PURPOSE OF SITE VISIT: Comprehensive Follow Up Inspection STATUS OF PAST NOTED VIOLATIONS: Permit Attachment 3, Part VII, 33. – RESOLVED -Mulch going to 401 Sand (N0396) for slope erosion control and confirmed not for public use currently. Permit Attachment 1, Part I, 8 –RESOLVED – EOW markers installed on LCID. 15A NCAC 13B .0563 (1) (a) – RESOLVED – Unapproved waste removed from LCID. OBSERVED VIOLATIONS: NA FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 ADDITIONAL COMMENTS 1. (Land Clearing and Yard Waste Debris Processing Conditions) Permit Attachment 3, Part VII, 32 - The volume of material that will be processed and stored must be contained within the 0.5-acre wood grinding area and one (1) acre wood storage/stockpile area shown on drawings included in approved operation plan. At the time of this inspection and the last in March, it appeared that the area had reached the maximum size for the grinding area and stockpile area and waste was being removed by 401 Sand. Please contact permitting if you would like to increase the size limits of the approved areas. Otherwise the removal of the mulched yard waste/trash will need to increase, in order to not go over the specified grinding and stockpile areas and risk violation. Recommend that markers are installed to outline the limits of this area. 2. While onsite, some unapproved waste, plastic and shingles, were spotted in the yard trash waste waiting to be mulched. Mr. Russell and Mr. Koliba contacted staff to remove immediately. An attendant shall be on duty at all times while the landfill is open for public use to assure compliance with operational requirements and to prevent acceptance of unauthorized wastes. Recommend that facility staff accompany customers to the LCID or YW areas when dumping to better screen waste to ensure only acceptable waste is received. This will prevent this issue. 3. Leachate was present on yard waste side waiting to be mulched as well as stockpiles already mulched. Be sure and manage according to permit and best practices. Do not allow leachate to runoff from area designated for Yard Waste Debris Processing. Also, remember waste cannot be in water, so manage accordingly. Site should be graded to allow for positive drainage of water away from the waste storage and processing area. 4. Fire breaks were implemented on the yard trash stockpiles waiting to be mulched, but not the mulched material waiting to be hauled off. The mulched material windrows need this, even more so than other to ensure fire control, should a pile spontaneously combust. 5. Permit Attachment 3, Part VII, 33 - If wood material/mulch containing yard trash is provided to the public, the permittee must submit a plan for composting the yard trash in accordance with the requirements of 15A NCAC 13B .1400, et. seq. Keep this condition in mind if County decides to change its current method of removal of the mulched material to 401 Sand Notified LCID for slope and bank stabilization. 6. Permanent EOW markers were reinstalled on the active cell of the LCID to define the limits of the waste and were visible one to the other. Ensure the EOW markers are installed for the inactive areas as well. 7. Trees and shrubs were being removed as requested from slopes of the active cell of the LCID. LF waste, that was exposed last visit, was properly covered and pushed inside EOW boundaries and the unapproved waste removed. The vegetation on inactive areas of the LCID should be mowed when conditions allow. 8. Excavation, grading and fill material side slopes must not exceed a ratio of three horizontal feet to one vertical foot (3:1) unless previously approved by the Section. Slopes of LCID were improved, please maintain this moving forward. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Issues with the need for additional equipment and staff were discussed as the main issues. It was suggested by facility staff the possibility of closing the LCID or contracting this work to be done instead. Currently, the County has a backhoe for grading, pushing, covering and soil excavation. This is a difficult job to accomplish with just this equipment and no backup either. 10. Corrective measures are necessary as a result of this inspection. A follow up inspection will be conducted about 30 days after sent date of this inspection.
