Project No. 1895531 REPORT OF ENVIRONMENTAL JUSTICE REVIEW - SUBSTANTIAL AMENDMENT TO PERMIT MOORE COUNTY C&D LANDFILL, PERMIT NO. 63-01-CDLF-1992, ABERDEEN, NC INTRODUCTION & BACKGROUND This report is offered to Moore County (the County) to satisfy a request from the North Carolina Department of Environmental Quality's (NC DEQ) Solid Waste Section (the Section or SWS) to Golder Associates NC, Inc. (Golder) in an email dated December 17, 2019 related to the permit amendment being sought by the County for the above -referenced facility. The request was to submit Environmental Justice documentation to the Section separate from the permit application. Prior to the request, the Section reviewed demographic and socioeconomic information supplied by Golder to them on behalf of the County following an Environmental Justice (EJ) desktop review triggered by the County's request for a substantial amendment to the landfill permit. No significant proximal concerns were found during the desktop review. Further due diligence actions recommended by the Section included informing the Lumbee Tribe and potentially underinformed residents on the periphery of the one -mile buffer area of the County's intention to expand their active construction and demolition (C&D) landfill. This report documents the County's actions to research demographic and socioeconomic data in the vicinity of the landfill and to notify and inform those groups. DESKTOP REVIEW With regard to Cumulative Impacts - CRA Title VI (G.S. § 130A-294 (a)(4)c.9), to address EJ issues, a desktop review was conducted by Golder using the EJSCREEN website (https://ejscreen.epa.gov/mapper/). Using the EJSCREEN website, the one -mile buffer around the facility was searched for demographic and socioeconomic data using map layers identified as: sites reporting to the Environmental Protection Agency (EPA), hazardous waste sites, water features, places, schools, transportation, prisons, public housing, and subsidized housing. The resulting screen map is included in Appendix A. Demographic and socioeconomic reports for the one -mile buffer area, including the 2013-2017 American Community Survey (ACS) Report and the 2010 Census Report, were then retrieved and evaluated. Both are enclosed in Appendix A. Potential concerns were then addressed by comparison of the reported data to EPA Standard Criteria including: • 50% or more minority population within the project area • 5% or more households above poverty • Limited English Population groups which constitute 5% or include 1,000 members (whichever is less) of the population of persons eligible to be served or likely to be affected or encountered • 10% or more difference when compared to the county average. Within the EJSCREEN ACS Summary Report, there was an estimated 7 percent American Indian population within one mile of the facility boundary. Moore County's overall population was reported at 0.8 percent, which makes the ACS reported population statistically significant. REQUESTED NOTIFICATIONS In response to the Section's request to inform the Lumbee Tribe of North Carolina of the County's intention to expand the landfill, the Tribal Chair, Mr. Harvey Godwin, Jr., was emailed by Golder on January 2, 2020 and informed of the County's intentions and of their efforts to address the EJ obligations identified by the Section. An email reply acknowledging receipt and promising review and comment was received that same day from Freda Porter, PhD, Tribal Administrator. After no further response was received, an email request for an update on the review was sent to Dr. Porter on January 14, 2020 and again on March 20, 2020, with copies to Mr. Godwin. No responses to those inquiries have been received. The referenced emails (4) are included in Appendix B. In response to the Section's request to inform potentially underinformed residents on the periphery of the one -mile buffer area, the County prepared a letter to households identified on a map provided by the Section. Those residents were informed by mail the week of December 16, 2019. The map ("Potential Mobile Home Sites"), an example letter, and a notarized list of the addresses mailed are included in Appendix C. No responses to the letters were received by the County's Solid Waste Manager. COUNTY ADMINISTRATION UPDATES We understand that the County's Solid Waste Manager and Public Works Director kept the County Manager informed of their and Golder's efforts to address EJ concerns related to the landfill expansion as requested by the Section. The administrators also informed the County Commission of these efforts at a commission work session on May 6, 2020. CLOSURE This report documents and substantiates the efforts the County has taken to fully address the County's obligations relative to compliance with CRA Title VI (G.S. § 130A-294 (a)(4)c.9) and to notify its potentially affected citizens. We would appreciate it if Golder / Moore County would complete the following additional steps. Contact the Lumbee Tribe. Within the EJSCREEN American Community Survey (ACS) Summary Report, there was an estimated 7 percent American Indian population within one -mile of the facility boundary. Moore County's overall population was reported at 0.8 percent, which makes the ACS reported population more than 50 percent. As the established counties for the Lumbee Tribe are in Sanford and Hoke, there is probably a flow over into Moore County. Recon one -mile After review of Google Earth, it appears there maybe sections of mobile homes surrounding the one - mile from the facility boundary. The Section would recommend Golder to ground truth the findings and determine if additional information should be supplied to any identified areas. This information could come in the form of a postcard or door hanger. Discuss findings with County Manager and Commission members. When Golder completes the above items, discuss the results with the County. Put together a report Golder should submit the following to the Section. This should include the desktop review, maps, reports, findings, and correspondences. Once this occurs the Section will respond to the findings. After providing statutory -required public notice and receiving feedback from citizens on November 19, 2019 the Moore County Board of Commissioners voted to approve the request and submit the application to North Carolina Department of Environmental Quality (NCDEQ). Moore County currently operates the Construction and Debris landfill within an area we refer to as Cell 5. The proposed Cell 6 area is located entirely within the land owned by Moore County and all statutory buffering requirements are being maintained.
