Teresa Bradford, DEQ – Solid Waste Section STATUS OF PERMIT: The Permit to Construct Phase 3, Cells 2K & 2M and the Permit to Operate Phases 1-3 was issued on May 1, 2019. The Permit shall expire on March 6, 2052. PURPOSE OF SITE VISIT: Operational Inspection STATUS OF PAST NOTED VIOLATIONS: 15A NCAC .1626(8)(d). The leachate outbreak and impacted areas have been repaired. Analytical data from sampling of the impacted area was conducted and submitted to Jackie Drummond, Hydrogeologist with the Solid Waste Section. No further assessment was required. This violation is considered resolved. OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The facility consists of a MSWLF and a drop-off convenience area for residential waste. 2. The facility is permitted to receive solid waste generated from within the City of Concord, Cabarrus County, the State of North Carolina and the following counties in the State of South Carolina: Cherokee, York, Lancaster, Chesterfield and Chester. 3. Proper signage was observed at the entrance of the facility. 4. A gate is provided at the entrance of the facility to prevent unauthorized access. Operations Inspection of the MSWLF: 5. Construction of Phase 3-Cell 2K has started. 6. Waste was being placed in Phase 3-Cell 2J. 7. The facility utilizes one tipper. 8. The working face appeared to be restricted to the smallest area feasible and compacted. 9. No unacceptable waste was observed. 10. The facility is permitted to use automobile shredder fluff mixed with soil, petroleum contaminated soil, tarps and foundry sand as alternative cover material. 11. Windblown litter was severe due to recent high winds and was being collected during the inspection. Wind fences are also being utilized at the working face. According to Rob LaTourette, additional temporary workers are being brought in to assist in daily pickup. 12. Additional landfill gas extraction wells were being installed. 13. Two areas of erosion were observed on the southern side slope of Phase 1-Cell 2C and 2E (saddle area). Take measures to ensure that these areas are repaired. 14. Edge of waste markers were being maintained. 15. Access roads were well maintained. 16. The leachate storage lagoon had adequate freeboard space. Additional treatment is available if needed in the leachate pre-treatment facility located adjacent to the leachate lagoon.
