a manner to ensure water or contaminants from the land surfaces cannot migrate into the monitoring well. During the July 10, 2020 inspection, groundwater monitoring well MW-2R was observed. Storm water that was directed into a conveyance ditch had undermined the concrete pad of monitoring well MW-2R. The well pad had been undermined approximately six to eight inches, jeopardizing the integrity of the well. Upgradient of the monitoring well, there was excessive erosion due to a hanging culvert in the conveyance ditch, which contributed Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT Qom' Division of Waste Management 0 parlmenl pl Ennronmenlal Quality Solid Waste Section the undermining of the well. To correct the violation, Polk County must submit a plan with the following components: a. Details on how the damage to monitoring well MW-2R will be repaired. b. Verify the well integrity with a camera or other means to ensure the well casing has not been compromised. c. Install measures upslope to prevent damage from occurring during future weather events. d. Provide specific details on how the monitoring well will be accessed for sampling events. Polk County may also choose to submit a plan to abandon monitoring well MW-2R and propose a new location for a replacement well. This plan shall also have specific details on how the monitoring well will be accessed for sampling events. Within sixty (60) days, submit the repair or replacement plan electronically to: Elizabeth Werner Hydrogeologist elizabeth.werner@ncdenr.gov 919-707-8253 Groundwater Monitoring Well MW-2R Page 2 of 4 NORTH CAROLI D_EQ�� UeV.bnenl.i Enrlrwmrenbl Ou.l� FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section B. 15A NCAC 13B .0510(c) states: "When a solid waste disposal site has been closed in accordance with the requirements of the Division, future necessary maintenance and water quality monitoring shall be the responsibility of the owner and the operator and shall be specified in the closure letter." Polk County is in violation of 15A NCAC 13B .0510(c) in that the facility failed to sample groundwater monitoring well MW-2R as specified in the December 29, 1995 Closure Letter, Post Closure Condition 8(a) "The permittee shall sample the detection monitoring wells and surface water sampling locations at a minimum on a semi-annual basis." The Fall 2018, Spring 2019, Fall 2019, and Spring 2020 groundwater monitoring reports submitted to the section stated that groundwater monitoring well MW-2R had not been sampled due to "property access issues". To correct the violation, Polk County shall sample all detection monitoring wells at a minimum on a semi- annual basis. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on July 10, 2020. 2. The inspection of the landfill was conducted due to a complaint regarding erosion of the landfill cap received by the Section. 3. The closure letter was issued December 29, 1995 and the closure permit for the landfill was issued on December 9, 2015 under Permit Number 7504. 4. Edge of waste markers constructed of white PVC pipe were installed and visible. 5. The landfill had good vegetative cover and no evidence of erosion of the cap was observed at the time of the inspection. 6. Corrugated metal pipe had been installed in some locations to the west beyond the landfill footprint to help direct storm water. Walking down the storm water path, a piece of corrugated pipe was observed suspended approximately twenty-five (25) feet in air. It appears that the soil around exposed end of the pipe had given way creating a small landslide. Downed trees were observed in the void created by the landslide. 7. Groundwater monitoring well MW-2R located on the west side of the landfill property was observed. Storm water that was directed into a conveyance ditch had undermined the concrete pad of monitoring well MW-2R. The well pad had been undermined approximately six to eight inches, jeopardizing the integrity of the well. A culvert in the conveyance ditch has failed, causing excessive erosion and contributed to the undermining of the well. See Observed Violations Section of this report. 8. When reviewing the groundwater monitoring reports submitted to the section, it was notated in the Fall 2018, Spring 2019, Fall 2019, and March 2020 reports that well MW-2R had not been sampled due to "property access issues". Approval was NOT given by the section to forgo monitoring MW-211. All wells must be monitored regardless of "property access issues". See Observed Violations Section of this report.
