Dear Ms. Stanley:
Waste Management of Carolinas (WM) respectfully submits this summary letter report in
accordance with N.C.G.S. 130A‐295.6(h2) which stipulated the reporting of: (1) researching the
development of alternative disposal technologies; and (2) a feasibility study of landfill gas‐to‐
energy, or other waste‐to‐energy technology for the Great Oak Landfill (Landfill), Permit No 76‐
07. As you know, this requirement is only in place for landfills that are permitted to accept
greater than 240,000 tons of Municipal Solid Waste (MSW) per year and were constructed after
2013.
NCGS 130A-295.6(H2) (1) - RESPONSE
WM has a long history of supporting research institutions whose research includes landfills and
waste disposal technology. In North Carolina specifically, WM has active research agreements
with North Carolina State University and the University of North Carolina at Charlotte. WM also
participates closely with Environmental Research and Education Foundation (EREF) on industry
issues, concerns and innovations.
WM has researched and is aware of the following alternatives to landfilling, including: Waste‐
To‐Energy Incineration; Anaerobic Digestion; Mechanical Biological Treatment; Pyrolysis; and
Plasma Arc Gasification. However, implementing and sustaining these methods are not
deemed to be economically or logistically feasible for the citizens of Randolph County nor WM
at the present time. Considering the current economy and with the presently available
technology, WM continues to operate the Landfill above industry standard using the most
affordable and advanced technology available. WM hopes to have the ability to continue its
efforts towards innovative solutions for the solid waste industry once the economy returns and
can maintain the thriving state of early 2020.

The feasibility of a landfill gas‐to‐energy scenario at the Landfill continues to be ongoing. The
Landfill is currently regulated according to the applicable portions of MSW Landfill New Source
Performance Standards (NSPS) Subpart XXX. Under the requirements of the regulations, the
Landfill must submit an annual calculation of NMOC emissions following the procedures
specified in 40 CFR 764. WM utilizes EPA’s LandGEM model to calculate emissions based on
actual waste disposal for the calendar year and regulatory specified default variables.
Our current Tier 2 calculations resulted in an NMOC value of below the NSPS Subpart XXX
threshold of 34 Mg/yr; therefore the landfill does not meet the requirement for the installation
of a Landfill Gas Collection and Control System (LFGCCS). Without production of enough
landfill gas to install and run a LFGCCS successfully, an evaluation of a landfill gas‐to‐energy
facility is not feasible at this time.

Permit Approval to Operate 7607‐MSWLF‐2015 (FID 1357255) was issued on August 30, 2019, to Randolph County
(owner) and Waste Management of Carolinas, Inc. (operator) for Great Oak Landfill. The permit approves an
increase in the disposal rate for the landfill to 4000 tons per day. Great Oak Landfill is now permitted to receive
greater than 240,000 tons per year and the owner or operator must comply with N.C.G.S. 130A‐295.6(h2) (see text
below). This statute requires studies and research and development pertaining to alternative disposal techniques
and waste‐to‐energy matters. Reports are due to the Section annually on or before July 1.
N.C.G.S. 130A‐295.6(h2):
(h2) Studies and research and development pertaining to alternative disposal techniques and waste‐to‐energy
matters shall be conducted by certain sanitary landfills as follows:
(1) The owner or operator of any sanitary landfill permitted to receive more than 240,000 tons of
waste per year shall research the development of alternative disposal technologies. In addition,
the owner or operator shall allow access to nonproprietary information and provide site resources
for individual research and development projects related to alternative disposal techniques for the
purpose of studies that may be conducted by local community or State colleges and universities
or other third‐party developers or consultants. The owner or operator shall report on research and
development activities conducted pursuant to this subdivision, and any results of these activities,
to the Department annually on or before July 1.
(2) The owner or operator of any sanitary landfill permitted to receive more than 240,000 tons of
waste per year shall perform a feasibility study of landfill gas‐to‐energy, or other waste‐to‐energy
technology, to determine opportunities for production of renewable energy from landfills in order
to promote economic development and job creation in the State. The owner or operator shall
initiate the study when sufficient waste is in place at the landfill to produce gas, as determined by
the United States Environmental Protection Agency's Landfill Gas Emissions Model (LandGEM),
and may consult and coordinate with other entities to facilitate conduct of the study, including
local and State government agencies, economic development organizations, consultants, and
third‐party developers. The study shall specifically examine opportunities for returning a portion
of the benefits derived from energy produced from the landfill to the jurisdiction within which the
landfill is located in the form of direct supply of energy to the local government and its citizens, or

through revenue sharing with the local government from sale of the energy, with revenues owing
to the local government credited to a fund specifically designated for economic development
within the jurisdiction. The owner or operator shall report on its activities associated with the
study, and any results of the study, to the Department annually on or before July 1.
