Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Andrew Hammonds and David Powell met with David Lambert to introduce new staff as well as to conduct a partial inspection, while providing technical assistance with the issues at the CDLF, Closed MSW and Transfer station. 2. DWM staff along with Solid Waste Director road around perimeter of Closed MSW. 3. Woody vegetation and small trees were observed growing on the cap during this inspection within the waste footprint. EOW markers need to be checked and/or installed in the correct position, if not already and all woody vegetation shall be removed. Trees that are greater that six inches in diameter must be cut and have the root system removed as conditions allow. The cap shall be repaired where the root system is removed. Permanent edge of waste markers need to be maintained around all landfill footprints. 4. Ponded water was observed in settled areas within the waste footprint of the landfill. County staff should inspect the landfill cap once the vegetation has been mowed to ensure there is no ponding water over waste and that there is positive drainage over cap. When ponding water is observed be sure to check for leachate seeps along the slopes and toe of the landfill. Areas of subsidence should be repaired by adding necessary soils when conditions allow to prevent ponding water. Repaired areas should be graded to ensure positive drainage of water from the LF cap and properly seeded and mulched to establish permanent vegetative cover sufficient to restrain erosion. 5. Landfill slopes and perimeter were being mowed, where wasn’t too wet, during inspection. Please wait until it is dry to do the mowing to ensure the integrity of the cap. The small trees that can be cut by hand need to be removed from within the waste foot print. 6. The yard waste mulch can be used to establish vegetation and erosion control in bare areas on the Closed MSW, but cannot be over applied or used to fill in low areas. A large area of thickly applied mulch is present on top of LF and needs to be spread out to less than a four-inch thickness. 7. Recommend that the perimeter of the facility outside the EOW is inspected for seeps or releases. 8. There was a drainage feature near top of the cap along Northside that needs to be repaired to ensure water flows from the cap. 9. Two new gas flares were installed recently on the North East side of LF. 10. Well 6 was locked, and had a tag and area around well looked undisturbed. All monitor wells should be inspected to ensure they are properly working, locked and tagged. 11. Corrective measures are necessary at this site based on observations during this inspection. Corrective measures should be completed within 60 days’ receipt of this report.
