Clay County is in violation of 15A NCAC 13B .0105(c)(6) for failing to ensure that trailers were loaded, transported, operated, and maintained to prevent the escape of solid, semi -solid, or liquid waste to the environment. During the September 17, 2019 inspection, the facility was actively loading trailer 768. The turnbuckle for the rear door on the right (passenger) side of the trailer was missing and allowing waste to protrude out the gap between the rear door and side of the trailer. Remove trailer 768 from service until a new turnbuckle can be installed. 2. Implement procedures to inspect each trailer before loading to ensure that all trailers can meet the requirements of 15A NCAC 13B .0105. Missing Turnbuckle on Trailer 768 The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on September 17, 2019. 2. The facility hours of operation are Monday, Tuesday, Thursday, Friday and Saturday, 8:00 am to 4:55 pm. 3. Waste is temporarily being transported to the R&B Landfill in Homer, Ga due to issues at the Pine Bluff MSW Landfill in Ball Ground, Ga. 4. Signage was observed at the facility and on the Clay County Transfer Station/Recycling website stating that there is a ten ($10.00) dollar charge for recycling items containing freon. � 130A-309.81.0 states in part: `Management of discarded white goods; disposal fee prohibited. (b) Restrictions. - A unit of local government or a contracting party may not charge a�disposal fees or the disposal of white goods. The county receives a quarterly tax distribution from the white goods disposal tax which can be used for operating costs associated with managing discarded white goods, such as labor, transportation and freon extraction. Ouerations Insuection of the Transfer Station (2202T-TRANSFER-1997) 5. Windblown litter was minimal and well managed at the time of the inspection. 6. The tipping floor was in good condition and no unapproved material was observed. 7. Minimal material was observed behind the side push walls and facility staff stated that the area is cleaned daily. 8. The loading bay trench drain was clear and appeared to be working properly. 9. Minimal waste was noted on the loading bay floor and the facility cleans the area between each trailer and at the end of each day. 10. Facility staff move empty trailers into the loading bay, load the trailers and then move the full trailers to the loaded trailer shed. 11. The facility was loading trailer 768 during the inspection. While inspecting the trailer, it was noted that the turnbuckle that held the rear door closed on the right (passenger) side of the trailer was missing and waste was protruding out the gap between the door and trailer body. No leachate was observed leaking from the trailer. 1 SA NCAC 13B .OlOS(c)(6) states: "The vehicle or container shall be loaded, transported, operated, and maintained to prevent the escape ofsolid, semi -solid, or liquid waste to the environment. - See Observed Violations Sections of this report. 12. The construction of the loaded trailer shed parking area has been completed and the applicable documentation showing the trailer shed was constructed to meet all applicable building codes has been submitted to Allen Gaither. 13. Trailer 593 had a large gash in the rear door and was removed from service. The facility stated that they had been in contact with the contracted hauler about getting the trailer repaired or replaced. Trailer 593 must be repaired so that it can meet the requirements of 15A NCAC 13B .0105 before it can be placed back into service.
