Thereafter of Dried, Digested Secondary Wastewater Treatment Sludge at the
Cherokee County Sanitary Landfill, (Permit # 20-01).
Dear Mr. Ladd:
The Division of Waste Management has received a request for characterization of the
subject waste. Based upon the submitted information, the waste appears to be non -hazardous.
The Division of Waste Management has no objection to the sanitary landfill disposal of this
waste, if in accordance with the conditions listed below:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no free liquids and can be confined, compacted, and covered
in accordance with the Solid Waste Management Rules (15A NCAC 13B).
The waste shall be transported and disposed in a manner which prevents a
physical hazard from dust.
4. Renewal of this letter will require resubmittal of a Waste Determination Form and
current supportive analytical data. Renewal is required prior to subsequent
disposal if the process generating the waste changes or if the waste composition
changes significantly.
Failure to meet these conditions may result in an administrative penalty. If new rules
and/or regulations were to prohibit this practice, this letter can be rescinded. If the process which
generates the waste changes or if the composition of the waste changes significantly, this letter is
void and re-evaluation of the waste will be required prior to subsequent disposal. Should you

Dear Mr. Honeycutt:
The Division of Waste Management has completed its review of the transition plan for the
referenced landfill submitted by the consultant, Municipal Engineering Services on behalf of the
owner and operator, Cherokee County.
Rule .1603(a)(4)(A) of the solid waste management rules codified at 15A NCAC 13B requires
the owner and operator of an existing MSWLF unit to submit a transition plan application for
continuing operation and closure of the existing MSWLF unit by April 9, 1994. Rule .I617(d)
requires that the plan contain: an operation plan in accordance with Rule .1625, a closure and
post -closure plan in accordance with Rule .1629, a water quality plan in accordance with
.1623(b)(3), and a report that contains a schedule for closure of the existing MSWLF unit and, if
necessary, submittal of an application for a new facility, a lateral expansion or permit renewal.
Rule .I603(d)(2) requires the Division to establish a review schedule for the transition plan
applications which determines the adequacy of all the plans by October 9, 1996. The rule allows
the Division to issue full or partial approvals and to determine the schedule for closure of the
existing MSWLF unit based on its review of the complete transition plan application.
In accordance with Rule .1603(d)(2), the Division has completed its review of the submitted
application as amended through January 2, 1997, and hereby issues full approval of the transition
plan for the referenced landfill. See the attached List of Approved Documents.
The approved transition plan shall be effective through December 1997, or until the permitted
contours are reached. Rule .1625(b)(3)(C) requires that operation drawings illustrate annual
phases of development which are consistent with the minimum and maximum closure slope
requirements. In accordance with this rule and Rule .1627(c)(10)(A), the existing unlined

MSWLF unit shall be operated in such a manner as to cease receiving solid waste on or before
January 1,1998, regardless of the approved final contours.
Have Municipal Engineering Services submit one complete transition plan (containing all of the --—
List of Approved Documents) for the Solid Waste Section central files. One complete transition
plan is being sent to Cherokee County and one is being sent to the Solid Waste Section Asheville

RE: Status Of The Permit Application for a MSWLF for Cherokee County
Dear Mr. Honeycutt:

This letter is being sent to all current applicants for permits to construct a municipal
solid waste landfill (MSWLF) who anticipate commencement of landfill operations prior to
January 1 , 1998. Experience has demonstrated that at least six months is required to
construct a lined MSWLF, assuming good weather during construction. Consequently, if
your MSWLF was not under construction by July 1, 1997, you should prepare a
contingency plan to transfer your waste to a lined MSWLF or a Waste -To -Energy facility.
Rule .0103(i) of the solid waste management rules, requires that after January 1,
1998, all active municipal solid waste landfills shall be equipped with liners, leachate
collection systems, and final cover systems as specified in the Section .1600 rules. As you
are aware, the issue of extending the 1998 deadline has been discussed in almost every
public forum over the last several years. In the interest of providing a full and open
discussion of the issue, the Division of Waste Management proposed, on two separate
occasions, rule revisions which would extend the 1998 deadline. In both cases, the
environmental community, local governments who have already made plans to meet the
deadline, and the waste management industry opposed any change in the deadline. Based
on this opposition and the lack of a compelling reason to change a rule that protects the
public health and environment and is economically feasible, the Division recommended on
both occasions that the Commission for Health Services not adopt the proposed rule
changes.
It is the purpose of this letter to reiterate to the referenced permit applicant that
regardless of the status of their permit application for a lined MSWLF, operation of an
unlined MSWLF past the 1998 deadline is a violation of solid waste rules subject to
administrative penalty and/or injunction and that a contingency plan for transfer of MSW
should be prepared.

Dear Mr. Wiggins:
The Solid Waste Section has reviewed your request, submitted on your behalf by Municipal
Engineering Services Company on 19 August 1998, for a revised extension of time to finish
closing the above referenced landfill. The Solid Waste Section (the Section) approves of the
revised proposed schedule outlined in the letter and approves the proposed completion date of
30 November 1998. If, for reasons beyond Cherokee County's control, items addressed in the
19 August 1998 letter cannot be completed in the proposed time frame Cherokee County shall
notify the Section and provide an explanation for the delay along with a revised time line.
Meanwhile, Cherokee County should maintain the existing cover and repair any erosion or
damage done to the interim cover and portions of the final cap completed thus far. If
necessary, temporary seeding or mulch shall be applied to landfill areas to minimize on -site
erosion.
Asa reminder, according to Waste Management Rules 15A NCAC 1313 section .1627(c)(7),
"following closure of each MSWLF unit, the owner or operator shall notify the Division that
a certification, signed by the project engineer verifying that closure has been completed in
accordance with the closure plan, has been placed in the operating record." This notification
can accompany the CQA document submitted to the Section, upon completion of the cell
closure, with the stated date that the notice was placed in the operating record.

MESCO requests the existing testing requirement of 4 in -place permeability tests per acre per lift
on cohesive soil liner [Section (e) of Cohesive Soil Liner under Construction Methods of the
Closure Plan] be changed to 1 permeability test per acre per lift. This modified frequency
satisfies the permeability test requirement of 1 permeability test per acre per lift outlined in the
Federal EPA, Technical Guidance Document 600/R-93/182 for Quality Assurance and Quality
Control for Waste Containment Facilities, Chapter 2, Page 84, Paragraph 2.8.4.3, Frequency of
Testing. At each permeability test location, an in -place moisture -density test will be performed.
If material consistency changes considerably, then the frequency of the in -place permeability and
moisture -density testing will be increased as determined by MESCO.
As part of this modified permeability testing frequency, MESCO requests changing the frequency
of visual classification, Atterberg Limits, moisture content, and sieve analysis tests [Section (h)
of Cohesive Soil Liner under Construction Methods of the Closure Plan] to 1 of each test per lift
per acre (constructed), provided the material consistency remains the same during construction.
If material consistency changes considerably, an adequate number of tests will be performed to
determine the suitability of the cohesive soil liner material during construction.

RE: Revised Closure Schedule for Cherokee County MSW Landfill

Dear Mr. Wiggins:
The Solid Waste Section has reviewed your request, submitted on your behalf by Municipal
Engineering Services Company on 10 June 1998, for an extension of time to close the above
referenced landfill. The Solid Waste Section (the Section) approves of the proposed schedule
outlined in the letter and approves the proposed completion date of 31 August 1998. If, for
reasons beyond Cherokee County's control, items addressed in the 10 June 1998 letter cannot
be completed in the proposed time, Cherokee County shall notify the Section and provide an
explanation for the delay along with a revised time line. Meanwhile, Cherokee County should
maintain the existing cover and repair any erosion or damage done to the interim cover.
Temporary seeding or mulch shall be applied to landfill areas to minimize on -site erosion if
necessary.
_14 As a reminder, in accordance with Waste Management Rules 15A NCAC 13B section
.1627(c)(7), "following closure of each MSWLF unit, the owner or operator shall notify the
Division that a certificaticn, signed by the project engineer verifying that closure has been
completed in accordance with the closure plan, has been place in the operating record." This
notification can accompany the CQA document submitted to the Section, upon completion of
the cell closure, with the stated date that the notice was placed in the operating record.

COMPLIANCE WITH CLOSURE REQUIREMENTS
FOR
MUNICIPAL SOLID -WASTE LANDFILLS —

The primary purpose of this notice is to remind all owners and operators of
Municipal Solid Waste Landfills (MSWLFs) of the requirements of Rule .1627(c), Closure
Criteria. The following requirements are summarized below:
1627(c)(4). The owner/operator shall place a notice in the facility operating
record indicating when the facility stopped receiving MSW waste;
.1627(c)(5). The owner/operator shall begin closure activities of each MSWLF
unit no later than 30 days (on or before January 1, 1998) from the
date of final waste receipt. The Section interprets this to mean that
the site work for cap placement shall start within this time frame. If
closure activities do not start consistent with this requirement, then
Rule .1627(c)(6) may be necessary;

1627(c)(6). The owner/operator shall complete closure activities within 180 days
(on or before July 31, 1998) or request an extension from the
Section to complete closure activities;

( .1627(c)(7). Upon field verification by the Certifying Engineer that closure

activities are complete, a letter shall be placed in the operating
record and a copy sent to the Section stating that closure was
• : completed in accordance with the closure plan/transition plan for the
facility.
It is important to point out that action by the compliance staff may be taken if an
owner/operator has not completed closure by July 31, 1998, or requested a closure
extension by July 31, 1998. For compliance purposes, closure is considered complete when
the engineer certifies that closure activities have been completed. However, the MSWLF
will not be officially closed until a letter of acknowledgement is received from the Section.

Ref: Closure requirements for unlined MSW Landfills
Dear Mr. Wiggins:
Enclosed is a reminder notice to all counties who are in the process of closing out old,
unlined municipal solid waste (MSW) landfills.
While the majority of the eighteen unlined facilities in the western part of the state have
indicated closure activities, not everyone has filed a notice of intent to close
(.1627(c)(4)) or requested an extension to complete closure after the July 31, 1998
deadline. No extensions will be granted unless a specific anticipated closure date is
provided along with a timeline indicating construction progression (i.e., bid date, date
contract awarded, date construction is to begin, etc.). Please check the notice and verify
that your facility has satisfied each of the requirements.
