Dear Mr. Tucker: In reference to our telephone conversation of May 12, 1983, I will identify treatment and disposal options available to you in connection with the approximately 300-400 cubic yards of high pH soil. I. N. C. Permitted Sanitary Landfills This office will support the use of any N. C. approved sanitary landfill providing the owner/operator approves and the selection of the specific treatment area is coordinated with this office. II. Out of State North Carolina does not have jurisdiction concerning solid waste handling in other states. All such actions shall be coordinated with appropriate local and state officials. III. Development of a New Site This office has the authority to allow the disposal of such treated soil in sites that meet specific requirements. A sanitary landfill permit can be issued for the one time treatment and disposal of cer- tain waste types including the contaminated soil. The following procedure must be followed: A. Coordinate the site selection with our area representative Jim Moore (office phone 704/669-3361). The site must have a minimum 50-foot buffer zone between the treatment and disposal area and the property line and any streams. A minimum buffer zone of 200 feet must exist between the treatment and disposal area and any inhabited dwellings and drinking water wells. B. Information identified in sections .0506(1)a,b,c and .0506(2)a,d on page 18 & 19 of the enclosed copy of the N. C. Solid Waste Management Rules should be sent to Mr. Gordon Layton of this office. Verification of the treatment method should consist of pH determinations on three or four random grab soil samples per 50-60 cubic yard batches. STATE HEALTH DIRECTOR This letter is in reference to our phone conversations of April 25 and 26 concerning the treatment and ultimate disposal of sodium hydroxide con- taminated soil at the water treatment facility in Andrews, N. C. I have no problems with the disposal of the contaminated soil in the Cherokee County Sanitary Landfill providing that the pH of the soil is reduced to a point that will support vegetative growth. The county must be willing to accept the treated soil. It is felt that a pH range of 5 to 8 would allow the treated soil to be used as cover at the landfill. Treatment can occur at either the sanitary landfill or at the water treatment facility property. Verification of the treatment process should be conducted by measuring the pH of 3-4 random grab soil samples per 50- 60 cubic yards of treated soil. Document the results of these analyses and submit copies to Mr. John Boring (Cherokee County Manager), Roy Davis (Division of Environmental Management, Asheville, N.C.) and myself. While we had discussed utilization of the treated soil as fill on another piece of property, I must now advise against it. The soil, even after treat- ment, is still legally considered a solid waste, and the placement of the soil on that property would require a solid waste permit. I dis- cussed problems found and remedial measures needed with you on May 24, 1983 and you agreed to a compliance date of June 30,'1983. Our agreement was as follows: The sediment basin below the access road needs to be enlarged and provided with an emergency spillway system (meanwhile the basin needs to be cleaned out). A rock check dam is needed in the ditch line below the toe of the slope of the old waste area. The lower corner of the old waste area needs a slope drain similar to the slope drain already in place at the midpoint of the fill area. The bare areas perimeter of landfill and adjacent to the housing dev- elopment need to be seeded. Box 190 Andrews, North Carolina 28901 Subject: Sodium Hydroxide Leak Andrews Water Filtration Facility Cherokee County, North Carolina Dear Mayor Burnett: After reviewing the reports compiled by Butler/McGill Associates, P.A., Baldwin and Cranston Associates, Inc., and Diamond Shamrock Corporation, it seems probable that only temporary and minor impacts would be made on groundwaters at the site of the sodium hydroxide leak at the Andrews water filtration facility. This conclusion is based on results of soil samples taken below the floor of the building which indicated no contamination by the chemical. If the sodium hydroxide had migrated this deep, it would have undoubtedly migrated under the concrete floor as a result of the lesser resistance of the disturbed earth. This limited migration was probably the result of a perforated pipe and washed stone foundation drain located immediately above the footing which collected the chemical and ultimately discharged it by way of floor drains from the pipe gallery to the lower sludge storage basin. The lack of a water tight seal in the storage basin allows leakage to the basin underdrains. The basin must be reworked so that it is water tight and does not leak. A sufficient clay or synthetic liner should be used to seal the basin. Please inform us of the Town's plans in terms of sealing this basin and schedule for completing this work. Removal and neutralization of the contaminated earth from around the building may be necessary to protect the building's foundation. We accept the neutralization and disposal plan as described in the telephone conversation with Mr. Karnoski. However, caution should be exe-r-ci-s d-du-r-in_g_the neutralization process to ensure that the hydro - chloric acid used in the procedure does not enter any streams or leak into the groundwaters.
