Solid Waste Management Facility Permit No. 8105 (FID 1339298) dated August 15, 2019, Permit to Operate (PTO) includes: 8103-CDLF-2002 Rutherford County Construction and Demolition (C&D) Landfill; 8104T-TRANSFER-1998 Rutherford County Transfer Facility; & Permit for Closure 8103-MSWLF-1974 Rutherford County Municipal Solid Waste (MSW) Landfill. PURPOSE OF SITE VISIT: Comprehensive Facility Inspections for Permit No.'s 8104T-TRANSFER-1998 and 8103-CDLF-2002. Partial Facility Inspection for Permit No. 8103-MSWLF-1974 (to observe environmental monitoring wells). STATUS OF PAST NOTED VIOLATIONS: 1. 15A NCAC 02C .0108(o) CORRECTIVE MEASURES ONGOING. At the time of this inspection, the facility has not completely demonstrated that each non -water supply well contains a permanently affixed identification plate with the required information. The site -wide Groundwater and Surface Water monitoring network currently includes 17 monitoring well and 4 surface water monitoring locations that serve to monitor both the C&D and closed MSW facilities on -site. Since the previous inspection, the facility has installed identification plates with the necessary information on all actively sampled environmental monitoring wells at the facility (photos #1 & #2), except for groundwater monitoring wells #7 and #8. During this inspection, Rutherford County provided the Section a paid invoice, dated March 31, 2019, for installation of "Rutherford County Well and Probe Tags". Additionally, during this inspection, facility personnel contacted the company Rutherford County hired to complete the identification plate installation on site environmental monitoring wells to inform them of the status of groundwater monitoring wells #7 and #8. Facility personnel were informed the identification plates would be installed by the next facility semi-annual sampling event. See Tables #1 & #2 below for additional information on site environmental monitoring well status. *Note: since the previous inspection, as part of the permit renewal process, the facility submitted a Landfill Gas Monitoring Plan, dated November 1, 2018 (FID 1257547), as well as a Landfill Groundwater and Surface Water Monitoring Plan, dated November 15, 2018 (FID 1258378). These plans were approved respectively by the Section on November 2, 2018 (FID 1257548) and November 16, 2018 (FID 1258379). Since the approval of these monitoring plans, some site environmental monitoring wells have been removed from the sampling regime and other environmental monitoring wells have been added to the sampling regime. Additionally, surface water sampling location #5a has replaced surface water sampling location #5. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. On -site November 26, 2019, to observe facility environmental monitoring wells, review facility records/certifications, and inspect the Transfer facility, Treatment and Processing (T&P)/Wood Grinding area, White Goods/Scrap Metals area, Scrap Tire area, the C&D landfill unit, the closed MSW landfill (monitoring wells only), and the temporary Disaster Debris Site. Participants from the facility included James Kilgo, Tony Bumgarner, and Alma Resendiz. 2. Post -inspection, facility personnel contacted the Section on November 28, 2019, and December 2, 2019, to discuss a fire occurrence at the facility. Please see additional comment #11 for more information. The following comments were noted/observed during this inspection: 3. Access was controlled at the facility and signage was displayed at the facility entrance. The facility's current operating hours are: Monday — Friday: 7:30 a.m. — 4:00 p.m.; and Saturday: 7:30 a.m. — 12:30 p.m. 5. The Permit to Operate (PTO), Updated Operation Plan, and all necessary records were available for review. 6. The Scrap Tire area, located north of the facility offices, consisted of three trailers which stored all tires under cover. This area appeared to be well maintained. The facility contracts with US Tire Recycling LP for tire removal/processing on an as -needed basis. NC Scrap Tire Certification forms were reviewed from 9/25/19 to 11/26/19. NC Scrap Tire Certification forms appeared to be maintained. During the NC Scrap Tire Certification records review, the Section and facility personnel discussed, at length, the facility's on -going efforts to manage the Scrap Tire area and to ensure that all Scrap Tire Haulers were accurately accounting for their tire disposal numbers at the facility. The Section noted the facility was conducting an excellent job of maintaining the forms and managing this area. 7. Used motor oil is accepted and collected in an above ground storage tank located northwest of the transfer facility. Currently, Enterprise Waste Oil, Inc., of Knoxville, TN, collects the used oil for recycling. 8. Used cooking oil is accepted and collected in a containerized vessel near the entrance to the transfer facility. Currently, Blue Ridge Biofuels of Asheville, NC, collects the used cooking oil as needed. 9. Facility fire extinguishers were most recently serviced by Falcon Fire and Safety Inc. of Boiling Springs, NC, in October 2019. Facility personnel observe and inspect the charge on facility fire extinguishers monthly. Fire response is provided by Rutherfordton Fire Department, with backup response provided by The Town of Spindale Fire Department. 10. White Goods and Scrap Metal are accepted at the facility and stored on a concrete pad located west of the transfer facility. The facility currently utilizes Commercial Metals Company (CMC) for white goods removal/processing. Chlorofluorocarbon (CFC) refrigerants are removed by CMC personnel. Facility records indicate CMC personnel were most recently on -site to remove CFC's from necessary equipment on August 2, 2019. No solid waste issues were noted in this area. 11. Electronic equipment is accepted at the facility and stored on a concrete pad adjacent to the White Goods and Scrap Metal area. The facility currently uses Electronics Recyclers International, Inc. (ERI) for removal and processing of electronic waste. Note: post -inspection a small fire occurred in this area on Thanksgiving holiday, November 28, 2019. Proper response was provided by the Rutherfordton Fire Department and facility personnel. The Section received the required Fire Occurrence Notification form from the facility on December 2, 2019. 12. The Treatment & Processing (T&P)/Wood Grinding area is currently permitted to receive land clearing waste, unpainted/untreated wooden pallets, and yard trash (ground material containing yard trash may not be distributed to the public unless it has been composted in accordance with Rule .1400). The facility utilizes a private contractor for grinding of material(s) in this area on an as -needed basis. Per facility personnel, material in this area was most recently ground in August 2019. No unpermitted waste was observed in this area and surface water management appeared to be maintained during this inspection. 13. Per facility personnel, the facility utilizes six inmate laborers (as available Monday -Friday) to perform various activities as directed on -site. 14. The perimeter of the landfill(s) and other areas have been marked with stakes to identify the respective limits of waste: • Blue -tipped stakes: limits of the Active C&D landfill; • White -tipped stakes: Old MSW landfill; • Yellow -tipped stakes: Old animal burial area; • Red -tipped stakes: New animal burial area; • Blue with Red -tipped stakes: Asbestos burial area; and • Black -tipped: T&P/Wood Grinding area. Per facility records, the facility scale was most recently calibrated by Fairbanks Scales, Inc., on June 20, 2019. TRANSFER FACILITY: Records/Certifications- 16. Per Transfer Facility records, the facility accepted on average approximately 156 tons of waste per day for the month of October 2019. Waste tonnage records from November 2018 through October 2019 were reviewed, appeared complete, and no issues were noted. 18. Waste screening records for the Transfer Facility were reviewed from August 2, 2018, through November 25, 2019. No issues were noted and waste screening records appeared to be well maintained. Continue efforts to ensure that "an employee will conduct inspections of at least 1% of all waste received" as per the currently approved Updated Operation Plan (FID 1320282) and that all unacceptable waste is documented and disposed of properly. Operations - 19. Transfer Facility loading bays #1 & #2 (northern side) accept co -mingled recyclables from county collection sites, municipalities, and businesses. Transfer Facility loading bays #3, #4, & #5 (southern side) are utilized for MSW disposal. 20. MSW from the Transfer Facility is transported by Republic Services of NC, LLC (d.b.a GDS), who has subcontracted the actual transportation of the waste to K.R. Drenth Trucking Inc. (KRD). 21. Cardboard, newspaper, glass, and co -mingled plastics are collected and transported as necessary by KRD Trucking Inc., (sub -contractor for Republic Services) to a Republic Services materials recovery facility (MRF) in Catawba County, NC. 22. During this inspection, no unacceptable waste was observed. 23. The facility maintains (pressure washes) the interior walls of the Transfer Facility on a semi-annual basis, or sooner as necessary. 24. As discussed on -site and as noted in previous inspection reports dated 8/22/18 and 9/7/17, heavy wearing of the tipping floor surface, along the "cantilevered concrete load chute" located to the rear of loading bays #3-5, was observed during this inspection. The tipping floor surface appeared very rough in this location and in numerous areas exposed rebar was observed. Per facility personnel, Rutherford County is currently working with a consultant to develop and implement a plan to complete the necessary tipping floor repair(s). Please schedule maintenance of the tipping floor as necessary. 25. The tipping floor and receiving bay leachate collection grates, trench drains, and leachate collection system(s)/drains were maintained during this inspection. The leachate collection system at this facility is connected to the Town of Page 5 of 9 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section Spindale's municipal sanitary sewer system. Leachate from Transfer Facility operations is collected and discharged directly to this system for proper treatment. 26. The receiving bay contained minimal debris and was well maintained (photos #3 & #4). Since the previous inspection, the facility has constructed/added a wall (sheet metal) along the lower, eastern side of the receiving bay which, per facility personnel, has helped to control/reduce windblown debris in this area. The Section appreciates the facility's efforts to control windblown debris in this location. As discussed during this inspection, continue to maintain this area as necessary. 3. The transfer trailer staging area located to the north of the transfer facility was maintained. 28. The berm installed last year located at the MSW receiving bay entrance drive along the southeastern corner of the facility was maintained and appeared to be functioning as intended - to provide an additional layer of protection to facilitate the capture of any potential leachate that may be generated from the MSW loading/receiving bay(s). No solid waste issues were noted in this area. Continue to maintain this berm as necessary. 29. Minimal windblown debris was observed at the transfer facility. The Section appreciates the facility's efforts to minimize windblown debris at the site. Please continue efforts to ensure that windblown debris is collected and properly disposed of daily. 30. Vector control measures were maintained at the transfer facility. C&D LANDFILL UNIT: Records/Certifications- 31. Per C&D landfill records, the facility accepted on average approximately 28 tons of waste per day for the month of October 2019. Waste tonnage records from November 2018 through October 2019 were reviewed, appeared complete, and no issues were noted. 33. Waste screening records for the C&D landfill were reviewed from August 2, 2018, through November 15, 2019. Waste screening records for the C&D landfill appeared to be well maintained and no issues were noted. Continue efforts to ensure that all unacceptable waste is documented and disposed of properly. 34. The most recent semi-annual groundwater and surface water sampling monitoring reports for the facility dated July 31, 2019 (for Spring 2019 sampling event) and April 25, 2019 (for Fall 2018 sampling event) were available for review. As required, continue to monitor all groundwater and surface water sampling locations at the facility on a semi-annual basis and submit reports to the Section in a timely manner. 35. Methane data (Landfill Gas (LFG)) is currently collected in monitoring wells LFG-1, LFG-2, LFG-3, LFG-4, LFG- 5, LFG-9, LFG-10, and LFG-11. Additionally, LFG data is currently collected in five facility structures: scale house, transfer station #1, transfer station #2, maintenance shop, the storage building, and the adjacent animal shelter. Since the previous inspection, the four most recent LFG quarterly monitoring reports for the facility, as sampled on 11/6/19, 8/21/19, 5/21/19, and 2/6/19, were reviewed. All records were well maintained and no exceedances were noted. As required, continue monitoring for LFG on a quarterly basis. (Note: The site -wide LFG monitoring system that includes eight wells and five structure locations serves to function as a methane monitoring system that encompasses both the C&D landfill and the closed MSW landfill on -site.) OAerations- 36. The working face of the active C&D landfill was inspected and appeared to be well maintained (photo #5). The working face size was compact and well managed. No unpermitted waste was observed. The application of weekly soil cover appeared to be adequate. 5. Eastern view of active C&D landfill working face. 37. Continue all waste screening efforts at the C&D landfill working face. As necessary, segregate from the working face any unpermitted waste delivered to this unit and properly dispose of the waste. Continue to ensure that all windblown litter is collected and properly disposed of at the end of each working day. 39. As discussed during this inspection, continue to maintain all Sediment Basins associated with the C&D landfill unit as necessary. Continue to maintain all other erosion control measures at this unit such as ditch -lines, diversion berms, vegetative ground cover, etc. as necessary. 40. Continue to manage and control surface water to ensure it is diverted from all operational and storage areas of this unit. 41. Groundwater Monitoring Wells MW-3, MW-12, MW-13, MW-14, MW-15, and MW-16 function to monitor the C&D landfill unit. Groundwater Monitoring Well MW-2 functions as a background well for all facilities and is located up -gradient, towards the northern end of the property. Monitoring wellheads MW-3, MW-12, MW-13, MW-14, MW- 15, and MW-16 for this unit were observed on -site. Surface Water sampling locations SW-2, SW-3, SW-4, and SW-5a function to monitor the facilities on -site. The areas of SW-2, SW-3, and SW-5A were observed during this inspection. Access was maintained in these areas. (See the Status of Past Noted Violations Section in this inspection report for additional information regarding the water quality monitoring well network at the facility.) 42. Methane Monitoring (LFG) wellheads LFG-1, LFG-2, LFG-3, LFG-4, LFG-5, LFG-9, LFG-10, and LFG-11 were observed on -site. Access was maintained in these areas. (See the Status of Past Noted Violations Section in this inspection report for additional information regarding the LFG monitoring well network at the facility.) 43. As discussed during this inspection, continue to conduct mowing maintenance activities on the established ground cover of this unit. CLOSED MSW LANDFILL UNIT: 44. Please refer to additional comment #34 regarding the most recent semi-annual groundwater and surface water sampling monitoring report for the facility. 45. Groundwater Monitoring Wells MW-2, MW-4, MW-6, MW-7, MW-8, and MW-9 function to monitor the closed MSW landfill. MW-2 is the up -gradient well that serves as the sampling point for establishing the quality of background groundwater at the facility. Additionally, six Groundwater Monitoring Wells comprising two well nests, MW-10A, MW- 1OB, MW-IOC, MW-1OD, MW-11A, and MW-11B were installed in 1998 to provide additional data on the contaminant plume emanating from the disposal area. Groundwater Monitoring Well MW-l0A has an extremely low recharge rate and is not currently utilized as a sampling location. Groundwater Monitoring Wells MW-2, MW-4, MW-6, MW-7, MW-8, MW- 9, MW-1OB, MW-IOC, MW-1OD, MW-11A, and MW-11B were observed during this inspection. Access was maintained in these areas. As referenced in additional comment #41, Surface Water sampling locations SW-2, SW-3, SW-4, and SW- 5a function to monitor the facilities on -site. The areas of SW-2, SW-3, and SW-5A were observed during this inspection. Access was maintained in these areas. (See the Status of Past Noted Violations Section in this inspection report for additional information regarding the water quality monitoring well network at the facility.) 46. The site -wide LFG monitoring system that includes eight wells and five structure locations serves to function as a methane monitoring system that encompasses both the C&D landfill and closed MSW landfill facilities on -site. Reference additional comments #35 and #42 for information regarding LFG environmental monitoring at the facility. (Additionally, see the Status of Past Noted Violations Section in this inspection report for additional information regarding the LFG monitoring well network at the facility.) TEMPORARY DISASTER DEBRIS SITE DS81-006: 47. Temporary Disaster Debris Site (TDDS) #81-006 has been deactivated since the previous inspection. 48. TDDS #81-006 is located north of the facility offices near the current site soil borrow area.
