It is the responsibility of every owner and operator of a proposed solid waste management facility to apply for a permit for the facility. The term 'owner" shall include record owners of the land where the facility is located or proposed to be located and holders of any Page 1 of 3 FACILITY COMPLIANCE INSPECTION REPORT Mecklenburg County Land Use and Environmental Services Agency Solid Waste Division leasehold interest, however denominated, in any part of the land or structures where the facility is located or proposed to be located." RESOLVED: On November 6, 2019, Metrolma Greenhouses submitted the required documents for permit renewal to NCDEQ Solid Waste Section -Permitting Branch. 2. 15A NCAC 13B .0203(d) states "By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit." RESOLVED: The required permit renewal application documents for permit number 60AN-LCID were received by NCDEQ Solid Waste Section -Permitting Branch on November 6, 2019. Application is currently pending review. OBSERVED VIOLATIONS: No new violations observed The items) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 1. The facility is permitted to receive waste generated by Metrolina Greenhouses, Inc. Observed waste in landfill consisted of discarded plant material and attached root balls, soil, and discarded potting media components. 2. Landfill is enclosed by gate, which is locked to prevent unauthorized entry. Signage providing permit number and emergency contact information was observed at entrance. Observed plastic potting media, such as plant tags and pots, on the active face of the landfill. It was stated that these are removed prior to burial. 4. Observed waste was located within the permitted disposal footprint. 5. Landfill side slopes comply with the permitted 3:1 ratio of three horizontal feet to one vertical foot. Vegetation on slopes is well established and adequate for erosion control. 6. No standing water was observed in contact with waste during the inspection. 7. Solid waste must be covered with one (1) foot of suitable soil at least once per month or when active face reaches one (1) acre in size. Observed active area was less than one acre.
