Dear Mr. Parker,
A preliminary hydrogeologic review has been done of the Revised
Site Hydrogeologic Report for Cherokee County. Several of the
responses still do not provide all of the information required by
the Solid Waste Management Rules. Please address the following
issues in order to provide the information necessary to enable the
completion of the technical review of the Site Study.
As I have already expressed verbally on several occasions, I am
getting a little frustrated with the responses stating that the
requested information is not required by the rules. In most cases
the requested information is specifically required in the rules.
In a few cases the requested information is documentation for
information specifically required in the rules.
Rule .0202 Permit Application, specifically requires "the
geological study shall bear the seal of a licensed
professional geologist, in accordance with N.C.G.S. Chapter
89E".
Rule .1623(a)(1) specifically requires "For sites located in
piedmont or mountain regions, this report shall include a
fracture trace analysis...".
Two large areas of the site have not been investigated. One area
is located on the eastern portion of the site. And the other area
is located between the borings located in the central portion of
the site and the borings located in the western portion of the
site.

Areas Of The Site Not Investigated (Continued)
The comments about the minimum boring density are not
relevant. The rules require subsurface characterization of
(_all por-ti_ons_�af_)__the—cite to be considered for a facility
permit. The average boring density is a guideline of the
minimum amount of borings that may be needed to provide
adequate characterization, based upon the experience of the
Solid Waste Section. The point is not merely to do a certain
number of borings, but to provide an adequate characterization
of the entire site.
- As GAI is aware, based on numerous past conversations, the
Solid Waste Section requires that all of a proposed site be
characterized. Any significant portions of a proposed site
that are not investigated can not be considered for inclusion
in the facility permit. Based upon the information provided,
as illustrated on Plate 4 of the Revised Report, over one-half
of the acreage for the proposed site has no borings. The large
gaps in the investigation for this site prohibit the Solid
Waste Section from considering site approval for the entire
site.
It is difficult for me to understand why the County or their
consultants did not discuss the need for additional site
characterization with the Solid Waste Section prior to this
date. Now several months have passed and remobilization is
still needed in order to provide the additional information
necespary to proceed with the permit application process.
The discussion clarifying the terminology for "temporary
standpipes" is generally adequate. However, in all my years of
experience, I have never heard of a properly constructed piezometer
referred to as an "open standpipe". In my experience this
terminology is used for boreholes with well casings that have not
been grouted in place.
The additional information on porosity is helpful. The effective
porosity for the clay (Unit I) does not appear accurate. Please
provide the sources and rationale for this value. Velocity values
should be provided for all hydrogeologic units, including those in
the unsaturated zone. Reference Rule .1631(c)(2).

Rule .1623(a)(7)(A) specifically requires "water table elevations
at the time of boring ...". In the future, these measurements
should always be recorded and reported. If this data is not
available for this Site Hydrogeologic Report, then you need to
provide a discussion on why this information is not critical since
stabilized water table elevations are available.
As previously referenced, the rules specifically require a fracture
trace analysis. Why was the area to the northwest of the proposed
site (Magazine Branch, Coffey Cove, Rhea Cove, Pine Knob, etc.) not
included in the lineament study for the fracture trace analysis?
This area should be evaluated and a revised fracture trace analysis
and Rose diagram should be submitted.
The revisions to Plate 3 (Plate 4 in the Revised Report) do improve
the legibility and ability to interpret information from the map.
The additional subsurface profiles are also helpful and assist in
the interpretation of the characteristics of the site.
The Section Hydrogeologic Unit has not yet completed a full
technical review of the Revised Site Hydrogeologic Report, since
the report is not yet complete. When a complete report (that
offers subsurface characterization of all areas of the proposed
site) is received, then we can proceed with the technical review.
Please provide the information requested in this letter so the
Solid Waste Section can complete the technical review of the
Cherokee County Landfill site plan application. If you have any

OPERATIONAL PLAN FOR CHEROKEE COUNTY
The County of Cherokee will operate their existing landfill until the October 9, 1996. The
Transition Plan includes a vertical expansion which will be the plan by which the landfill is
filled. The County has been operating under the fill with the area type fill. The daily fill
should be maintained in the smallest area possible and filled as deep as possible before the
daily cover is applied.
Daily cover will be the combination of soil and synthetic cover. The synthetic cover will
be used on days that the next days fill will be placed directly on top of the fill. Soil cover
will be used when the next days waste will not be placed directly on top and the synthetic
cover is not large enough to cover the entire area. (See cover requirements under
operational requirements).
The County will implement a program at the landfill for detecting and preventing the
disposal of hazardous and liquid wastes. The program shall consist of random inspection
of incoming loads at a minimum of 1% of the weekly traffic. Landfill personnel will be
trained to recognize hazardous and liquid wastes. Records shall be kept on the training
and the inspections. _(See Appendix I).
The County of Cherokee shall monitor for explosive gases of landfill structures and
property boundaries. The concentration of methane gases generated by the landfill cannot
exceed 25 percent of the lower explosive limit for methane in the structures, and it cannot
exceed the lower explosive limit for methane of the landfill property boundary. (See
Appendix III) If methane gas is found to exceed the acceptable limits at either the property
boundary or landfill structures, it is the County's responsibility to do the following:
Immediately take all necessary steps to ensure protection of human health, i.e. no
smoking, temporarily abandon the structure and notify the Division of Solid Waste
Management.
Within seven days of detection, place in the operating record the methane gas
levels detected and a description of the steps taken to protect human health; and
Within 60 days of detection, implement a remediation plan for the methane gas
releases, place a copy of the plan in the operating record, and notify the Division of
Solid Waste Management that the plan has been implemented. The plan shall
describe the nature and extent of the problem and the proposed remedy.
Off and on site erosion shall be controlled through erosion control structures and devices.
Provisions for a vegetative ground cover sufficient to restrain erosion shall be
accomplished within 30 working days or 120 calendar days upon completion of any phase
of landfill development.

Dear Mr. Honeycutt:
The Solid Waste Section (the Section) has reviewed a request submitted on your behalf concern-
ing the referenced subject. Pursuant to the North Carolina Solid Waste Management Rules (amended
effective October 9, 1993), the Section may approve alternatively daily cover if the owner or operator
demonstrates the adequacy of the material. Accordingly, the Section approves the use of the pro-
posed cover materials for a limited trial period of 120 days to allow a demonstration of adequacy.
During the trial period it must be demonstrated that the use of the alternative daily cover achieves
compliance with the Solid Waste Management Rules, 15A North Carolina Administrative Code
.1626(2)(b). This rule states that the alternative materials must control disease vectors, fires, odors,
blowing litter, and scavenging without presenting a threat to human health or the environment. The
use of alternative materials should be punctuated with soil cover at some reasonable interval, and the
materials should be adequate in size to cover all exposed parts of the working face.
I will periodically inspect the referenced facility during the 120-day trial to evaluate the use of the
alternative cover material. Please contact me when you are ready to initiate the trial. At the end of
the trial period, a decision will be made regarding the continued use of the product.

Dear Mr. Welch:
The Solid Waste Management Division has received a request for characterization of the
subject waste. Based upon the submitted information, the waste appears to be non -hazardous. The
Solid Waste Management Division has no objection to the sanitary landfill disposal of this waste,
if in accordance with the conditions listed below:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no free liquids and can be confined, compacted, and covered in
accordance with the Solid Waste Management Rules (15A NCAC 13B).
3. Renewal of this approval will require resubmittal of a Waste Determination Form and
current supportive analytical data. Renewal is required prior to subsequent disposal
if the process generating the waste changes or if the waste composition changes
significantly.
Failure to meet these conditions may result in revocation of this approval, and subsequently,
an administrative penalty. The approval is subject to change if new rules and/or regulations were
to prohibit this practice. If the process which generates the waste changes or if the composition of
the waste changes significantly, this approval is void and re-evaluation of the waste will be required
prior to subsequent disposal.

referenced transition plan application submitted by Municipal Engineering Services on behalf
of Cherokee County. See the attached memorandum for geological and hydrological

The Section's preliminary review involved evaluating the Cherokee County Landfill's
Transition Plan against the N. C. Solid Waste Management Rules, 15A NCAC 13B. Based on
its preliminary review, the Section needs the following additional information from Municipal
Engineering Services.

2. The Waste Screening Plan states that waste should be carefully spread for observation
using a front end loader or other piece of equipment and that the Division of Solid
Waste recommends that the waste should be hand raked to spread the load. Revise
to say what will be done, do not include recommendations. Will the waste be spread
with a front end loader or will it be hand raked?

A hydrogeologic review has been completed of the Cherokee County
Landfill Transition Plan. Additional information and clarification
is needed on several issues. Please have Cherokee County or their
consultants review the following comments and questions and prepare
a revised Transition Plan for the Cherokee County Landfill.
COMMENTS AND QUESTIONS:
LOCATION RESTRICTIONS:
The statement is made that the "Cherokee County landfill
facility is not located in a FEMA studied floodplain". A FEMA
map needs to be provided that supports this statement. Based
upon my observations in the field, it appears that a
significant portion of the facility along the Valley River is
in the floodplain.
LOCAL AREA STUDY:
Each of items (i) through (v) of Rule .1629(b)(2)(A) need to
be clearly addressed in the Local Area Study. Presently there
is no text and only partial information available on the
aerial photo that addresses these items.
The Local Area Study Map submitted illustrates the proposed
landfill site rather than the existing landfill site. No
legend or information has been provided on the Local Area
Study Map.

The location of the survey control benchmarks needs to be
shown on one of the Local Area Study Maps.
WATER QUALITY MONITORING PLAN:
Several items in my earlier letter to GAI dated February 22,
1994 have sill not been adequately addressed. Additional
information is needed on items 3, 6, and 7 in the 2-22-94
letter.
Documentation is needed showing that the maintenance problems
with the previously existing monitoring wells identified on
page 4 and below Table 5 in the report have been corrected.
The locations of all three private wells to the east of the
landfill need to be identified and shown on a landfill map.
Any information on the design and construction of these wells
also needs to be provided.
- Information on the method of abandonment for the on -site water
supply well is still needed.
The location of the adjacent water wells, springs, and
underground utilities for the trailers located south of the
landfill are needed.

In the Note for Table 7 it states: "The depth includes a
proposed one foot of sand pack below the bottom of the
screen". This is not the preferred well design. Ideally the
sand pack should not extend below the bottom of the well
screen, especially if the well is screened immediately above
rock or a confining geologic unit.
SAMPLING AND ANALYSIS PLAN (SAP):
The GAI revised SAP dated April 1995 appears generally okay.
At the bottom of page five, specific conductivity should be
reported along with the other field sampling data.
The landfill owner or operator is also required to report the
direction and rate of ground -water flow for each monitoring
well for each monitoring event.
The data for each sampling event must be compared with the
N.C. Groundwater Standards and analyzed for statistically
significant increases over background values.
GAI needs to provide a separate copy of the revised SAP to
each County to be included in their copy of the Transition
Plan. For the Transition Plans to be maintained by the Solid
Waste Section, either a sheet referencing the revised SAP on
file should be placed in each County's Transition Plan or a
separate copy of the revised SAP needs to be placed in each of
the various Counties Transition Plans.
- Should there be any discrepancies between the Water Quality
Monitoring Plan or Sampling and Analysis Plan and the Solid
Waste Management Rules and policies, then the rules and
policies are to take precedence.
INITIAL BASELINE SAMPLING REPORT OF OCTOBER 1994:
There are two different copies of Table 1 in the report. The
older copy of Table 1 needs to be removed from all copies of
the report.

The laboratory data reports do not indicate the analytical
methods used for the water quality analyses.
Monitoring weiis 4K, 5, ana -i are constructea snallower tnan
is generally desirable. The Solid Waste Section prefers
relatively shallow monitoring wells to be screened with 15
foot screens set so that the top of the well screen is just
above the seasonal high water table. However, in a setting
with the water table within five feet of ground surface this
is not advisable. The top of the well screen should never be
placed shallower than five feet of ground surface, since
shallower screen placement risks surface water infiltration.
The Solid Waste Section will allow Cherokee County to use the
wells as constructed as long as they are judged to be able to
provide representative samples of the ground -water quality at
these locations.
BASELINE SAMPLING REPORTS FOR JANUARY, FEBRUARY, AND MARCH 1995:
- The laboratory data reports do not indicate the analytical
methods used for the water quality analyses.
- There is no summary table for detected constituents. Nor is
there a comparison of the data with the N.C. Groundwater
Standards.
- There is no statistical analyses of the data.

And Water Quality Monitoring Plan For The Cherokee County
Landfill (Permit # 20-01)
A hydrogeologic review has been completed of the Cherokee County
Landfill Transition Plan. Additional information and clarification
is needed on several issues. Please have Cherokee County or their
consultants review the following comments and questions and prepare
a revised Transition Plan for the Cherokee County Landfill.
COMMENTS AND QUESTIONS:
LOCATION RESTRICTIONS:
The statement is made that the "Cherokee County landfill
facility is not located in a FEMA studied floodplain". A FEMA
map needs to be provided that supports this statement. Based
upon my observations in the field, it appears that a
significant portion of the facility along the Valley River is
in the floodplain.
LOCAL AREA STUDY:
Each of items (i) through (v) of Rule .1629(b)(2)(A) need to
be clearly addressed in the Local Area Study. Presently there
is no text and only partial information available on the
aerial photo that addresses these items.
- The Local Area Study Map submitted illustrates the proposed
landfill site rather than the existing landfill site. No
legend or information has been provided on the Local Area
Study Map.

- The aerial photo does not have a north arrow, legend, 2000 ft.
perimeter boundary, etc. The iower hait ot the aeriai photo
is too dark to be legible.
- (i) None of the Local Area Study Maps illustrate current
topographic information.
- (ii) Are there any surface water intakes in the study area?
(v) What are the locations and types of any potential sources
of contamination?
The location of the survey control benchmarks needs to be
shown on one of the Local Area Study Maps.
WATER QUALITY MONITORING PLAN:
- Several items in my earlier letter to GAI dated February 22,
1994 have sill not been adequately addressed. Additional
information is needed on items 3, 6, and 7 in the 2-22-94
letter.
Documentation is needed showing that the maintenance problems
with the previously existing monitoring wells identified on
page 4 and below Table 5 in the report have been corrected.
The locations of all three private wells to the east of the
landfill need to be identified and shown on a landfill map.
Any information on the design and construction of these wells
also needs to be provided.
Information on the method of abandonment for the on -site water
supply well is still needed.
The location of the adjacent water wells, springs, and
underground utilities for the trailers located south of the
landfill are needed.

In the Note for Table 7 it states: "The depth includes a
proposed one foot of sand pack below the bottom of the
screen". This is not the preferred well design. Ideally the
sand pack should not extend below the bottom of the well
screen, especially if the well is screened immediately above
rock or a confining geologic unit.
SAMPLING AND ANALYSIS PLAN (SAP):
The GAI revised SAP dated April 1995 appears generally okay.
At the bottom of page five, specific conductivity should be
reported along with the other field sampling data.
The landfill owner or operator is also required to report the
direction and rate of ground -water flow for each monitoring
well for each monitoring event.
The data for each sampling event must be compared with the
N.C. Groundwater Standards and analyzed for statistically
significant increases over background values.
- GAI needs to provide a separate copy of the revised SAP to
each County to be included in their copy of the Transition
Plan. For the Transition Plans to be maintained by the Solid
Waste Section, either a sheet referencing the revised SAP on
file should be placed in each County's Transition Plan or a
separate copy of the revised SAP needs to be placed in each of
the various Counties Transition Plans.
Should there be any discrepancies between the Water Quality
Monitoring Plan or Sampling and Analysis Plan and the Solid
Waste Management Rules and policies, then the rules and
policies are to take precedence.
INITIAL BASELINE SAMPLING REPORT OF OCTOBER 1994:
There are two different copies of Table 1 in the report. The
older copy of Table 1 needs to be removed from all copies of
the report.

- The laboratory data reports do not indicate the analytical
methods used for the water quality analyses.
Monitoring wells 4R, 5, and 7 are constructed shaiiower tnan
is generally desirable. The Solid Waste Section prefers
relatively shallow monitoring wells to be screened with 15
foot screens set so that the top of the well screen is just
above the seasonal high water table. However, in a setting
with the water table within five feet of ground surface this
is not advisable. The top of the well screen should never be
placed shallower than five feet of ground surface, since
shallower screen placement risks surface water infiltration.
The Solid Waste Section will allow Cherokee County to use the
wells as constructed as long as they are judged to be able to
provide representative samples of the ground -water quality at
these locations.
BASELINE SAMPLING REPORTS FOR JANUARY, FEBRUARY, AND MARCH 1995:
The laboratory data reports do not indicate the analytical
methods used for the water quality analyses.
- There is no summary table for detected constituents. Nor is
there a comparison of the data with the N.C. Groundwater
Standards.
There is no statistical analyses of the data.

The Solid Waste Section (the Section) has reviewed a request submitted on your behalf concern-
ing the referenced subject. Pursuant to the North Carolina Solid Waste Management Rules (amended
effective October 9, 1993), the Section may approve alternatively daily cover if the owner or operator
demonstrates the adequacy of the material. Accordingly, the Section approves the use of the pro-
posed cover materials for a limited trial period of 120 days to allow a demonstration of adequacy.
During the trial period it must be demonstrated that the use of the alternative daily cover achieves
compliance with the Solid Waste Management Rules, 15A North Carolina Administrative Code
.1626(2)(b). This rule states that the alternative materials must control disease vectors, fires, odors,
blowing litter, and scavenging without presenting a threat to human health or the environment. The
use of alternative materials should be punctuated with soil cover at some reasonable interval, and the
materials should be adequate in size to cover all exposed parts of the working face.
I will periodically inspect the referenced facility during the 120-day trial to evaluate the use of the
alternative cover material. Please contact me when you are ready to initiate the trial. At the end of
the trial period, a decision will be made regarding the continued use of the product.

permission to use synthetic daily cover. Please find
enclosed Appendix VII of the Transition Plan that
generally addresses the use of synthetic cover.
Cherokee County would like to use two 50' x 48'
parcels of "Airspace Saver". Enclosed is a chart of
the physical properties of this cover for your review.
The cover will be used according to the plan
submitted in the Transition Plan.

possible so that we can limit the use of soil as daily

OPERATIONAL PLAN FOR CHEROKEE COUNTY
The County of Cherokee will operate their existing landfill until the October 9, 1996. The
Transition Plan includes a vertical expansion which will be the plan by which the landfill is
filled. The County has been operating under the fill with the area type fill. The daily fill
should be maintained in the smallest area possible and filled as deep as possible before the
daily cover is applied.
Daily cover will -be ce will -be of soil and synthetic cover. The synthetic cover will
be used on days that the next days fill will be placed directly on top of the fill. Soil cover
will be used when the next days waste will not be placed directly on top and the synthetic
cover is not large enough to cover the entire area. (See cover requirements under
operational requirements).
The County will implement a program at the landfill for detecting and preventing the
disposal of hazardous and liquid wastes. The program shall consist of random inspection
of incoming loads at a minimum of 1% of the weekly traffic. Landfill personnel will be
trained to recognize hazardous and liquid wastes. Records shall be kept on the training
and the inspections. (See Appendix I).
The County of Cherokee shall monitor for explosive gases of landfill structures and
property boundaries. The concentration of methane gases generated by the landfill cannot
exceed 25 percent of the lower explosive limit for methane in the structures, and it cannot
exceed the lower explosive limit for methane of the landfill property boundary. (See
Appendix I11) If methane gas is found to exceed the acceptable limits at either the property
boundary or landfill structures, it is the County's responsibility to do the following:
1. Immediately take all necessary steps to ensure protection of human health, i.e. no
smoking, temporarily abandon the structure and notify the Division of Solid Waste
Management.
2. Within seven days of detection, place in the operating record the methane gas
levels detected and a description of the steps taken to protect human health; and
3. Within 60 days of detection, implement a remediation plan for the methane gas
releases, place a copy of the plan in the operating record, and notify the Division of
Solid Waste Management that the plan has been implemented. The plan shall
describe the nature and extent of the problem and the proposed remedy.
Off and on site erosion shall be controlled through erosion control structures and devices.
Provisions for a vegetative ground cover sufficient to restrain erosion shall be
' accomplished within 30 working days or _120 calendar days upon completion of any phase
of landfill development.
