(Section 1.2) The Permit Application shall be prepared according to the applicable Rules 15A NCAC 15B .14001 through .1410 readopted effectively November 01, 2019. The preparations of a permit renewal and modification shall be done according to Rule 15A NCAC 13B .1401. 2. (Section 3.2) Please include the prohibited waste streams coming into the compost unit(s) per Rule 15A NCAC 13B .1403. 3. (Section 3.6) i. Please describe how to temporarily store (such as roll-off box) and remove & properly disposed of (by whom & disposed at where – the onsite landfill units or transfer station) all collected non-compostable contaminants or nonconformance wastes from the waste screening processes [Rule 15A NCAC 13B .1406(9)(j)]. ii. The Section 3.6 describes utilization and operation of Plat 1, 2, & 3 are likely inconsistent to those stated in Section 3.8, the drawing sheets in Appendix of the permit application, and the Facility Compliance Inspection Report November 22, 2019. The prescribed operations at Plat 2 in this section is likely occurring at Plat 3 which is abutting Plat 1 as shown on the drawing. Plat 2, abutting TDDSS -DS41-002 is separately located from Plats 1 & 3. Please clarify. 4. (Section 3.7) Sizes of plies of feedstock or finished product shall be reduced to the dimensions that are required by the local fire marshal. And the isle distance between stockpiles shall be 25 feet per Rule 15A NCAC 13B .1404(a)(8). Please add the requirements to the Section. 5. (Section 3.9) Please add the following requirements to this Section i. Waste grinding should not be conducted during the raining day [Rule 15A NCAC 13B .1406(9)(i)]. ii. Surface water protection per Rule 15A NCAC 13B .1404(9). The rule-required permit or approval document should be appended to this permit application. 6. Please provide documents and descriptions of vertical buffer for groundwater protection per Rule 15A NCAC 13B .1404(10)(A), (B) & (D). 7. Please provide a section to discuss the operational requirements per Rule 15A NCAC 13B .1405(8)(c) - (e). 8. (Section 3.11) Please describe the training/education credential of the staffs operating the compost units and the record keeping requirements per Rule 15A NCAC 13B .1406(19). 2 9. (Section 3.15) “Results of tests required in Table 3 of Rule. 1408” is the incorrect/out-of-date reference for a Large Type 1 compost facility. 10. (Section 3.16) Please add the following requirements to this Section: i. The arrangement of fire-fighting assistance from a local fire department/Fire Marshal per Rule 15A NCAC 13B .1405(12) & 1406(7). ii. Open burning of solid waste shall be prohibited per Rule 15A NCAC 13B .1406(7). iii. Reporting a fire per Rule 15A NCAC 13B .1406(8). (Section 3.17) Please describe where the collected litter and/or stray debris will be temporarily stored and disposed of. 12. The facility must be operated in a manner that reduces the potential for vector attraction. Please add this requirement to the operation plan. 13. Please address the dust control/suppression measure(s) during the periods of conducting waste processing (grinding) and treatment (curing & turning) per Rules 15A NCAC 13B .1404(c)(3), .1405(8), & .1406(9)(k). 14. Please describe the facility closure requirements per Rule 15A NCAC 13B .1410. Please contact me if you have any questions or requests for further clarification on the comments. The reason for the “delay” of the reviewing process is because the compost rule (Section Rule 1400) went through a rule readoption process this year (in fact all NC Solid Waste Management Rules had gone, are going, and will go through this law-required processes). The new rule – Section 1400 was approved on 11/01/2019 but just being posted on-line this noon.
