PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: 15A NCAC 13B .0542 OPERATION PLAN AND REQUIREMENTS FOR C&DLF FACILITIES (f) (1) & (2) & (g) (3) The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS: 01 – Life of Site Permit issued April 08, 2018. 02 – Facility has a locking gate and fencing for security. Entrance signage has required information. 03 – Roads are constructed of all-weather construction. 04 – New Landfill directional signs have been installed and look good. 05 – Edge of waste markers still needs to be reinstalled in several areas at the C&DLF when cover work is completed on side slopes. This was noted on the January 08, 2020 inspection also. 06 – This facility has 4 Certified Landfill Operators: Justin Harrison, expires 9/27/2022, Johnny Rascoe, expires 12/6/2021, Kimley Brown, expires 9/27/2022 and Ronald Brownfield, expires 10/19/2022. 07 – Scrap tires are being collected at this facility and laced into a Box trailer. 08 – Scrap metal pile is getting rather large. There has been an issue with the past contract hauler. A new Contractor has been contacted to remove the scrap metal. 09 – Several White goods containing CFC’s are not upright. Must be kept upright until the CFC is removed. 10 – Electronics area is being managed well. 11 – No non-conforming waste observed at the C&DLF working face. 12 – Concrete has been ground up and ready for use. Has 1 small pile started of concrete to be ground when there is enough to bring in grinder. 13 – Yard Waste pile has 1 large item of non-conforming waste noted. It appears the non-conforming waste was dumped and then pushed up to the top of the pile. It would be best to remove any non-conforming waste before it has been pushed to the top of the pile. 14 – Facility is using the S/M approved cover at the 50/50 rate. 15 – No records were reviewed during this inspection. 16 – OBSERVED VIOLATIONS: 15A NCAC 13B .0542 OPERATION PLAN AND REQUIREMENTS FOR C&DLF FACILITIES: (f) Cover material requirements: (1) Except as provided in Subparagraph (3) of this Paragraph, the owners and operators of all C&DLF units must cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half acre and at least once weekly. Cover must be placed at more frequent intervals if necessary to control disease vectors, fires, odors, blowing litter, and scavenging. A notation of the date and time of the cover placement must be recorded in the operating record as specified in Paragraph (n) of this Rule. (2) Except as provided in Subparagraph (3) of this Paragraph, areas which will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, must be covered and stabilized with vegetative ground cover or other stabilizing material. (g) Spreading and Compacting requirements: (3) Appropriate methods such as fencing and diking must be provided within the area to confine solid waste which is subject to be blown by the wind. At the conclusion of each operating day, all windblown material resulting from the operation must be collected and disposed of by the owner and operator. 17 – A follow-up inspection will be conducted of the observed violations of cover material and blowing litter will be re-accessed in 30 days to ensure compliance has been met. 18 – If compliance has not been met, A Notice of Violation will be issued. 19 – Digital pictures taken during this inspection with several attached to this inspection report.
