Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Page 1 of 3 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on December 18, 2019. 2. Closure certifications were submitted on August 24, 1999; however, the permit for closure was not issued until December 11, 2014. 3. Landfill gas results from January 2017 until November 2019 were reviewed and no exceedances were noted. Facility staff have been monitoring landfill gas monthly and Municipal Engineering Services has been testing concurrently when conducting semi-annual groundwater monitoring for the facility. 4. On December 19, 2019, Cherokee County requested to reduce monthly landfill gas monitoring to quarterly testing. Ervin Lane approved the request by email on December 19, 2019. 5. Groundwater testing was conducted on the following dates: • February 10-12, 2016 • August 10-11, 2016 • February 23-24, 2017 • October 19-20, 2017 • April 12-13, 2018 • October 3 1 - November 2, 2018 • April 26-29, 2019 All water quality reports had exceedances of the 2L standards. 6. The closed landfill is secured by a gate, which was found to be locked upon arrival for the inspection. 7. The facility collects and flares landfill gas to the west of the closed landfill. The county contracts with Barnet Construction for landfill gas management. 8. Edge of waste markers, constructed of green metal T-posts with the tops painted orange, were installed around the perimeter of the landfill. 9. The landfill cap had good vegetative cover established and no erosion issues were observed. Facility staff stated that the cap is mowed two times per year. 10. A dead tree was observed on to the east side near the landfill cap and a methane extraction well. It is recommended that the tree be removed to reduce the risk of the tree falling and damaging a methane extraction well or doing damage to the landfill cap. 11. The landfill cap appeared to have positive drainage and no depressions were observed. Please continue to monitor the landfill cap and repair any settling issues that may occur.
