Below is the complete one.   The readopted rule Section 1400 was effective on November 01, 2019 and the completed permit application was received onNovember 27, 2019. Therefore, the operations of yard waste collection area without active composting (equivalent to SmallType 1 Compost Facility) at the proposed LCIDLF shall comply with new readopted rule 1402(g)(1) which can be found inthe following link http://reports.oah.state.nc.us/ncac/title%2015a%20-%20environmental%20quality/chapter%2013%20- %20solid%20waste%20management/subchapter%20b/15a%20ncac%2013b%20.1402.pdf   15A NCAC 13B .1402 (g) - The following operations shall be exempt from the permitting requirements in Rule .1401 of thisSection: 1. Small Type 1 Facilities meeting the following conditions: (A) notification to the Division prior to operation and on an annual basis as to:(i) the facility location;(ii) the name(s) and contact information of the owner and operator;(iii) type and amount of wastes received;(iv) the composting process to be used;(v) the intended distribution of the finished product; and(vi) for new facilities only, a letter from the unit of government having zoning jurisdiction over the site thatstates that the proposed use is allowed within the existing zoning, if any, and that any necessary zoningapproval or permit has been obtained;(B) the facility operates in accordance with the operational requirements as set forth in Rule .1406(1) through (11) and (16) ofthis Section and the setbacks in Rule .1404(a)(1) through (a)(10) of this Section; The link of the specified Rules are http://reports.oah.state.nc.us/ncac/title%2015a%20-%20environmental%20quality/chapter%2013%20- %20solid%20waste%20management/subchapter%20b/15a%20ncac%2013b%20.1404.pdf   http://reports.oah.state.nc.us/ncac/title%2015a%20-%20environmental%20quality/chapter%2013%20- %20solid%20waste%20management/subchapter%20b/15a%20ncac%2013b%20.1406.pdf (C) the facility operates in accordance with all other state or local laws, ordinances, rules, regulations or orders;(D) the facility shall not be located over a closed-out disposal site; and(E) safety measures shall be taken to prevent fires and access to fire equipment or firefighting services shall be provided. In addition to the comments sent to you yesterday, the above-referenced rule requirements shall be added to the operationsplan if you still wants to operate a yard waste collection area. The existing zoning (F1575) allows constructing and operating a LCIDLF at the property; therefore, you need to obtain anapproval from the City/County Planning Board of operating a yard waste collection site (less than 2-acres and having a totalvolume up to 3000 CY- combining products and yard wastes) according to 15A NCAC 13B .1402(g)(1)(A)(vi), Please noted that a subdivision will be constructed right next to the proposed LCIDLF, and the proposed yard wastecollection area shall meet the new buffer/siting requirements as stipulated in Rules 15A NCAC 13B .1404(a)(2), (3) & (4). To avoid any dispute to a future resident for potential odor issues, you may want to relocate the yard collection area to theSouth or west side of the landfill property. Per 15A NCAC 13B .1406(7), please provide a written document from a local fire department (Union Cross Road) to agree toprovide assistance if landfill catch a fire. A fire extinguisher should be equipped to each on-site machinery or equipment; theon-site fire-fighting equipment should be noted on the site plan drawing Sheet C-1. Per 15A NCAC 13B .1406(8), please add the standard fire report form to the permit application, which can be downloaded from the link: https://files.nc.gov/ncdeq/Waste%20Management/DWM/SW/Forms/FireOccurrenceReport.pdf   Per 15A NCAC 13B .1406(10), the yard waste piles or windrows shall be monitoring for temperatures to prevent anypotential spontaneous combustion. You should set a maximum temperature for each stockpile/windrow and monitoringfrequency and instrument/probe. The remedial procedures such as wetting and turning should be provide in the writtenoperations plan. If you have a copy of the property deed please e-mail it to me. I did my deed search and found out the landfillproperty is currently owned by Tucker Trace Farms, LLC (see attachment) and the transaction was completed on 11/15/2019. Since this copy is downloaded from on-line search and not an official/legal document; therefore, the Solid Waste Sectionrequests to obtain an official/legal document with Deed Book/Pages Nos and property descriptions and official sealdate/signature. I am looking forward to receiving the written responses to the comments and any revised documents. Please conduct the following actions: a. Provide a copy of the latest property deed document issued by Forsyth County Register of Deeds. b. Make necessary revision/update on the submitted drawings and application forms. 2. According to the Special Use Permit- F1575 issued by City Winston-Salem/Forsyth County Planning Board, the proposed landfill site is located within Abbotts Creek WSIII Watershed, a public drinking water resource; therefore, a “WATERSHED PLAN PERMIT” is required as a portion of the permit application. Please provide a copy of thepermit. 3. Please provide the soil logs of the Test Pit # 2, 3, & 4 as shown drawing Sheet C-1. The log of each test pit should report, at a minimum, the depth of test pit, soil types, and water table elevation, if encountered. 4. Regarding the high-water table (SHWT) at this site, please address the following concerns: a. Operational Requirement Note No. 1 in drawing Sheet C-1 note field states that the seasonal high-water table (SHWT) is 878 feet above mean sea level (amsl). Please provide narratives how the SHWT isconcluded/determined. b. If the SHWT of 878 feet amsl is confirmed and the landfill base elevations ranging from 886 to 893.5 feet amsl, as shown drawing Sheets C-3 through C-5 will be established by excavation and regrading. Pleasedescribe the as-built survey requirements/assistance to confirm the landfill base construction. 5. Item 6. of the Operations Plan in drawing Sheet C-1 note field states that the landfill facility will receive uncontaminated soil for disposal. The uncontaminated soil a. must be an un-contamination earthen material and meet the “unrestricted use standards" - meaning contaminant concentrations for each environmental medium that are acceptable for all uses per NCGS 130A-310.65; and b. shall have any contaminant with a concentration less than or equal to that in the NC Residential Health Base Preliminary Soil Remediation Goal (NC PSRG) which can be found in the web link:https://files.nc.gov/ncdeq/Waste%20Management/DWM/risk_based_remediation/PSRGs_May2019_FINAL.pdf Please add the requirements to the revised application document. The copy of NC PSRG (Residential Health Base) mustbe appended to the Operations Plan. 6. Please provide the maximum extent (in acreage) for each of the proposed recycling unit – Wood Waste Collection Area, and Concrete Process Area.
