Additional information must be provided before the application is considered complete. Note that this information was requested in previous review letters from the Section. Please provide the requested information in order to continue the review process. 1. In two previous completeness review letters, the Section requested that Chambers complete the archaeological study of the site. The Section understands that numerous potential sites were located and the sites are in various stages of investigation. Ten of the identified sites still require further action. Two sites are eligible for the National Register of Historic Places. One of these sites is located in an area that will not be developed and Chambers plans to protect this site in place. Provide four copies of the in -place protection plan for this site. Obtain concurrence with this plan from the Division of Cultural Resources and provide copies of the concurrence to the Solid Waste Section. The other site will be impacted by development since it is located within the landfill footprint. Chambers plans to recover artifacts from the site. These sites are located in areas which will never be impacted by development at the MSWLF facility. The Division of Cultural Resources should be consulted regarding the decision to cease further investigation at these sites and protect the sites in place. The Section will concur with Chambers decision if the Division of Cultural Resources approves. Chambers will be required to submit plans for the in -place protection of these sites and obtain concurrence with these plans from the Division of Cultural Resources. Four copies of the protection plans and written concurrence from DCR will be required for submittal to the Solid Waste Section for inclusion in the site plan application. There are four sites that will be impacted by development that also require further investigation. Phase II investigations shall be completed for these sites. Four copies of the investigation results shall be submitted to the SWS for inclusion in the site plan application along with concurrence with conclusions from the DCR. Further action at these sites is dependent upon the outcome of the Phase II investigations. 2. Service area for the facility was not addressed in the local government approval. Chambers mentions in the response letter Of 1/4/93 that service area is described in the contract and that the contract was reviewed and approved by the Anson County Commissioners. Please provide the minutes of the meeting in which the contract was approved. Though the application is considered incomplete, the Section has begun a technical review. The following comments must be addressed: 1. A general description of any special engineering features (i.e. spring capture drains) must be included in the application. 2. Provide one drawing which identifies the entire facility boundary, landfill footprint, ancillary facilities, wetlands, locations of significant habitat areas that will be protected, floodplains, locations of archeological sites eligible for the National Register of Historic Places and locations of those sites whose eligibility for NRHP is undetermined but are proposed for in -place protection on undeveloped areas of the site. All springs, seeps, or other surface water features located on within the facility boundary or within the CSX right-of-way should be included on this drawing as well. Mr. Cekander June 24, 1993 Page 3 3. The distribution of diabase dikes on the site needs to be mapped and sufficient piezometers installed to determine the hydraulics of the dikes. 4. Additional information must be provided regarding the nature and locations of faults and their influence on the site's hydrology. S. Wells MW-18-SB, MW-17-SB, MW-31-SB, and MW-33-SB have hydraulic conductivities on the order of 10-3 cm/sec. The first three wells form a line parallel to a proposed north- south.fault and the proposed trend of the diabase dike. What is the origin of this conductive zone and can additional zones be expected? I have enclosed a copy of the comments made by the Division of Environmental Management regarding your application. Dear Ms. Gledhill -Early: On behalf of Chambers Development Company, Inc. we are submitting a draft Phase II archaeological report and a proposed draft Memorandum of Agreement concerning archaeological resources associated with the proposed Anson County Regional Landfill west of Wadesboro, North Carolina. Chambers has asked us to submit this material to your office in conjunction with their application for a solid waste permit from the State of North Carolina and to assist in fulfillment of federal obligations under their Corps of Engineers wetlands permit. This cover letter summarizes the current status of archaeological research at the Anson County landfill, which began with our initial Phase I archaeological survey between September 1991 and January 1992. That survey resulted in the identification of 17 archaeological sites. In a report submitted in April 1992, Garrow recommended that five of the 17 did not produce sufficient data to warrant further study or protection. Garrow recommended that additional testing be conducted at the other 12 sites if they are to be impacted by landfill development activities. The North Carolina State Historic Preservation Office (NCSHPO) reviewed the report and concurred with these recommendations. In July of 1992, Chambers requested that we conduct Phase II Evaluation studies at five of the 12 sites that were within what was then defined as the impact zone of landfill facilities (31AN60, 61, 64, 76, and 127). These five Phase II studies and survey of 93 acres that was not available during the initial survey were conducted in September of 1992, with reports submitted in November of 1992. This research concluded that only one of the five Phase II sites studied (31AN60) appeared to be significant and recommended that no further studies or protection were needed at the other four sites examined (31AN61, 64, 76, and 127). The survey of 93 additional acres identified two new sites (31AN130 and 31AN133) and we recommended that site 31AN130 was not significant and site 31AN133 should be studied further or protected from impacts. The NCSHPO reviewed the Phase II and Phase I Addendum reports and concurred with our recommendations. In 1994, Chambers reduced the size of the parcel that they plan to acquire for the landfill project, which resulted in several of the potentially significant sites now being completely Atlanta, Georgia Memphis, Tennessee Latrobe, Pennsylvania r Garrow & Associates, Inc. Page - 2 outside the project area. In addition, Chambers has modified the construction plans within the acquisition parcel to avoid impacts to as many archaeological sites as possible. In April of 1995, Chambers requested that Garrow conduct Phase II testing studies at two sites that could not be avoided by project modifications. We have completed these studies, and a draft report is enclosed with this letter to document our conclusion that neither site is eligible for the National Register of Historic Places. In summary, Garrow & Associates has identified the following archaeological sites on the property that Chambers now plans to acquire: • Sites 31AN82 and 130 were identified during Phase I survey and NCSHPO has determined that they are not eligible for the NRHP • Sites 31AN61, 64, 76, and 127 have been tested by Phase II evaluation studies and the NCSHPO has determined that they are not eligible for the NRHP • Site 31AN83 and Loci A and C of Site 31AN62 have been tested by Phase II evaluation studies. Garrow recommends that they are not eligible for the NRHP and now seeks the concurrence of the NCSHPO. • Loci B of Site 31AN62 and Sites 31AN63 and 75 were determined to be potentially eligible for the NRHP after the Phase I survey, but they are completely outside the impact area of the landfill. Chambers proposes to preserve these sites and protect them in perpetuity. • Site 31AN60 has been determined eligible for the NRHP and will be impacted by landfill construction. As an impact mitigation measure, data recovery excavation studies will be conducted at this site prior to any land -altering activities. To address the need for data recovery at site 31AN60 and for preservation measures at the other potentially significant sites on the landfill property, we have taken the liberty of preparing a Memorandum of Agreement (MOA) that stipulates the measures to be taken. A draft of the proposed MOA is enclosed with this letter for your review and comment. The MOA will of course have to be negotiated and signed with the Corps of Engineers for compliance with their federal Section 106 responsibilities, but we wanted to formally outline the measures that Chambers wants to implement to ensure preservation of significant archaeological information. Jose Urrutia, Chambers 3 D o A Fil- MEMORANDUM OF AGREEMENT SUBMITTED TO THE ADVISORY COUNCIL ON HISTORIC PRESERVATION PURSUANT TO 36 CFR 800.6(A) REGARDING THE ANSON COUNTY REGIONAL LANDFILL PROJECT (ACTION I.D. # 199203131 AND NATIONWIDE PERMIT # 26) WHEREAS, the Wilmington District of the United States Army Corps of Engineers (COE) has determined that construction of the Anson County Regional Landfill will have an effect on properties eligible for inclusion in the National Register of Historic, Places, and has consulted with the North Carolina Historic Preservation Office (SHPO) pursuant to 36 CFR Part 800, regulations implementing Section 106 of the National Historic Preservation Act (16 U.S.C. 470f); and WHEREAS, the developer of the Anson County Regional Landfill, Chambers of North Carolina, Inc. (Chambers) has participated in the consultation and has been invited to concur in this Memorandum of Agreement (MOA); NOW, THEREFORE, the COE and the North Carolina SHPO agree that the undertaking will be administered in accordance with the following stipulations in order to take into account the effect of the project on historic properties. Stipulations The Wilmington District, COE, will monitor the progress of the stipulated tasks and will incorporate completion of such tasks as a requirement for permitting of the project. Failure to comply will result in the withdrawal of the COE permit. The COE will ensure that the following measures are carried out: A National Register -eligible Archaeological Sites The COE will consult with the SHPO and the Council to determine appropriate treatments for any archaeological sites that have been determined to be eligible for the National Register of Historic Places. These include site 31AN60 and any other sites DRAFT of May 23, 1995 Page - 1 DRAFT subsequently determined eligible (see Stipulation B, below). Potential appropriate treatments include the following: 1. Preservation in Place a. Preservation in place is the preferred treatment, and Chambers has modified the property boundaries and landfill construction plans to avoid all but one eligible archaeological site. All other eligible sites will not be disturbed. b. A plan to protect eligible archaeological sites avoided and preserved in place will be developed and implemented in consultation with the SHPO. 2. Archaeological Data Recovery a. For any eligible archaeological sites that cannot be avoided, a data recovery plan for the retrieval of significant archaeological information will be developed and implemented. b. A data recovery plan that addresses substantive research questions will be developed in consultation with the SHPO for the recovery of significant archaeological data. The plan will be consistent with the Secretary of the Interior's Standards and Guidelines for Archaeological Documentation (48 FR 44734-37) and take into account the Council's publication Treatment of Archaeological Properties (Advisory Council on Historic Preservation (draft] 1980) and Guidelines prepared by the North Carolina Office of State Archaeology. It will specify, at a minimum, the following: • the research questions to be addressed through the data recovery, with an explanation of their relevance and importance; • the methods to be used, with an explanation of their relevance to the research questions; • the proposed disposition of recovered materials and records; and, DRAFT of May 23, 1995 Page - 2 DRAFT • a proposed schedule for the submission of progress reports and final reports to the COE, the SHPO, and the Council. c. The data recovery plan will be submitted to the COE and the SHPO for thirty (30) days (from receipt of documentation) review and approval. Unless the SHPO objects within thirty (30) days after receipt of the plan, the COE will ensure that it is implemented. d. A draft technical report of these investigations will be prepared by the Principal Investigator and submitted to the SHPO and the COE. The final report (marked final), incorporating the SHPO's and the COE's comments will be provided to the SHPO and the COE for final review. The SHPO will write to the COE as to the final acceptability of the report. e. The COE, after consultation with the SHPO, will write the Advisory Council on Historic Preservation concerning data recovery results. Documentation will be sent to the Council to support the finding of mitigation of adverse effect. f. The COE will ensure that all artifacts recovered during the archaeological investigations are stabilized and processed for curation in a repository meeting professional curation standards in accordance with 36 CFR Part 79. Copies of all records, including, but not limited to, field notes, forms, maps, catalogue sheets, and representative photographs (negatives) will be submitted for curation with the artifacts. Documentation that the repository has received and accepted these materials will be supplied to the SHPO. B. Archaeological Sites Whose Status Has Not Yet Been Determined Phase I survey identified three archaeological sites within the landfill property that were determined by the SHPO to require additional investigations to enable an evaluation of National Register eligibility. Further studies have been conducted on all such sites within the currently known area of potential effect, and all have been determined not eligible for the National Register. To ensure that potentially significant deposits currently outside the area of potential effect (Loci B of Site DRAFT of May 23, 1995 Page - 3 L nn 31AN62 and Sites 31AN63 and 75) are not affected by future modifications in the landfill project, the COE will ensure that the following measure is implemented 1. Archaeological Evaluation. Prior to any land disturbing activities such as (but not restricted to) excavation, tree clearing, grading, and/or borrowing in the area of sites 31AN63, site 31AN75, or Loci B of Site 31AN62, a Phase II evaluation study will be conducted to determine if the site(s) is(are) eligible for the National Register of Historic Places. If any of the sites are determined eligible for the National Register, a treatment consistent with the measures described in Provision A (above) will be developed and implemented. C. Late Discoveries. If unanticipated cultural materials or human skeletal remains are discovered during project landscape - altering activities or archaeological investigations, Chambers will cause a temporary halt of these activities and immediately notify the SHPO and the COE of the late discoveries. This temporary halt will afford the SHPO the opportunity to assess the situation and recommend a course of action. These preliminary recommendations will be made by the SHPO within 48 hours of notification. D. Oualifications. All archaeological work conducted in conjunction with this memorandum will be carried out by or under the direct supervision of an archaeologist who meets, at a minimum, the Secretary of the Interior's Professional Qualifications Standards (48 FR 44738-39). E. Reports. All reports resulting from research carried out in compliance with this memorandum will be responsive to contemporary professional standards and the Secretary of the Interior's Format Standards (42 FR 5377-79), as well as standards presented in the North Carolina State Archaeology Guidelines. Copies of the reports will be filed, at a minimum, with the COE, the SHPO, and the Research Laboratories of Anthropology at the University of North Carolina at Chapel Hill. Above the secondary geocomposite, the secondary sump will contain an approximate 15-foot length of 18-inch diameter SDR 17 perforated HDPE pipe surrounded by crushed stone (AASHTO No. 57 Stone) wrapped with a 10 oz./sy nonwoven geotextile. An 18-inch diameter SDR 17 solid wall HDPE riser pipe bedded within a trench shall extend up the slope, beneath the primary geomembrane. Details of the secondary monitoring system can be referenced in the Engineering Drawings. Any water entering the secondary monitoring system sump shall be pumped out via a submersible pump for disposal to the local POTW. Sampling and analysis of the secondary monitoring system shall be conducted in conjunction with collection samples from the groundwater monitoring wells to determine if a leak has occurred. Analytical data will be evaluated and compared to groundwater standards and background conditions of the site. 2 - 12 (Rev. 9/98) The final landfill surface will include side slope terraces at nominal 40 feet vertical interval. The side slope terrace will intercept the stonnwater runoff and discharge it to pipe down spouts. The pipe down spouts will discharge in to the perimeter ditch. The stormwater collected in the perimeter ditch will be diverted to one of the three sedimentation basins for detention and discharge to the on -site watercourses which ultimately discharge to the Pinch Gut Creek or Brown Greek. The side slope terraces, pipe down spouts and the perimeter ditch will be constructed incrementally along with development of various cells and capping of the areas reaching final grades. Sediment Basin No. 1 located east of the landfill will be constructed and on-line prior to construction of Cell IA. The proposed perimeter ditch and basins will be vegetated or rip -rapped to minimize potential for erosion. The outflow from the basins will be controlled by riser -type outlets and discharged to a rip -rap apron to reduce flow velocities and erosion potential. As required by the North Carolina Sedimentation Pollution Control Law, Chambers has prepared a site -specific Erosion and Sediment Control Plan. This Plan includes hydrologic and hydraulic designs of the proposed control measures and has been submitted to and approved by the NCDENR Land disturbance activities will be conducted in accordance with the approved plan. 21.11 Enhanced Liner System An enhanced liner system will be installed in portions of the Phase I landfill footprint where little or no saturated overburden exists, which includes approximately 2.44 acres of Cell 1B, _ 4.13 acres of Cell ID, and 5.68 acres of Cell 1 E. The system will be constructed beneath the "low" end of these cells in areas where leachate accumulation is most likely. The aerial extent of the enhanced liner system in the affected cells can be seen in the Engineering Drawings. The proposed primary and enhanced liner systems will consist of the following components from top to bottom: ■ double -sided heat -bonded secondary geocomposite (6 oz./sy nonwoven geotextile/geonet/6oz.sy nonwoven geotextile); ■ 60 mil primary textured HDPE geomembrane; ■ double -sided heat -bonded secondary geocomposite (6 oz./sy nonwoven geotextile/geonet/6oz.sy nonwoven geotextile); ■ 60 mil secondary textured HDPE geomembrane; and ■ 24-inch compacted clay liner.
