North Carolina Dept. of Env. & Natural Resources Raleigh Central Office 217 West Jones Street Raleigh, North Carolina 27603 Re: Uwharrie Regional MSW Landfill—Life of Site Permit Request Facility Permit No. 62-04 Montgomery County, North Carolina HHNT Project No. 6703-291-01 / 07 Dear Mr. Chao: As you know, the current Permit to Operate for the subject facility is scheduled to expire on May 14, 2020. On behalf of Republic Services of North Carolina, LLC (Republic), we are writing to request that a Life of Site Permit be issued for the continued operation of the landfill. In support of this request, we have enclosed a copy of the 2020 Municipal Solid Waste Landfill Franchise Ordinance Amendment for Montgomery County, North Carolina. This Amendment was adopted by the Montgomery County Board of Commissioners on March 17, 2020 and extends the effective date of the Ordinance to the Life of Site. A complete copy of the Franchise Ordinance, including this Amendment has been enclosed for your use. At this time, the Uwharrie Regional MSWLF has an estimated 3 years of remaining, constructed airspace within the current waste footprint. However, Bunnell-Lammons Engineering (BLE) and Hodges, Harbin, Newberry, & Tribble, Inc. (HHNT) have been working with Republic on a Life of Site Permit to Construct Application which covers all remaining cells and/or phases of the facility. It is anticipated that the Design Hydrogeologic Report will be submitted by BLE to the Solid Waste Section within the next several weeks in support of this Life of Site Permit to Construct application. Likewise, HHNT will be submitting the Engineering Application in the next several weeks for review by the Section. We appreciate your time and consideration with regard to issuing a Life of Site Permit to Operate. Nothing is changing except that the local government has approved the life of site. I don’t see how we can deny. Also, it is my understanding that Uwharrie will be sending an application for PTC Ph 5 and 6 shortly (2-3 weeks). We can get all of the plans updated in that application. The Landfill and his consultant lately submitted the PTC application -Phase 4 in 2008 (almost 12 years ago). The Facility, Engineering and Operations Plan got modifications through the years between 2009 and 2012. Last PTO renewal dated 2014 was just a piece of a letter followed up a modification of the protective cover system. When I took over the facility from John Murray in 2017, I was overwhelmed by the dozen documents floating around, but not a comprehensive permit application is available. After issuing the PTO in August 2017 (see attachment), Republic and HHNT criticized the permit conditions are not applicable (see attachment) UWH_PTO. The disputes had not been settled yet. But I told them verbally at that time, when the LOS permit application was due, they would have to get all info updated and sent in a completed permit application. Now they avoided to talk me directly but got you agree (took advantage on you of not knowing the “dirty” history of the matters) on some sort of agreement to renew the a LOS permit. I am strongly suggesting you rejecting the application on the basis of Rule 15A NCAC 13B .0207 (b), (c), & (d). Any update of the required plans in Section Rule 1600 shall be incorporated into the Permit Application.
