REGAN Secretary MICHAEL SCOTT Director Mr. Gary Lynch 42 East, LLC PO Box 20012 Raleigh, NC 27619 Re: Site Restoration Plan Flowers LCID Recycling Center Permit No. 51-05 Johnston County, North Carolina Dear Mr. Lynch: NORTH CAROLINA Environmental Quality January 9, 2020 The Solid Waste Section received plans for restoration of Flowers LCID Landfill submitted on behalf of 42 East, LLC, by Smith Gardner, Inc., on December 6, 2019, and has determined that 42 East, LLC may proceed with these plans subject to the following conditions: 1. Operations shall be conducted in accordance with any applicable requirements of the Sedimentation Pollution Control Law 15A NCAC 4. 2. Operations are not authorized within any floodplain or wetlands areas. 3. Surface water shall be diverted from all operational and storage areas and the site shall be activities shall be conducted in a manner to prevent standing water in operational areas and under or around storage piles. Water that comes in contact with solid waste shall be contained on -site or properly treated prior to discharge. 4. Erosion and runoff control structures shall be maintained and the facility operated in such a manner that soil erosion and runoff from the site shall be controlled. 5. Operations shall be conducted with sufficient dust control measures to minimize airborne emissions and to prevent dust from becoming a nuisance or safety hazard. 6. Operations shall be conducted in a manner so as to prevent the creation of a nuisance, potential health hazard, or a potential fire hazard. 7. Appropriate measures shall be applied to confine wind-blown material on the property. 8. In addition to the documentation outlined in the plan to be submitted to the Section after restoration, provide information regarding type of materials not removed from the site and provide a map showing their location. 9. Groundwater and/or soil sampling may be required if wastes other than LCID are encountered during site restoration.
